Ancestral Property - Succession

My father left his property to his 6 children (4 married & 2 unmarried) by means of a settlement deed, which will come into effect only after his and his wifes death.
A) In case of the event of the unfortunate death of one of the married children, does the deceased childs share of property go to his / her brothers & sisters or to his / her spouse and children.
B) In case of the death of the unmarried child,how is his / her share of property settled.
C)At the time of selling the property, if any one of the children is not willing to give consent for sale of property, can the property be disposed of by the remaining children by virtue of majority children being in agreement.

Inheritance of mother's Ancestral Property

My Grandfather has 2 daughters ( no sons ) - my mother and her sister. His property ( which he inherited from his father ) was divided when he was alive into 4 shares - self, his wife and 2 daughters. He died a few years ago, but my grandmother is still alive. I want to know, as of now, if I have a right on my grandfather's property and if yes, what right/share do I have, considering that my mother and grandmother are alive.
Also, can my grandmother and mother, will their share of the property to anyone, other than their children or do I have a legal right over their share as well.

Power Of Attorney

I purchased a plot of land in 1987 and I have with me original and duplicate sale deed , patta in my name , Encumberence certificate from 1986 till date , ie for 24 yers.
The land was sold to me and registered in my favour by Power of Attorney holder. The original entire holding of land was between two families and each family executed a POA in favour of one agent . The agent was the person who sold the land to me . Both POAs were registered at same Sub Registrar on same day in 1986 and bear continuous serial numbers. However I am able to locate xerox of only one registered POA and am unable to locate xerox of registered copy other POA . I am keen to sell the land and would like to know how to overcome this technical shortcoming in document. Pl madvise.

Publication of General Notices in Dailies

Sirs
Number of Public notices are being published in the News Papers thereby inviting claims and objections prior to completion of land registrations sale with supporting documents for consideration by stipulating time limit.
Kindly indicate such publications are mandatory prior to finalisation registration process, its merits and demerits and in case objections are received is it necessary to furnish to the Sub Registrars concerned. Is such publication of notices in news dailies are also necessary in case of Gift Settlement Deed registration and if so to kindly indicate relevant act/clauses/rules

My uncle not vacating my father's rented house

My father had rented a house in a chal in Mumbai in 1950.

He was leaving there with his wife and a younger brother.

Later my father got a new job in 1955 and moved to a new place which was given to him by his new employer.

Since then my uncle (father's younger brother) has been staying there in the chal and paying the rent. The rent receipt still shows my father's name, but all the receipts are with my uncle, for all the years till today.

My father expired in 1980 and my mother also died after that.

Today, my uncle is having his own house in Mumbai, but still he is not vacating my father's rented house.

What should I do in this case ? Pls advice.

Sue against will

Dear All

Our property is name of my grand mother who is 80-85 year old but yet she has not prepare the will in the name of any body even not share in my father and uncle but my grand mother live with my uncle from day one. now she is going to prepare the will for the name of uncle under the peressure. Let me know what can I do for avail my right in this property. it is not ancesetral property.

Settlement deed

There was a dispute between the two brothers over the transfer of share relating to the flat in a co op society which belonged to their Late Father. One of them name was entered as a nominee in the society registered however other brother challeged the same in co operative court and got the order restraining the soiety to transfer the share.
Both brothers are no more and their legal heirs want to settle dispute and apply as joint owner in the flat. But society is demanding the order copy of judgement which we dont have.
Can we do a settlement deed and submit the same to the society?
What is the procedure to do a settlement deed? and stamp duty, court fee involved?

Loan/morgage of property

A has taken a personal loan of rs 100000/-from b and signed and execute registered gpa,will,reciept,and notarised agreement to sell (property belongs to a)and handed over all the title documents to b as a security of said loan amount.

Please provide the legal opinion,or what is legal effects of aforesaid query.
