S.149(2)M.V.Act

Whether when Insurance Co. is challenging the Award only with respect to S.149(2),permission under S.170 is still needed in filing appeal? To me it is not legally required.Want a ruling for this as urgent.

Mr Ranjit nad rani got married on 1/4/75 as per hindu rights and customs But Mrs ranjit approached to District court, aurangabad for divorce in 79 and obtained Decree, Ms. Rani remained unmarried. in jan 81 Mr. Ranjit came to know that Ms Rani gave birth to a female child named Ranjitha.
Some time later Mr. Ranjit got married to one Madhuri and was leaving a happy life with two children Bunty and Bubly

During Financial Year 06-07 Mr. Ranjit filed an income tax return where in he has shown a family property consisting of a resendital property where he is leacing noew and a commercial complex located at Nirala Bazar, Aurangabad worth 5 crores. this property was inherited form his father.
Ms. Ranjitha got maried to mr. yusuf who is medical doctor. Ms ranjitha sent a legal notice on jan 1 07 claiming a share in Hindu Family property in capacity of Daughter.
Mr Ranjit denied that Ms Ranjitha was born to him. The Family court aurangabad directed for the DNA test for both the parties. but mr ranjit refused to undergo the same. then family court held that mrs ranjitha is a legitimate daughter of Mr Ranjit.
Aggregieved by diposal order of the family court, Mr Ranjit challenged this order before Hon'ble High court of Bombay, Bench at aurangabad.

Imposition of levy

Can a royalty (or any tax or fee) be imposed, for the first time, without the authority of law or a notification not having the force of law (i.e. through a mere executive decision)? If not, continued payment of the levy for more than three decades would be held out as an estoppel or limitation for seeking relief from the Court?

MISLEADING WBIC COMMISSIONER

My several applications and appelate letters under RTI Act to SPIO and Appellate Authorities of 1.Kolkata Police, 2.Writer's Building, 3.KMC, and 4.WBHRC come under DEEMED REFUSAL either on their irrelevant and incomplete reply or NO reply. I made complaint of all the four incidents to WBIC on ^th June 2010 for which the commission took its own sweet time till the commissioner retired on August 2010. After repeated marathon followup with Deputy registrar/secretary of WBIC, he, promised to do hearing during Feb. But I am shocked to receive a copy of soft reminder sent by WBIC to the SPIO/AA to all of them to reply within 15 days.

DOES SENDING THESE SOFT REMINDERS COME UNDER ANY OF THE PROCEDURES OF RTI ACT, PLEASE DETAIL.

After this drama the SPIO of Kolkata POlcie sent a reply to me under copy to WBIC with the same irrelevant and incomplete reply against I gave complaint to WBIC.

Why the WBIC is doing this TIME-PASS trick with me. Whom they are protecting? Except Kolkata Police all the others are yet to act.

Now what is the recourse to me. Why should a already victim be victimised repeatedly?

After exhausgin all the procedures of RTI Act If I have to file a WRIT at Kolkata HC, does not this mean that the RTI Law is inadecuate to serve its purpose. Instead of going to HC is there any remedy. Can I knock the Governor of WestBengal, who through a gazette introduced RTI Act in WEST BENGAL?

Stamp Duty on Mortgage Registration

Sir,

I hv two property to morrgate against single loan in gujarat

When I registered First property, i have paid 0.25 of Loan amount as stamp duty. Now while registering other additional property against the same loan, whether I have to pay again 0.25 % stamp duty on additional mortgage ?

Information to assist injured person on road by accident

Like to know about helping accidental injured person on city road or on highway.
General impression prevail that helping such injured person on road accident leads & indulge to unnecessary legal procedure & harassment by police. Query: If some unkown person lying on road by some road accident, the vehicle & driver which committed this accident ran away. We just pass by this and stop to help this injured person. We call 108 by cell or carry such person in our car to hospital, in short want to help this person on humanity ground.Whether we have to indulge in legal problem by police on Panch Nama or summon by court during the case? As usually civilian try to help such person but when thinking of this Police harassment problem they just watch, express pity on lying person and drove away.Now a days Car No plate is like MH-11-N-0000 if want to note no. of car / vehicle which no. is important to remember? The whole no.plate or the last digit no.? Shall be thankful if reply.This information is helpful to us and to all good civilians.Thanks

Getting information through RTI

Resp.Sir,
I am employed through a agencies (outsource) in a Central University. My employer who is outsource agency not getting me actual information of my salary which is provided by Central University.Could I getting information through RTI ACT and if,please suggest me procedure for taking information to central university and what the remedy if my employer not enroll his agency in ESI but deduct the same.
