Dear friends, the customer presented his retirement-benefit-cheque into Nationalized Bank whereat he and his institution also have the accounts. Hence, As the same bank is a computorized branch , immediately his cheque was honoured and the same was accounted into his account. on the same day , within minutes, the same customer's another cheque issued to his friend was presented and the same was also honoured and transferred into his friend's account . Subsequently , the customer presented his cheque for withdrawal , there is no sufficient balance in his account due to his friend's collection of customer's cheque. now ,the question is ' is it lack of deficiency of service'. Any land mark judgement? thanks in advance.

Kindly Provide the latest ruling on the Dishonour of the Security Cheque, whether Security Cheque deposited with the Bank attracts the Provision of Section 138 of N.I. Act more particularly when blank cheque is given &new oder?

A registered GPA for execution of documents

Two members (sons of the Managing Partner) of the family are sleeping partners and doing some private sector jobs away from place of execution of documents.

A registered GPA for execution of documents is available in favour of the Managing Partner i.e their father.

Is it acceptable to Execute all documents, including Personal Guarantees by the Managing Partner, as GPA, on behalf of the said two partners ?

service tax

i have a franchise business where company pays me rs 85000 per month as 32000 for staff salaries, 10000 for shop rent, 5000 as electricity bill, 2000 telephone bill, and rest 36000 as my commission.
Now after 2 years service tax officer are saying that as i am using brand name of a company so i am liable to paid service tax on my commission and there is no service tax assumption on my total commission.
Plz guide me what i can do or is i am liable to pay service tax on my commision. i.e; 36000 per month. Is there any assumption on my yearly commission.???
