Who is qualified for ia

Dear all,

i see that most of the firms esp Big4 employs B.com graduates to do Internal Audit for companies (MNC/Listed/etc. They also do have CA's.

I understand that Statutory Audit needs to be conducted only by a qualified CA. Why not this is applicable for Internal Audit conducted.

Being a B.com they lack competence and skills these remain unknown to clients and presume they are CA aswell.

Should ICAI come up with a regulation or stating who is certified to be called as Internal Auditor first of all and the qualification one requires.?

Also if Internal Audit can be executed by anyone like Graduates / MBA then why become a CA...?

I need suggestion as to how this can be taken forward.

Thanks Indeed!
Regards

Pension benefits

My colleague retired from the bank on superannuation. A case is pending in the CBI court in Mumbai where he has been made accused. He is a pension optee. The bank is not releasing gratuity. Whether it is proper on the part of the bank to withhold the gratuity, when it is clearly said that gratuity can not be hold back under any circumstances as per gratuity act. Does pension regulation overrule gratuity act?

What would be the effect under section 32(2)(a) where the respondent objects to the order and the arbitral tribunal does not recognise a legitimate interest on his part in obtaining a final settlement of the dispute. Will such a decision be final?

Bombay public trust act 1950

BPT Act 1950 does not speak of de jure and de facto trustees. However, a de jure trustee is a person who is appointed one and de facto is a person who carries the function of trust under some arrangement. My query is: Whether a trustee or trustee board appointed by the Charity Commissioner under Sec.50(a) of the Act while framing a scheme for the trust, becomes de facto trustee or trustee board as the case may be, after expiry of tenure of appointment? If so, what would his/its rights and liabilities if the trustee/trustee board continues to function after expiry of that tenure?
