A bunglow at Rajasthan Udaipur stands in the name of one brother and there are three brothers in the family. 22 years ago a mutual agreement was made between those 3 brothers regarding the partition of the family and in that all of them agreed to share all expenses and income of the bunglow equally and in future if they sell the bunglow all the proceeds will be divided equally but now one of the brothers is violating that condition which was written on the Rs. 50 stamp paper theyre not sharing any rental income earned since the last 30 years and also they're trying to sell out the property without the 3rd brothers consent. What is the remedy for the third brother in this situation.

I am based out of Maharashtra, i, being the nephew, intend to gift shares of a listed company to my Uncle (partly) (My Mother's Brother) and my Aunt (partly) (His spouse), who are again based out of Maharashtra. could you please guide me as to how much stamp duty shall be payable, considering following points;
1. Does the concession in Stamp Duty cover transfer of Shares
2. Does the above mentioned transferor and transferee be called Relatives under the Maharashtra Stamp (Amendment) Act, 2015
Further could you please also guide me w.r.t. place of registration of Gift Deed in Maharashtra, Mumbai, in specific

Hi..
My dad has shop in khar on paghadi system. Now he want to sell it. Intially landlord is not allow to sell but now she is ready on 33%.
Now main issue is that if new tenant wants to sell the said shop in future he will give 33% to landlord on his "profit". For e.g. today if he purchase shop say in Rs.50Lac and in future if he sell shop in Rs.80lac so he will pay 33% on profit i.e. 33% on 30Lac only but landlord denies she wants 33% on 80Lac.
Is there any such type of law exist? And if it is then please provide legal back up document?
Kindly advice.

My father own a pagadi system house in south Mumbai. He is not staying in that house since last 4 years due to some health issues. Now the property owner has sent a letter to surrender the house within 1 month after receiving this letter.
1. Can i sell this house now?
2. Is there a rule to surrender the house if we dont stay in that house for certain period ?

I have entered into agreement for purchase of flat in Mumbai. After paying initial token amount, we have made MOU on stamp paper with the owner of the flat saying that in case of breach of agreement, owner should return double of initial token amount. The MOU was made on stamp paper and not registered. After paying full amount of our share to the owner i.e. Rs 47 lakh, stamp duty of Rs 6,25,000/-, registration charges of Rs 30,000/- and TDS of Rs. 1,13,000/-, now owner has refused to give documents to submit to bank for disubursment of loan amount and refuse to hand over possession. Please guide me how to get documents for possession or penalty as mentioned in MOU from the owner for breach of registered agreement.

Hi,
I am in process to buy SRA property which has 2003 agreement and year 2005 SRA Smart card. It has also got SRA OC on 2009.
Bank is asking for following documents to process my loans.
SRA NOC and indemnity of non-registration.
Could you please let me know what is the process to get these documents?
Also any other check list before buying this property.
