Consumer Dispute Redressal Commission

My original Complaint was in the District Forum of the Consumer Dispute Redressal Commission. The Complaint was dismissed & Order was passed against me and the Judgment was full of errors. I had appealed to the State Commission,Mumbai.

The State Commission stated in its order that the order passed by District Forum is bad in Law and the Forum has not gone into details placed on record. The State Commission passed the following order:
1.Appeal is allowed. Impugned Order is set aside
2.Complaint is remitted back to the District Consumer Forum for fresh disposal
3.Forum below is directed to re-hear the parties after remand and to decide the complaint afresh in light of various issues raised by the parties.
4.Both parties are directed to appear in the District forum on _______
5.No order to costs
6.Copies of order be funished to both parties free of cost.


Need some inputs on the above judgement:
1. What does "No order to Costs" mean?
2. Will the case start afresh in the District Forum since the Judges have changed ?
3.Does court fees have to be paid again in the District Forum?
4. What will be the procedure if we have to file fresh affidavit for happenings after the final hearing in the District Forum.
5.Does a Caveat need to be filed in the National Commission?
6.Will the time frame be as lengthy as in the initial case in the District forum?

Would really appreciate to be advised on the above.

due date and time for payment of instalment.

This in reference of instalment due on loan. Suppose instalment due date is 7th of a month. There is no money in the account on 7 th at 10 am to say 11.30 am in borrowers account. Borrowers cheque was cleared into his account by 12.30 o clock. Therefore sufficient funds were in the borrowers account after 12.30 o clock on 7th of a month.Bank bounced the installment ch. presented on 7th before 12.3 o clock for want of funds. Please advice what is the time when liability to pay instalment on particular date is fixed.does it make any difference if instalment iscollected through ECS.

Kindly let me know whether any bar on limitation for filing an application u/s 111(4) of the Companies Act,1956? If yes under which section and what is the remedy.

jurisdiction in respect of filing an application u/s 111(4)

I am a resident of kolkata.
I want to file an an application u/s 111(4) of the companies Act,1956 against a company having regd office at Hissar(Haryana).Kindly let me know where I have to file the above application at Delhi or at kolkata. I sthere any special provision for that?

change of user

does it amount to change of user if one is using a residential flat as office of a law firm. And can a society pass a resolution in the AGM and increase the non user charges by 10 times just because the place is being used as a law firm.

I would like to know if there are any rulings or citations to this effect.

In a given case, a person is working as a law officer simultaneously in more than one organisation. He is representing the respective organisations in the Court of law.

Can an individual act as a law officer simulataneously in more an one organisation?

Subject – To stop running of unauthorized grinding unit of adulterated & misbranded spices (Red Chillies, Black Pepper, Turmeric Powder and other Spices) at NH-394, Opp. Balmiki Gate, Mohalla Krar Khan, Jalandhar City.

Respected Sir

I'm writing to inform you about the inconvenience we are facing because of the extremely air pollution caused by grinding unit of spices near my Residence NH-391 Opp Balmiki Gate, Mohalla Krar Khan, Jalandhar City. It has been happening on a regular basis day & night. I have to inform you that it is causing a great deal of disturbance to us due to this problem residents of the locality including my parents & children are facing problems and symptoms of upper respiratory tract irritation such as sneezing , coughing & runny nose. It is to bring in your kind notice that Mr Roshan Singh & his sons has been carrying out this activity at NH- 394, Opp Balmiki Gate, Circular Road, Jalandhar.
This activity is being carried out unauthorisedly without obtaining any license & NOC from the Municipal Corporation. Mr Roshan Singh has also not obtained Pollution Certificate from any competent authority. The process of grinding and mixing of Dried Red Chillies, Black Pepper, Turmeric Powder and other Spices, inhaled for long periods, causes uneasiness and diseases to the residents of the Mohalla & children, it may easily affected from chest related diseases like Asthma.


It is kindly requested that this unauthorized grinding unit that is bringing miseries to the residents be stopped from its operation giving relief to the residents of the Mohalla.
Your early action will be highly appreciated.

Case Procedure Question?

Que.1.Dear Experts, If Respondent doesn't turn up for the First Hearing the Court would pronounce Ex-Parte Judgement, but What if the Petitioner himself nor the advocate for the Petitioner is attending after attending for 5(Five) hearings for thier Divorce Suit , What would or should the Judge do to my counters?
