Fraud in land registration

Dear Sir/ Madam,

We purchased a plots in Bangalore, the fraud has happen in land registration documents. instead of agreed plots he has registered plots which are not in existence. when we noticed that we asked for rectification but the seller stopped responding to us. we have paid all amount through cheques. so now it is confirmed that he has done this fraud purposely.. want your suggestions how can we get all our money back ? thank you

Maintainance issue


We have been alloted our redeveloped flat on 6.6.18 On aski ng possession builder says pay out standing of maintainance charges As we were in court dispute and both we and builder has not approched for possession Old maintainance charges. Is payable by us without posession ?? Builder has given possesion to others in 2010 or 11 What is the act under this type of situation?
Builder and society person asking if there is any law regarding prior maintainance charges before possession is borne by whom. Or it cannot be levied at all by the society
Pl advise.

Handover society with legal dispute

Hi Experts,
I am living in Pune, we are going to complete 2 years in society now it's time to take handover from builder.
Society is joint venture with builder and land owner.
We found after dept analysis, society land is in dispute, land owner put case on builder,
My question to experts did we take society handover from builder with legal dispute on land.
If we didn't then after 2 years builder with send it to government agency, If we take what should we take care as it's in dispute, what should be taken care in case landowner win the case.

Substitution of name of husband in place of wife

MY DECEASED WIFE WAS AN APPLICANT IN BPTP ( BUILDER), AFTER PAYING MAJOR INSTALLMENTS SHE DEMISED. NOW WHEN MY ONLY DAUGHTER RELINQUISHED HER RIGHT IN MY FAVOUR THE BUILDER ASKS TO APPLY AFRESH FOR SUBSTITUTION, WHEREAS MY SAY IS WHY A FRESH APPLICATION IS NEEDED WHEN A BOOKING IS EXISTING IN HER NAME AND I WANT MY NAME BE SUBSTITUTED. WHAT IS THE LAW IN SUCH CASES.

Bad-functioning of the society by governing body read more

Dear Sir, We have a gated community of 483 flats and we have a registered association. The association is registered in 2017. However, since it has been formed, the governing committee members are running the society on their will, they are not responding to any resident's query. Residents has issues on below things, how the residents can take action on the governing body as they are running society on their will. 1. Lack of on-time communication to the residents for any matters. 2. Zero Transparency. 3. Inappropriate maintenance of books of account. 4. No audit report 5. Weak management due to many positions are vacant. Restrain and restricts the rights of the residents. Please suggests how we the residents can take legal action against the ill-functioning of the society by governing body.

Query regarding purchase of land categorised as "anadeenam"

Dear Sir,

There is a piece of land categorised as "anadeenam" in the government records and the valuation is 0. But yet in 2011, the Land Measurement and Land Taxation Commissioner had issued an order directing to issue patta, for the said land based on the facts and figures that the occupants ancestors were doing farming in that land and their names appeared in the SLR records (but not in A register) and that they had paid taxes earlier. But the district revenue officer then refused to issue patta way back in 2011 asking the party to get High Court order for issuance of patta, which could not be followed upon later. Now we want to purchase this land. Can we use this Land Commissioners order of 2011 and request the present district revenue authority to issue patta for the land? Will they issue ? or what is the procedure for obtaining patta for this land? Kindly help us with this as it is very important for us.

Removing co-applicant"s name from home loan

My friend is a co-applicant in home loan. She was made the co-applicant at the time of sanctioning the loan as her husband was the principal lender at that point of time.
However, they are now legally divorced and she wants herself removed as a co-applicant from the above mentioned loan. She is not the co-owner of the property, but the fact that she is a co-applicant is reflecting in her CIBIL rating and hampering her process to avail any other loan independently.
Please advise regarding the necessary steps to be taken regarding the same.

Duty on release deed

Hi,

Me and my office are officially divorceed. We have joint home loan and property registered on both of our names
Property is in Bangalore

One of the clause in court order says, she will do Release Deed and in written I'll pay her some amount.

Does this sort of release deed attracts any kind of fees?
