Property mortgaed to bank but no property exists

Respected Sir
A critical problem crop up in a bank where a borrower mortgaged his teacher mother property in bank to secure a loan and his mother is also stood as guarantor.Title deed is also available in registration portal but while taking possession of the property bank is saying 2 cottah property mentioned in title deeds is for 12 ft rasta no property exists.Lawyer as well as valuers did searches and valuation.Bank'complaint is right or occupied by other ? What is way out?

Double registration on same land

My father and my uncle both of them combinedly purchased a land plot no 80 and divided into two parts as 80/P around 2004.

Here issue is we have not purchased full plot 80 we have purchased only half bit from plot 80 while registration land registered as 80/P with two names(my father's and uncle).But when we search with 80, registered name is not reflecting with recent one's.

Unfortunately owner has expired and his 1st wife started property belongs to her and raised GPA in 2016 .We went legally and she cancelled the GPA.

We are paying property maintenance since 15 years and applied current meter, received House No also and paying house tax every year.

Again now she came into picture she registered the full plot 80 into two bits to some other else as 80/p/east and 80/p/west.

Registration completed on 12-5-2020.

What should I do now?
Pls suggest.

Revenue court of civil court?

Greetings experts,

In a town of U.P. the then zamindar leased out a piece of land through an unregistered document in 1949, reserving Rs. 6 as an annual rent. No duration of lease mentioned in the deed, no 4 sides of property given, only khasra number is given. Right to raise construction was given in the deed, tenant raised pacca construction. Land is in limits town area limits (now nagar panchayat). Later tenant got his name mutated in revenue records and sold a large part of the property to someone, claiming himself as the owner of the property. Possession of sold part handed over to the purchaser.

Now, what is remedy for the landlord to get back the possession ?

1. As the land is in nagar panchayat limits, should it be treated as an urban property and landlord goes to civil court? or small cause court?
2. U.P. rent control act applies here?
3. Since property is in nagar panchayat limits so Z.A. act does apply, still should the landlord go to revenue court?
4. Should the landlord plead to get the sale deed cancelled?
5. What about court fees then if landlord wants to get the sale deed cancelled?

Sub division issue

I am residing in chennai. We bought land in year 2000. Seller sold 600 sq ft to my father and 1000 sq ft to another 3rd party. We built house in our part. 3rd party build house in their part without doing subdivision. Now we are going to sell our part but without subdivision purchaser not accepting. That 3rd party is not cooperating for sub division. How to proceed. Please guide.

Society maintenance

Respected Sirs,
I am the original Landlord of the property situated at Ghatkopar East Mumbai. In 2007 we have added 3 floors to the exhisting A wing of the building, B wing is ground + 4. Society was formed in 2007 and conveyance was given in 2011. There are about 21 residential and 5 commercial properties. Originally there were 9 residential and 3 commercial tenants and even today these tenants are not the members of the society. I am the owner of those properties and I am paying the maintenance to the society on their behalf. All the commercial, as well as A and B wing residents have their own water connections and seperate over head and under ground water tanks. The monthly water and electric bill for Residential A wing is Rs.15000/- and that for B wing is Rs.2500/- Now the society wants to merge all the bills and is asking me to pay the amount of maintenance for both the wings in combine where as I am paying water and electric bill for B wing Tenants and this is not included in the maintenance bill.
If the whole amount is asked to be shared and paid then my maintenance amount for non members would actually increase and I will have to pay the amount from my pocket. I want to know that when all water and electric bill for pump is seperate for both wings can society ask for merging the bills and collect extra amount from me which will have to be paid from my pocket.
Also at the time of conveyance stamp duty was paid by me and it was to be reimbursed by all the members and myself on behalf of my tenants but the members have till today NOT paid the stamp duty. I have reminded them about this in every meeting and off late I have sant the letter for payment along with interest on the outstanding amount but I have not received any reply from the members.
Please advice on both the issues.

Name on property papers

Sir,
I had bought a flat in 1997 with my name as B.K Tiwari. However in documents such as PAN/AADHAAR etc my name is Basant Kumar Tiwari.
Is it legally valid and if not what can be done to correct the same?

How to stop sale of land ?

We are seeking urgent help to STOP SALE OF OUR LAND with concerned authorities as we will be forced to become homeless if our land is sold. Our father Mr. Deb Narayan Sharma having who divorced our mother, Geeta Sharma and now wants to sale our decades old land and flee away making all of us homeless forever. We are four children (all major) from our parents and our father does not wants to give us any share in his property which was purchased by his mother Mrs. Kulapati Sharma who is no more alive now. Deb Narayan Sharma wants to destroy us by making us homeless by selling ancestral property. He has become an enemy for us. The land is registered in his name which was purchased by his mother. Please HELP us by stopping this sale of land at any cost for us which is the only hope for us to live.

As per our divorce conditions and family court ruling, he has to provide us accommodation to our stay if he sells the property. He does not want to give us any rupee. The court also asked to pay 3000 per person to my mother and two daughters which have not been given to us which has been years now. He is having links with gangsters and repeated warns us to have devastating consequences (Harming us physically & killing us). He has paid to Local police station officials who helps him. We do not want any more court cases as we have gone through seven years of mental torture in court cases already.

Please HELP us by stopping this sale of land at any cost for us which is the only hope for us to live. We hope our plea is heard and some action is taken to bring our family some peace and much needed protection.

1. How we can stop the sale of land ?
2. What to do for the warning us to kill us ?
3. What should be our next step in line with our rights & safety ?
4. Does not children have rights in the property of father ?

I belong to general caste. Can I buy house from 2nd owner who in turn bought land after completion of 10 years from Schedule caste person given under special scheme.

Regarding 84 c kalam and agriculturist certificate

My father had bought land in Pune in 1987 and 7-12 of the land has Ku.Ka. 84 Kas Patra remark on it. In 2017, we sold same land to other person. Now he is asking for our Agriculturist Certificate to transfer 7-12 on his name but we do not have any agriculturist certificate as nobody from our has any farmland.
Can i get Agriculturist Certificate if my wife has agriculture land on her name.
Please advice. Thank you.
