Can anyone tell me the importance of the registered will. What happens if the registered will is opened only after 20 yrs after the death of the mother?
Does the will lose importance if after period of 20 yrs??
If property subdivision was done without will and now after 20 yrs can the subdivision be done again as per the registered will??

Hi There,
I am in a state of frustration now and hence looking for someone who can guide me here. I booked a house in Rajnagar (March 2007) that was supposed to be ready by 2009.
Once booked, few months later I noticed that there is no progress in the construction and hence I decided to meet the authority. Post few meetings I found that the construction wont be happening because of some financial problems with the builder. I decided to cancel the deal and I did that in April 2009.
Much to my surprise, they gave me PDC of 1 year later (for May 2010!) and I had no choice but to agree. I had things planned at my end accordingly which included a big financial help for my family for which I was depending on this money.
The cheque BOUNCED!
Almost everyone whom I talked to since booking have left the organisation and finally I had to go to meet someone in office (and was hoping the office was not shut down!). They said they will give me draft on June 15th which they pushed to July 2nd and now they pushed again to July 10th(2 days from now) in name of no funds with them.
Today they say that they are in problems and may not be able to give refund on July 10th and will be pushed by couple of weeks now.
Trust me, I was Salman Khan, I would have broken their teeth. I am in a fix now. My money stuck there since last 3 years and my prior committment at family which will force me to take loan!
Can you please suggest what would be the best way to go ahead. I have all the documents to produce and confirm my standings.
I sincerely hope there is someone who can understand my condition and guide me in right direction.

There are three sons of my mother(in order of age):
1.me, the eldest son who has a decent source of income. (A)
2.my younger brother who doesn't earn much. (B)
3.my youngest brother who earns a handsome sum. (C)
A is staying in a house(in the name of his mother) for the past 15 years, with his
wife and two children with his mother's consent. A constructed the house and later
renovated it with his own money. A has been paying the electricity and water
connection(both in the name of his mother) bills for the same period. The mother
stays with C in a property in the name of A's deceased father who left it
intestate. The mother is in full influence of C who has a malafide intention of
kicking A out of both the properties. The mother is physically incapable of doing
anything.
A and B+C have tense relations between them
Question:
Is it possible for the mother to oust A of the accommodation by citing something
like:
"She is a widow, has no source of income and none of her sons takes care of her.
She is left to the misery of B.(Though A had earlier taken full care of the mother
both monetarily and emotionally), so she wants to gain the possession of the
accommodation in which A is currently staying with his family, to rent it out and
earn something for her survival(though actually C wants to snatch it in such a
garb)."
What defense/legal right(e.g. Right to property/life or Human Right) does A have
at his disposal to prevent being ousted of the house?
But I guess A has a right as an inheritor in the property left intestate by his
deceased father. Is it so? Kindly elaborate.
Kindly help!!

There is a house which consists of 3 joint families since our forefather. The family consists of Ganpat, Gangaram & Pandurang and they are not real brothers. As the Ganpat was the head of the family, hence, the assessment receipt was coming in his name since begining and the 7x12 extract of the house is also on his name. In the year 2002 all the three existing families decided to collapse the old house and to build a new house. Since then suject to the affidavit of wife of Ganpat we have built a new house and it is equally divided into three parts. Since then the assessment receipt was coming on the name all of three families till 2007.
Now what has happened due to some dispute between our three families. The wife of Ganpat has revoked that affidavit and made a new affidavit and in that she is not ready to accept any of my share in the said house. And since then the Gram Panchayat has stopped issuing us assessment receipt. We are having Rationcard, Voting Card other some documents of the same till 2007.
So how can i get back my title in the said house property and before whom i have apply and whether i will succed in the sume or not.

Is not investment in property just black marketing ?
If we store Wheat,Sugar,Ghee ,Rice etc. in big quantity ,we may be charged of black marketing. But if a person who is residing in his owned house and invests in properties which are not going to be used by himself, Is not this black marketing ?
He either keeps these properties empty or gives on rent. The purpose of such investments are just investments not any other use.Such investments are made just either to earn rent or for getting the apprication of the rate of property.Does not this practice keep many really needy people deprived off their dream of owning a house ?
Please respond keeping in mind that yet a very big number of population of our country is homeless.
