Conveyance of Land

Sir,

One landlord have constructed a building in the year 1987 on 1/3rd area of total Plot. The Flat Purchaser have now formed the society duly registered under Co-operative Societies Act. Now the landlord has been going to convey the entire plot of land to the third person(builder). Can Landlord convey the land to the builder without intimating the society? Is his act is illegal?

Unregistered POA to buy a property

Hello sir,

I'm interested in buying a property at Tambaram, Chennai. In 1997, the property was sold as UDS to 4 persons. Among that 4 1 person bought it through POA which was not registered. Again this person sold to another person through a registered POA . In the bank they are asking for the registration number POA which was not registered :(.
Current property owner is telling that since that person used unregistered POA for buying, its not mandatory to register and its a valid.
If I buy this property, will i face any problem?

7/12 addition of name as occupant (Kabjedar)

We hold open land prior to 1981 as an occupant. Owner is non traceable but alive. We are paying NA tax of the same land since 1981. The receip of the same shows owners name as well as our name. Other than this we don’t have any other proof, that we are occupant of the said land. Now since the said land was the part of the larger plot having CTS no XXX. In 1996 Builder has constructed on that larger portion leaving our smaller plot of land. Now we came to know that Builder already got the FSI of our smaller plot (419.25 SQ.MTRs).

Q.1 What is the way we can add our name as kabjedar in 7/12.

Q.2 If we don’t enter name in 7/12 and continue to hold same way, can any builder eligible to develop on the said land on the basis of available document which is only NA tax receipt, inspite of FSI available with neighbour building?

Q.3 We want to pay assessment tax and municipal tax of the same plot, but since it is under name of Owner, department not accepting from us. Any solution?

sir,
one of my uncle executed a will with out mentioning probate in which he bequeathed 05 plots in my name during the year 1995. later on in the year 1998 he sold 02 plots to some persons out of those 05 plots and he did not revoke/amend the will.
now i approached to the tehsildar for mutation of rest of 03 plots in my name as per the will. he tehsldar refused to mutate the plots in my name by saying that your uncle himself did not stand on will executed by him and he sold 02 plots after the execution of the will and furthermore legal heirs of your uncle are objecting the mutation by claiming their share from ancestral property.
sir is it possible to get rest of 03 plots in my name since the will is not been revoked till date?

Stay order on inherited property

After the death of my father I transferred the property in my name after getting NOC from my siblings.He had not made any will during his lifetime, but as per the society records I was the successor.My name is incorporated now in the Municipal corporation that the said property is transferred in my name. Now my siblings want to cancel the NOC and they also want to take a stay order on the property in the sense that I cannot sell it.I have been mantaining the said property which is a house in a co-operating housing society for more than one and half decade. Now at this time can they cancel the NOC or take stay order on the property?Please reply asap as I dont want to spend anymore of my resources on the property which I cannot enjoy as per my free-will.

Can a money decree be sold ?

Dear Ld. Friends,

I have a query. Please tell me whether a money decree/arbitral award passed in favour of an individual by a court/tribunal such as arbitral can be sold to another individual.

Is there any requirement of license for purchasing money decree passed in favour of another individual?

I think T P Act does not prohibit it.

Please refer relevant law(s).

Proxy law and can family members (blood relation) attend AGM

Respected Sir/madam

I mr Mrunal Nagpure son of Madhukar Nagpure Attended the meeting on sunday(30-05-10)in absence of him also my mother and brother attended the same.
since we already have dispute in our building since 95-till today and we are the oldest member in the society since 1990. Me myself and my family members are aware of all issues in building.
since in sundays meeting we had some argument with management commitee and other memebers. Whereas the meeting was regarding redevelopment.
The secretary (mr.manohar sinh) is forcing to accept the builder which he has selected not the society as whole.
Being the old member i have informed them abt all issues happened since 1995.still they dont believe us.

now the mangaement commitee says we (myself,mother and my brother) cannot attend the meeting with or without my father(m.d.nagpure) because we misbehaved as informed by committee.
I WHAT TO KNW HOW ALL MY FAMILY MEMBERS CAN ATTEND ANY MEETING BECAUSE MY MOM AND DAD ARE NOT SO WELL EDUCATED,SO IT IS SOMETIME DIFFCULT FOR THEM TO UNDERSTAND CERTAIN THINGS.
ALSO COMMITTEE HAS ISSUED WARNING LETTER AGAINST(myself,mother and my brother). WHT TO DO
COMMITEE ALSO WANT TO MAKE THE RULLE THAT ANYONE ABOVE 35 YRS WIL ONLY ATTEND THE MEETING(IS IT VALID BYLAWS)

CAN A NON FLAT OWNER, DO A COMPLETE AGAINST COMMITEE IN MHADA.

PLZ DO REPLY AND GUIDE ME FOR THE SAME.....

Reg Property

Hi

My father has bought a property in Thirumullaivoil, Chennai. He has passed away 13 years back and has death certificate from Trivandrum medical college.

This land had ceiling and goverment has asked us to pay the amount. The poonamale office has asked us to produce legal heir certifcate.

Is it possible to get legal heir certificate for a person whose death has happened in Trivandrum and propery in Chennai?

Which VAO office should i approach. In chennai or trivandrum?

Rectification Deed of property

I had purchased an apartment on the thrid floor and another customer has purchased apartment on the second floor. When i had gone for registration of my third floor apartment the builder by mistake had registered the third floor apartment in another customers name. The builder adviced me register the second floor apartment in my name now and later on go for rectification deed for both of us.

I was left with no option but to register the second floor apartment in my name.

Now the builder has executed a rectification deed registered to the other customer indicating second floor apartment instead of already registered third floor without my signature in the deed of rectificaiton as i am the sole and first authority of the second floor apartment.

Now the builder is insisting me to go for registering the rectificaiton deed to get the third floor apartment instead of seocond floor already registered in my name.

My question is:

Is such rectificaiton deed leagally valid when executed without the first registered party of the apartment while executing the rectification deed?

Should i have to pay registration fee once again?

registry of parking space

Hello all,
I have bought a HIG flat from a builder in Ghaziabad. The total cost of the flat includes the charges of open space parking & the same is mentioned in our registry.

Now the builder is also offering covered parking which he was not giving earlier.

I have come to know that separate registry is not possible for this area. How can I get this area registered.

Though the builder is telling me that this area can separately be registered as commercial space. How can the open space at ground be taken as commercial space. Is this possible. If yes, what is the rate of registry for commercial space in UP.
