Pay protection regarding

Sir,
My name is shajumon ss have been completed 17 years of service in CISF on a post of constabe/fire under(MHA) .I was applied for the post of fireman II at a wage scale of 8400/- through proper channel my application for the new post forwarded to COCHIN SHIPYARD LTD .After got the appointment letter my resignation has been accepted Technically and joined in CSL as on 03/11/2016 on a pay scale of 8400/. When I am applied for the post my basic pay in CISF was 12300(inluding 2400 GP).After the pay fixation of Central government employees my basic pay was fixed into 33300/- that I am drawn for the month of OCT-2016 from CISF. The new firm is not providing any pension scheme. So the terminary benefits and pro-rata pension process is under progress.
So please suggest me sir whether I am eligible to avail pay protection from the new job.If I am eligible what will be my new scale,and what is procedure ?.

Pay Protection in technical resignation

Sir, I was working in one Department of Central Government of India. After one and half year of service I on technical resignation joined another Department of the Central government. However, I was not given pay protection and my basic pay was restarted from the initial level. There are other colleagues who have been given the pay protection. Is there any way out.

Mact case related

Dear Sir,
I am the conducting lawyer of the Insurance company in a Motor Accident Claim Case. After the evidence of the petitioner , I was not able to attend the case as I fell ill due to a tumor in my brain. The petitioner lawyer taking advantage of this cunningly manage to fix the case on 4 different dates with in a month and judgment was pronounced. I have not adduced evidence and have not argued in this case. 5 months after I suddenly came to know about the judgment. Can I be allowed by the High Court of Orissa , if a case is filed before the High Court to allow rehear the matter and permit me to adduce evidence.

Please comment.

Rti information not received after gic final order

Dear Sir,

As I filled RTI for seeking information but PIO did not response upto 30 days then I filled 1st Appeal against PIO to FAA (First Appeal Authority) but the FAA did not ordered to PIO for providing complete information as per RTI application at the 1st appeal hearing.

Then the PIO provided wrong, misleading information so we filled second appeal to GIC against PIO and FAA. The GIC disposed my appeal and ordered FAA that the applicant is not satisfied with the PIO's answer hence GIC ordered PIO and FAA to give chance of hearing to applicant and PIO ane make assumption each point by point until the applicant not satisfy. This order was passed to PIO and FAA but after the order received to FAA and PIO but till date we have not given chance for hearing and also they didnt provided the information till date after the GIC order.

1. Now, I want to know that can I file complaint to GIC if already filled second appeal and GIC order passed ?

2. Can I just send simple application to GIC for informing that the FAA and PIO didnt obey your order and didnt provided information till date ??

3. Do I have to file writ petition to Gujarat High Court ?? Do I have to find lawyer for that or the writ petition can be filled be us ? What will be the possibilities for result ? How much it will cost ?

I request you to please guide further.

Help and Guidance on Appointment Letter in FCI

प्रार्थी ने भारतीय खाद्य निगम में परीक्षा पास कर टाईपिस्ट (हिंदी) के पद पर चयन पाया है जिस पर प्रार्थी को नियुक्ति पत्र जारी किया जा चुका है. परंतु डॉ भीमराव अंबेडकर विश्वविद्यालय, आगरा संबंधी कारणों से कार्यग्रहण नहीं करने दिया गया (होल्ड पर रखा गया). निगम द्वारा प्रार्थी के स्नातक योग्यता B.A. (जोकि Dr. Bhimrao Ambedkar University, Agra से हासिल की है) की सत्यापन हेतु पत्र भेजा गया जिस पर विश्विद्यालय सत्यापन नहीं कर रहा है जबकि एकबार विश्विद्यालय सत्यापन कर निगम को पत्र भेज चुका है! अब विश्वविद्यालय में किसी एक नियमावली का हवाला देकर प्रार्थी के कुल अंकों में 1 अंक की घटी कर नई अंकतालिका जारी करने के लिए कहा जा रहा है। जबकि प्रार्थी को B.A. III, 596/1200 अंकों से उत्तीर्ण की अंकतालिका जारी की गई थी, प्रोविसिनल डिग्री भी जारी की गई. जिस के आधार पर प्रार्थी ने भर्ती परीक्षा पास कर चयन हासिल किया। साथ ही एक बार सत्यापन भी किया जा चुका है जिसमे 596 ही अंक बताये गए थे। लेकिन अब विश्विद्यालय के रिकॉर्ड में पास के स्थान पर पेन से RD/PMW लिख दिया और Re-Examination संबंधी किसी नई नियमाबली का हबाला देकर 1 अंक की कटौती कर नई अंकतालिका जारी करने को कहा जा रहा है।

अतः उक्त संबंध में प्रार्थी को क्या करना चाहिए, जिससे कि प्रार्थी नियुक्ति पर कार्यग्रहण पा सके। कृपया सहायता करें तथा कोर्ट या जांच संबंधी शिकायत कहाँ की जाए...?

Karnataka state public record act 2010 & 2013

Sir,
Im working in Karnataka State Govt Dept and working in RTI Section.

In my Office file pertaining to a complaint has been lost and it has not yet traced. In meantime complainant has filed RTI in r/o that complaint. We gave reply that the same has not been traced. Finally in that case Karnataka Information Commission has ordered that to take action as per Karnataka State public record act 2010 & 2013 against the Govt. Employee who is responsible for lost of Govt. Record.

Please guide me what are the steps to be taken from my Office against the concerned who is responsible for loss of record as per Karnataka State public record act 2010 & 2013 '

Is it mandatory to give copy of "written argument" oppnent?

I appear in person in my case. Last date was fixed for the argument, but the petitioner's Advocate asked for the adjournment stating that he is not ready. I filed the "Written Argument" & supplied a copy to the Opponent also.

My questions are:---

1. Was it right, that Judge Saheb gave an easy adjournment to my opponent just because he was not ready to argue? Was this a valid reason? Though, it was his case.

2. Was it mandatory for me to give copy of "Written Argument" my opponent?

3. Who submits the Argument first in a case, the Petitioner or the Respondent? Is there any rule?

Note:-- I being the Respondent was asked not to stand in my left side before Judge Saheb. There are many unwritten rules of the Court, that is why I am asking subtle questions. Any more suggestions for ppl like me appearing in person would be very much helpful.

Clarification of SC status of dalit Christian reconversion

Respected sir, I belong to Christian dalit and I enjoy obc reservation.. My father is a hindu dalit and he enjoys SC reservation.. If I convert to Buddhism can I get SC reservation or only converting to hindu religion can get me SC reservation? Thanks in advance

Meetings under societies registration act 1860

Can a registered Society conduct a Governing Body meeting through video conferencing. If yes will those members who participate through video conferencing be counted as part of the quorum.
