Complaint U/S 138 filed on 04.05.2018 but the affidavit in support and evidence by way of affidavit dated 02.05.2018. whether it is valid affidavit or defective.

I am Rakhi Missra.
My husband died due to carelessness by Applo Hospital Gurgoan. I filed consumer case and I am fighting it alone.
The Forum has given me compensatoin of 20 lakhs. And the hospital has ont paid anymoney till now. So I filed executoin petition. Under 200 section. Warrant has been issued. The hospital filed appeal in state commission but it got dismissed. But they deposited 10 lakh wiht commission. Now how to get that money?
The hospital advocate has stopped appearing in execution case.
Next what to do? How to get the money from the hospital.?
Please guidde.

Whether the complainant under NI case can drop one of the accused person from the case, stating the person has nothing to do with issuance cheque. Any decided case law please.

I want to know that in 3dpdp act if chargesheet is filled in the lok adaalat and also case is settled with a minimal fine, Is we are going to be ineligible for any govt. Job

Hi all
I am the manufacturer and I had supplied goods with Rs 200000 to the dealer and he didn't make the payment for 9 months and at last he gave us the cheque of the total amount and those were bounced due to insufficient funds. And the next day I called him and asked for the payment he said give me another one month I will make the payment. But still he has not made the payment.
Now I wanted to send him a notice, but the lawyer said the time period to issue notice is within 15 days which I have missed.
Now what is the procedure furthur i can take to recover my money
Kindly guide me on this

We have an advocate staying in our society , who in drop of the hat sends notices , inimidates us with defamation and litigation . He has not been cooperating with the society development , and challanges each and everyhting through notice . Due to this the committe is fed up and members do not want to come forward to be a part of MC .
We effected members are tired of him throwing his weight around on small pretexts and constantly being harrassed with notices . We had a plumbing audit for leakages , he refused to allow the security and plumber to check the same .

Dear Expert Sirs,
in a SRA Project a plot of land was de-marketed and dedclared as a reserved plot for PG. the Builder has not yet transferred said plot in favour of BMC as the project is not yet complete. the Tehsildar issued a demand notice for revenue on the entire plot of land against which the builder approached the office of Tehsildar and showed the notification about the declaration of said part of land reserved as PG the Tehsildar the asked to pay the revenue amount of the plot deducting the revenue of the PG plot area and builder has paid the amount.
After a year they again issued a notice of demand along with the arrears stating that you have not transferred said plot in favour of BMC hence you have to pay the amount with penalty.
The builder has filed an appeal u/s. 247 before Addl. Collector which was decide against the builder and the Addl. Collector has directed the Tehsildar to take action and issue notice with demand of double of penalty.
the Builder who has contested the matter in person now approached me to challenge said order of Addl. Collector. This is my first matter in the subject act. I need your guidance to contest the matter. please help me for this.

ಸರ್, ಕೆಲ ವರ್ಷಗಳ ಹಿಂದೆ ನನ್ನ ತಂದೆ ಅಪಘಾತದಲ್ಲಿ ಮರಣ ಹೊಂದಿದ್ದರು. ಆ ಸಮಯದಲ್ಲಿ ನಾನು ಅಪ್ರಾಪ್ತನಾಗಿದ್ದುದರಿಂದ ಅಪಘಾತ ಪರಿಹಾರದ ಹಣವನ್ನು ಮಾನ್ಯ ನ್ಯಾಯಾಲಯವು ಬ್ಯಾಂಕಿನಲ್ಲಿ ಜಮೆ ಇಟ್ಟಿತ್ತು. ಕಳೆದ ವರ್ಷ ಈ ಮೊತ್ತ ಪಡೆಯಲು ನಾನು ಮಾನ್ಯ ನ್ಯಾಯಾಲಕ್ಕೆ ಒಬ್ಬ ವಕೀಲರ ಮೂಲಕ ಮನವಿ ಸಲ್ಲಿಸಿ ಅನುಮತಿ ಪಡೆದಿದ್ದೆ. ಆ ಅನುಮತಿ ಪತ್ರ ವನ್ನು ಬ್ಯಾಂಕಿಗೆ ಸಲ್ಲಿಸಿ 3 ಬ್ಯಾಂಕ್ DD ಪಡೆದಿದ್ದೆ. ನನಗೆ ಪರಿಚಿತರಾಗಿದ್ದ ವ್ಯಕ್ತಿ ಒಬ್ಬರು ಆ ಮೂರು DD ಗಳ ಪೈಕಿ ಒಂದನ್ನು ತಮ್ಮ ಬಳಿ ಇರಿಸಿಕೊಂಡು ಎರಡನ್ನು ಮಾತ್ರ ನನಗೆ ನೀಡಿದ್ದರು. ಆ ವ್ಯಕ್ತಿ ತನ್ನ ಬಳಿ ಇರಸಿಕೊಂಡಿದ್ದ DD ಬಿಟ್ಟು ಉಳಿದ ಎರಡೂ DD ಗಳ ಮೊತ್ತ ನನ್ನ ಖಾತೆಗೆ ಜಮೆ ಆಗಿದೆ. ಆ ಇನ್ನೊಂದು DD ಯನ್ನು ಕೊಡುವಂತೆ ಆ ವ್ಯಕ್ತಿಯ ಬಳಿ 9 ತಿಂಗಳಿಂದ ಕೇಳುತ್ತಾ ಇದ್ದರೂ ಅವರು ನೀಡುತ್ತಿಲ್ಲ. ಬ್ಯಾಂಕಿನಲ್ಲಿ ಹೋಗಿ ಆ ಇನ್ನೊಂದು DD ಕುರಿತು ವಿಚಾರಿಸಿದಾಗಲೂ ಅವರು ಆ ಪರಿಚಿತ ವ್ಯಕ್ತಿ ಯ ಬಳಿಯೇ ಕೇಳಿ ಎಂದು ಸಬೂಬು ಹೇಳುತ್ತಿದ್ದಾರೆ. ಆ ಮೂರು DD ಪಡೆದ ದಿನಾಂಕ ಮತ್ತು ಒಂದು DD ಹೊರತು ಪಡಿಸಿ ಇನ್ನೆರಡು DD ಗಳ ಸಂಖ್ಯೆ ನನಗೆ ಗೊತ್ತಿದೆ.
ನನ್ನ ಹೆಸರಿನಲ್ಲಿ ಇರುವ DD ಇನ್ನೊಬ್ಬರು ದುರುಪಯೋಗ ಮಾಡಿಕೊಳ್ಳಲು ಸಾಧ್ಯವಿದೆಯೇ? ಆ DD ಯ ಪ್ರಸ್ತುತ ಸ್ಥಿತಿಯ ಮಾಹಿತಿ ಪಡೆಯುವುದು ಹೇಗೆ ದಯಮಾಡಿ ತಿಳಿಸಿ.

Refusal by courier service to deliver
Dear sir
I got a courier sent by friend . At the time of taking the parcel for sending, the courier company did not raise any objection as to the delivery service area of the address. When the courier reached the place near to my address where the courier company has a branch, the branch people who received the parcel telephoned me and informed me that I have a courier. For that I asked them, being courier service they are supposed to deliver the parcel at the address mentioned on the cover. For that they said they can not deliver the parcel as the address is not covered by service area for delivery. And they asked me to come to their office to collect the parcel. For that I said I can not come to them and I would like to lodge a complaint. They said no problem and I can proceed. I immediately lodged online complaint with courier site. Later I found on the site a remark stating " CUSTOMER REFUSED DELIVERY". I immedaitaley gave another mail stating the facts and mentioned that I never refused to take delivery if the parcel is delivered at my address. There is no respones from their end. My query is will the action of courier people amounts to deficiency in service?. Do I have a defendalble case? Can I make complaint in consumer forum at my district head quarters.
