FSI of one building out of six buildings

Ours is a co operative housing society in Mumbai. Society has 6 buildings (94 flats). Now one of the building with 16 flats has formed a FSI committee and going ahead with the construction of additional FSI granted by govt. Two of the members of this building have given a written letter to the society that they are not willing to take part in the additional FSI and therefore have not contributed monetarily.
Now one of the non participating member wants to sell of his flat and the FSI committee is insisting on the managing committee not to give NOC to the member without the FSI committee's NOC as the FSI committee feels that the non participating members are also bound to share the cost incurred towards common column. Please advice whether FSI committee has the right to ask the managing committee to consult them before giving NOC to the member.

Medical Negligence.

In the shadow of medical negligence and allied topic-

1. Whether a doctor can use his professional judgment to expand the scope of the operation when the patient is incapable of giving consent?

2. What are the criteria for determining whether an expert witness is qualified and eligible to testify regarding the standard of care in the medical field?

3. Does the number or relationship of the defendants alone determine whether the doctrine of Res-ipsa-loquitur applies?

4. Whether a defendant surgeon can claim innocence on the basis of action taken in good faith.? (a situation where the doctor did not take consent to conduct additional surgery)

overcharging of mineral water - contempt of court

Hi Raj Kumar Makkad,

To my earlier query on the sam eissue you responded that,Its illegal practice to overcharge mineral water in restaurants but some one should come forward to resist it and bring such hotels to High Court under contempt of court act.

May you please suggest what can be done in such a case? How much more can they charge?

Please advice.
