Dear all,
my mom borrowed using sale agreement method from someone for 3% interest rate on 2012 Oct and the agreement tenure is 3 years till date we paid 1L interest. on last year July 2017 we requested him to make 1% so we can pay everything, but he refused to take money went to the lawyer notice we also replied for his notice. now they are calling for settlement and asking us to pay 2% interest. My question is if this case goes to the court then how much interest i will be paying for 250000? court will ask us to pay till 2017 July or till the hearing comes whole tenure we have to pay. Please help me to understand. 9844550017 nagarasu.ar@gmail.com

I have purchased a flat in Khativali Village of Shahapur Taluka in Thane District and got possession in 2013. The agreement for sale states about payment of maintenance charges @ 1686/- per month for three years from the date of possession of the flat. The builder has not allowed to form the Co-operative Housing Society unless the construction work of adjacent building is completed. The structure of the said adjacent building is left unattended for more than 3 years. Even after completion of 3 years in 2016, as required in agreement of sale, the builder has forced me to pay monthly maintenance charges at unjustified rate of Rs. 1686 (increased to Rs. 2248/- per month from 01-04-2018).
As per my knowledge, the maintenance charge is a sum total of Annual Repairs at minimum 0.75% of construction cost of a new building/flat, and, in addition, reimbursement of other expenses incurred by the builder on behalf of the flat owners. Accordingly, I have asked the builder to justify maintenance charges @ Rs. 1686 / 2248 per month for which he has chosen to be silent.
The flat owners are being forced to make payment of GST even on the reimbursement of other expenses like Panchayat Tax, NA Tax, Electricity consumption for common premises, etc, incurred by the builder on behalf of the flat owners. Moreover, The Co-operative Housing Society would have been formed within a reasonable period as per existing rules, regulations and practices if it had not been denied by the builder. In case of the existence of CHS, the payment of GST on Maintenance Charges would have been on different footings.
In view of the above, I am in need of your expert advice in light of the existing rules, regulations and practices in the matter relating to maintenance charges and GST thereon in such forced circumstances. - Chandraprakash B. Morjal (Mobile No 9987093041).
A member of a co-operative housing society in Mumbai made a will wherein his flat be transferred to 4 named individuals. The administrator (also one of the will holder) applies for probate of will and obtains a letter of administration from high court. The letter administration name the administrator as the legal owner of property. A testament of the will attached to the order mentiones 4 individuals with 25% share each on the flat.
1. I want know whether the society has to transfer the flat and endorse all 4 names of individuals or only the administrator's name to be endorsed on share certificate?
2. After obtaining the letter of administraion one of the will holder dies intestate, and in case the wife of the deceased person claims to transfer the 25% share of the deceased person, (after following procedure as bye law No.35) and makes application to society for admission, whether society to transfer the flat to the spouse of the deceased as nominee or absolute owner of the flat?
We are bit confused and hence this querry. Thanks

I am having a proprietorship firm registered with MSME. I have a limit of 1.4 cr (1 crore fund base and 40 lac non-fund base) by Yes Bank. I wants to change my bank from Yes Bank to HDFC Bank. For this bank is charging 2% pre-payment charges. At the time of opening bank account with CC limit facility in the year 2013, my limit was 55 lacs. My sanctioned letter was issued in 2013, 2% pre-payment penalty clause was mentioned on 55 lacs, after that limit renewed every year. Now bank is asking for- closure charges on whole amount of 1.4cr. I have heard about new circular from RBI, if any firm is MSME registered firm, no pre-payment charges applicable ?? Kindly help me with a solution so that i can change my bank and gets my property papers back from bank.
Locked in the marital home
I am planning to take a divorce from my husband. He is very abusive and oppressive. We both live in an independent house with nobody around and he keeps me locked inside the house in his absence. I do not have any relatives who can come and deal with him. Please advice me how do I go about it. Will a lawyer be able to get me released from his captivity(Probably by filing a police complaint) ? What will be the next step if my husbands objects for this ?
Please advice and oblige...
