Need to know the procedure

Hi

I have a agri land in Daudpur U.P. And it's registered with the name of my father. He died 1 year ago. Now my tau ji is saying you need to pay 50 to 60 k to transfer under my name. I said what you are talking about. The land automatically get transfer to the child or mother . Why shoul i pay this hefty amt. I need to know is this true? And also tell me the procedure to get it transfered to my mother and me. Currently i am in New york , working with it company and i am coming to india next month. So please guide how i can do this alone.

Leag notice to developer

Dear Sir,

I have purchased a flat in residential complex at Kolkata but after few months of possession developer is not providing any service. While communicating to developer they are simply telling we will not take any responsibility for day to day service and better to depute some FMC company who can provide day to day service. In that situation we the flat owners are very much anxious how to handle the situation. we also tried to seek NOC from developer so that we can depute some FMC and they can provide the service. As per deed, if any flat owner not paid maintenance more than 3 months, developer can take legal action. Our residential complex consists with >200 flats and complex not yet registered with West Bengal Owners Apartment act.1972.
Therefore, it will be great help if you can suggest whether we send a legal notice to Developer to take maintenance and provide service until the society get registered.

Ancestral land of mother

Dear Experts,

One of my friend's mother along with her sister had inherited land from her father in Bihar. They do not have any brother. Some land records are still having name of her late grand father and not transferred in her name. Although, her sister sold most of her own share of land in past. Whether my friend's mother can sell her share of land to any son / daughter without consideration or all her sons and daughter will get the equal portion of land. Whether sale deed will be valid by mentioning her share and not waiting for transfer of land records in her name which is cumbersome process and will take its own time.

Whether her daughters can claim her right on this land.

Awashiya patta आवासिय पट्टा

My father was given Letter on a simple piece of paper from Gram panchayat (it has the names of 5 -6 ward members too) stating that we are giving him some piece of land for house construction.
1)Can the gram panchayat take it back or do we have full owner ship of the land given to us.
2)Do we have to do anything to make Pakka patta from tehsil or it will happen by the concerned authorities itself.
3) do we have the right to sell it too.

Breach of injunction

Sir/Madame Temperory injunction has been passed restraining defendent from further construction until partiion of suit property is done by meets and bounds. But defendent not obeying the court orders by continuing the construction, taking advantage of physical location of construction planned and spread on a combined land of suit property and the adecent land). Land adjecent land of suit property belongs to her son's. Defendent is confusing the identification of suite property.
1)Can a court order of police aid u/s 151 from court for police aid can help me. Does police have an authority to identify the suit property refering court orders.
2)What action can police take if the defendent continues the breach of injunction inspite of police warning..?
3)Do police has powers to undergo a spot punchnama of the ongoing activity.
4)Can police record statements of both the party?
5) Can I include pray for assistant from local Talati or TLR office to assist police to identify the suite property as Defendant is confusing and misleading police for I sent if I at of suite property?
6) What are the chances of getting an Exparte order for an Police Aid U/s 151.
7)Does police has powers to detain the Defendant if disobeying the injunction order?
8) What are the evidences granted by court to show breach of injunction for an construction activity?

Right of sons over property acquired by father

dear sir
i am a retired employee and have earned some house properties in my name. my wife recently died in nov 2017. i got two male children who were of 37 years and got married and settled.the eldest so was attacked with kidney failure and was on dialysis since last 9 years. due to his bereaved condition some property was sold for his maintenance. now the second son was demanding to give him immediately some property other wise he will go to the court. in this connection i told him i will give some to his children after my death by writing a will. but he was black mailing me.further my wife was bedridden for 9 years before to death and he has neither visited nor taken care of her at any time. i found a letter after the death of my wife where in my wife wrote about him that he has herrazed and threatened over phone several times by using abusive language also for property. does he got any right to demand me for property that was solely acquired by me.we are harijan Christians/scheduled caste.i request you to kindly help me with your advice

Property Sale agreement

I'm a buyer entered in to a property sale agreement (not registered)with a seller in Coimbatore to buy a resale property which is under mortgage. Agreement time period is six months,5 months have elapsed.out of 100% of sale value ,50% of sale value is under mortgage loan and I paid 40% of the sale amount as advance where cheque numbers are Incorporated in the agreement document and as I got possessory right and with seller's oral consent I spent huge sizable value on renovation and seller himself has witnessed the renovation process as he is residing in the immediate neighborhood apartment .Just before the agreement is about to lapse in few days, I came to know the seller hasn't settled the loan using our advance and hasn't got the title documents ready,now he is trying to breach the contract after getting renovation done in my expenses .
What is the remedy for my situation?

1.) How to legally get him register the title in my favour?
2.)In other case What are the options to recover my entire advance amount including the renovation expenditure?
3)agreement period is 6 months,5months have lapsed,also agreement not registered.will it have any implications?

Neighbours throwing cigaratte butt in my terrace balcony

Hi,

I have a terrace balcony flat (Pune, Maharashtra), and above my flat there are appx 22 flats. From last one week some one is continuously throwing cigarette butt in my balcony. I have talked to several flat owners but no one taking the responsibility, I have also put this problem to builder (as there is no society formulated yet). There is no action has been taken up by builder also.

Please let me know the possible way to deal with this, if you all can help, or else let me know if there could be some other legal way where in I can send the notice to all the flat owners.

I am having 4 year old son, and when he sees these cigarette leftouts, he un-noticeably picks up them start playing, I am very much desperate to get the solution, and ready to take any legal action if that can be taken.

I will like to know any legal process that I can take, or the way I can get some sort of fear develop among the builder/neighbors about legal action.

Os - plaintiff gpa

Dear Experts,

I am standing as GPA for my friend who is a plaintiff (living abroad who has been cheated of property) filed OS. The case has been going since Sep2016. While defendants cross examination me (Plaintiff - GPA) occurred over 3 hearings, during last hearing I explained details to few questions and Judge felt / wanted plaintiff to appear in person and take remaining questions... Now does this situation warrent all prior question responded by me is void and also post my friend appearing to next hearing and goes back to in work place (abroad) would court/judge still allow validity of GPA for reminder of the state till order/judgements are passed. Also will we be given opportunity to cross examine defendants and subsequent arguments states etc.

Appreciate a details response with pros and cons and sound advice what I should do to continue helping my plaintiff friend.
