Bank guarantee in redevelopment

SIR,
OUR HOUSING SOCIETY HAS UNDER TAKEN REDEVELOPMENT PROCESS.
THE REGISTERED DEVELOPMENT AGREEMENT PROVIDES FOR BANK GUARANTEE OF RS 15.30 CRORES.
NOW SOCIETY HAS CONVENED A SGBM MEETING AND PASSED A RESOLUTION THAT THE BANK GUARANTEE MAY NOT BE TAKEN AND FIXED DEPOSIT OF RS 12 CRORE BE .OBTAINED IN LIEU
OF BANK GUARANTEE.
CAN SOCIETY PASS SUCH A RESOLUTION .
I HAVE ASKED TO TAKE LEGAL OPINION OF THE APPOINTED ADVOCATE BUT IT HAS NOT BEEN TAKEN .
THE RESOLUTION WAS PASSED IN A SGBM WHERE AGENDA WAS TO DISCUSS THE PLAN OF NEW BLDG,
THE NOTICE STATES AGENDA TO DISCUSS THE PLAN AND ANY OTHER MATTER WITH PERMISSION OF CHAIR.
CAN THEY PASS SUCH IMPORTANT RESOLUTION IN MEETING WHERE AGENDA WAS NOT INFORMED EARLIER.
THE ORDINARY MEMBERS CAN NOT UNDERSTAND THE IMPORTANCE OF BANK GUARANTEE AND IT WAS PASSED BY THEM IN THE NAME OF MAJORITY

Rights on land

Hello, My Uncle register our land on his own name without knowing us. We live in same building which that land occurs. We have fear he will tress passed on our land. Our house is on my name but they will may give difficulty to our children in future. We don't have trust on him. This land register on his name since from 27-28 year . previously it was on my grandfather name. Pls help us regarding this. I don't have much knowledge about this.

Regarding missue of visar pavti against we registered docume

We ( suppose C ) buy a land in year 2009 from person A by doing registered documents and sale deed, in 2011 person B file case against we ( C) and A as A & B has done visar pavti in 2007 ..and there issue is going on ..we were totally unknown about that...
a) is there any law where missue of visar pavti can be prevented
b) is there any supreme Court judgement where ..he cannot file case against us means ( visar pavti person cannot file case against registered person )

Currently the case status is under preparation.

What is the legal definition of the term - granting rights in rem deriving from ownership giving the right to use real estate. Basically what does it mean?

Rental amount is being asked to transfer to another account

Dear Experts,

My sister is staying in a rented house, the landlord has moved to overseas.
Now the landlord is asking to pay the rental amount into his father's account.
What is to be done in this case.

Harassment by Neighbor

Hi, I live in a Chs in Mumbai and for years now, the person staying below my house has been harassing my tenants. 2 families have already vacated the flat and the 3rd tenant is currently being harassed. I use my current flat rent to pay the rent for the flat I stay in and I already am on financial crisis. He doesn't want anyone staying in my flat. He uses all means of harassment including going on the terrace above my house and throwing huge weighted stones. Even if there is slightest of noise from my house, he and his family come to my flat and start abusing and threatening my tenant. Written complaint Has been given to the Secretary of my Society, however they have refused to take action saying this is a civil issue. Tenants refuse to come to police station. I want to understand if I am able to convince my current tenant to come with me to the cops, what all can I do? What can I also do legally? I am mentally vv harassed and this has started affecting my health too.. If I don't get rent, I will get in a miserable situation. The society and all its members are hopeless. I need proper guidance in this pls.

Ancestral agriculture land dispute

Ancestral agricultural land of 7.8 acre in Cholavaram west of Cholavaram Panchayat. In 1960 my grand mother owner of above land made a will for the above land and registered it in Kannamangalam sub registrar office that the said property should be equally shared by her two sons 1. Late M Govindareddy (my father) No 2. Late Adhikesavareddy (my uncle). in 1981 both the brothers divided the land mutually not registered it, that time a portion of 30 cent of my father's share grabbed by my uncle's sons and used it. In 2005 a formal Patta was issued by vellore taluk in which the 30 cent of my father's share also included in my uncle's patta In 2012 my uncle's four legal sons divided their share and my father's 30 cent land also and registered in their names without our consent. As my father was died in 2001 and my uncle died in 2013. We are three legal heirs to my father (late M Govindareddy) we all were unaware about the above malpractice since last year. Now my question is it possible to get back the 30 cent of land from my uncle's sons ? If so how can we move kindly suggest us ....

How to get family tree/legal heir certificate in mumbai?

I see in internet that in mumbai/maharashtra Family tree/legal heir certificate is issued by Tahasheeldar only to government employee and Mill workers. If so, what other citizens should do to transfer khatha of properties of parents or spouses?
how poor people in rural areas of Maharashtra get family tree to transfer assets? how corporate people get transfer of funds after the death of a person?

my known person living in worli,mumbai has a site in bengaluru, his wife has passed away. now to transfer of khatha of that site from wife to husband it requires family tree. since there are no documents of this person from bengaluru. he should get family tree from mumbai only. so, how to get family tree or legal heir certificate in mumbai?
