Deed of Relinquishment

My father died in 2007 with no will. Thus, his land in Punjab has fallen to my mother, my sister and me.

Me and my sister have granted a power of attorney to my mother (duly attested by Indian High Comission in UK) so that she may sell teh land on our behlaf. Do we need to enter into a deed of relinquishment also? If so, does this need to be attested by Indian High Commission also?

I hoped that by providing a power of attorney my mother would be able to enter into a deed of relinquishment on our behalf in India. Either way, I will need somebody to draft it for me as i have no knowledge of this document. Please advise.

HUF property

Hi,

Our's is a HUF property. We are a family of 5 with two brothers and one sister. My father had given a piece of the ancestral land to our sister creating a sale deed as though he had sold that land to our sister without informing us. We both brothers had not signed on this sale deed. Is this sale deed valid? Now our father and mother are no more and we brothers would like to divide the property among ourselves as per parent's wish, as according to them, they had already given the property to our sister. We also want to give the property to our sister which the father had given to our sister by signing on that sale deed. Does our sister have the right in the rest of the property which we want to divide among ourselves? Our sister is now saying that she will not sign the document. We brothers had given a lot of money to our parents for their expenditures throughout lifetime, also taken care of them including the medical expenses. Property is the only source for us now. Also, can we divide the property among ourselves? Incase our sister wants share, requst you to let us know as to how can we get it divided without giving the property to her? Your help is higly obliged.

thanks & regards
Avil

Land Acquisition Act

Dear All,

The government has taken a plot under the land acquisition act and has paid a compensation, however, for the past 10 to 15 yrs the said land tax bills and other related bills still are standing in our name.

We need the land to develop it.Can we use the land as the government has not utilised it for long and there are chances of it being encroached.

Please help. Whom do we approach. The land is situated in Mumbai.

Thank you in advance. However, if the experts think it is a repetition, please note that I have not come across such a query before.

Tenant not ready to leave our peoperty

Hi Sir,

We have a tenant who was living in property since 35 years. 20 years back we lost a case against him to vacating our property. Since then he stopped paying rent as well which was at that time a bare minimum Rs 80. 10 years back he left the property as well but they have not given us the possession instead put a lock. My Father also do not want court case as their previous experience was not well. So what can be done to get the possession of the property as we are now planning to sell it off. Can we directly get the possession with local Police consent or we need to file a case again?
The grounds on which I think we should be given the possession is that its vacant from 10 years and we have not got rent from 20 years. Please guide me on it.

Sudeep Naik
