Mortgage property of joint family (one member minor)

Hello,

Can we mortgage our property to bank business CC loan where in Joint Family of Behalf on release deed of where one kid minor without court permission and guardian of minor - Mother, Brother, Sister and Other All are in Release deed Family members are agreed.

Is it possible please guide how is it possible.

Token amount

Hi All Experts,

I am currently working in Bangalore. I have thought of buying recently a property under Land owner Share. The property is under construction. I paid 1 Lakh token amount to the broker. The token amount was paid around 25 Days back. After paying token amount i got sick and was admitted in the hospital. When I recovered I asked the broker to share me the Documents so that I can proceed with legal verification. The Broker share soft copy and refused to share hard copy saying that don't do legal verification from a private Lawyer and do it from Bank approved lawyer when i asked him that without legal verification I cannot proceed he said you have 5 days to sign the agreement. I asked him in that case I don't want to proceed and kindly refund my token amount. On that he refused to give it back.

I have an email confirmation from him that amount has successfully received by him. Also the amount was paid by cheque on landowners name. I have not signed any document and he is yet to provide any receipt.

Can you please advise what legal actions can I take.

Property registered on my father name when he was minor

My grandfather purchased a agriculture land on my father name in 1966 by registered sale deed.my father is minor 2 years age in 1966.according to sale deed my Father is only and fully owner of agriculture land.mutation is my Father name since 1967... property tax is paying by my father since 1967 to till 2019 . possession and cultivation on land by my father since his major time,( more then 35 )years...my grandfather died in 1999.my father take a bank loan on this land..now my uncle want to share on this agriculture land. Can they take share on this property ????

Nominee of the property

Hi, my question is if the property owner has made a nominee and the society is not transferring the share certificate so what should we do? And do legal heirs of the deceased person has a right in the flat?

Can i buy open to sky area and use that place privately

Hi Sir/Madam,

My flat boundaries are given below :

EAST : CORRIDOR
WEST : STAIRS and LIFT
NORTH : OPEN TO SKY
SOUTH : OPEN TO SKY

There is a open space at north side(mentioned OPEN TO SKY in sale deed). He sold all the flats. Now, can I buy that OPEN TO SKY area? is this legally fine?

Bda plot in cd

Sir,

I am trying to buy a BDA Plot in Kempegowda Layout in Bangalore. The seller says that the plot is in CD and by the time I process home loan, the plot will be available for registration. Is it safe to buy this plot. I did not understand the meaning of CD. I only got to know the full form " Correct Dimension" but did not understand what exactly it is. Can you please explain.

Advance amount paid towards a Flat

Hi Sir,

Myself Pradeep from Bangalore.
Recently I visited a 1.5BHK flat which belongs to TATA Heaven - By TATA Group, and on the visit day June 17th 2019 i interacted with the sales manager over there and discussed on the pricing which was approx 38 Lakhs and he advised me to go for a booking amount of 30000 on immediate basis so that he would give me a better price.
I thought of a Gud opportunity a immediately transferred an amount of 30000 through IMPS payment.

After transfer he gave me a price of Rs 35.95 Lakh as a final price. He then suggested will official send across the booking details through mail.
(But I haven't received it till today)
Later on the same day I discussed with my parents regarding to the booking which I had done. But my parents are not happy to leave in a flat and therefore they suggested me to go for a plot purchase and later go for a construction.

So today morning I spoke to the sales manager of TATA Heaven and requested for the cancellation and asked for the return of my booking amount.

But now he clearly says that the booking amount can't be returned and will be forfeited.

There is no documentation done nor he advised on this amount forfeit at the time of booking.

So how should I go ahead to get my booking amount return. Please suggest me

Registration of Land for son in law and his brother in 1995

Hi sir,
There is a land which my father and his brother got from my father's brother mother in law as his mother in law had no son only single daughter.
At that time they got the land registry (Bainama) in registry office. I'm not sure about the resistration type( tenant in commit or joint tenants)

Now the problem is my father's brother is claiming that this land his only his property and he will claim it and I can not do anything as it was given by him mother in law And if I will do anything in that land he will just cancel the resistration and I will not get anything.

Is there any law to cancel the land registry only by one part in my case?
And what should I do to claim my land? Any suggestions be very helpful.

Farmer certificate for husband. wife is a farmer

My wife is a farmer...she holds a land in Maharashtra . 7/12 format has her married name (ie. wife Name- Husband name and Husband's Surname) ...I dont have farmer certificate ...but i want to purchase agricultural land on my name...she is ready to co operate...is there any procedure so that I can have farmers certificate

Legal heirs of releasor who were major-release deed

Dear Sir/Madam,

I have an important query on HUF Indian law.

A brother and sister have 50% share each on a property which belonged to thier deceased father.
A release deed is executed with the sister as the releasor and brother as the releasee.
At the time of execution of the release deed , both the sister and the brother have children who are thier legal heirs and are major in age.
1.should the legal heirs (children) of both the releasor (sister) and the releasee (brother) sign the release deed?
2.if the children of sister (releasor) have not signed the registered release deed (since they were not aware of the release deed execution) then can the children of the releasor go to the court the release deed to be cancelled and rightfully claim thier 50% share in thier grandfather's property?
