My mother died about 8 months ago. Can I claim on her father's property? I have a power of attorney from her signed in September 2009. She did file a police complain over her 3 brothers and one sister in 2009 end and sent a notice through her lawyer but never moved to court. Her father died in 1994 and her mother died in 1998.
In 1994, her brothers claim, she has signed a legal document and surrendered all her property rights. Can you please suggest, can I claim on her property rights now and how do I make my case strong. What points go against me

Rental agreement for 9 months has been executed
before witnesses and is notarised but not registered.
Tenant want to back out of agreement. Rent not paid.
Has a landlord-tenant relationship been established?
Is Rental Agreement document admissible as evidence?
Thanks.

There is a residential property in my mother's name. The property was purchased by my father as my mother had no income of her own. She died in 1991 inestate. My father died in 2003 inestate. We are two brothers and two sisters. The papers are in the possession of my elder sister. The full property is in possession of my younger brother. My brother wants to sell off the property and take his share but he does not have papers. I also want to take my share and quit. My younger sister is also willing to sell her share. But no one knows the mind of my elder sister who has the papers of the property. In fact my father had authorized her husband to get the papers from DDA and he never gave him the papers.
The questions are-
1) Can me, my brother and my younger sister sell our respective share to any one without having the papers.
2) Can we get copies of the papers (registration deed) from DDA officially?
3) The share is not demarcated.
4) Can I buy my brother's share?
5) Can we 3 brother/sister sell our share to outsider?
6) As the property is in my younger brother's possession, can we give the possession of 3/4th share or 1/2 share in case only me and my brother decide to sell our share, to the prospective buyers.

we have lesseed a floor to the bank for 25 year . the lesse is expiring in march 2011.As per the aggrement the bank will give us the peacefull position . i have given a notice for peaceful position but no response from bank till today.what should we do?
Tenant does not vacate after notice to quit
Tenant gives handwritten 6 month's notice to quit.
Does not vacate. Five or so years pass since giving notice to quit.
Pays enhanced rent from time to time and verbally promises to vacate soon.
1) Is the tenancy still surving after 6 months's notice to quit by tenant?
2) Can eviction suit be based on the old notice to quit by tenant?
Will eviction suit run into limitation?
3) Has a new tenancy come into being by paying enhanced rate
since giving notice to quit?
(The issue of new tenancy is relevant because Fair Rent
in West Bengal is based upon date of inception of tenancy)
