valuation of the property


Dear sir
My mother is likely to acquire two row houses through sucession of his brother since he expired on april. The query is to understand the valuation since we had paid some money as a bond in the court proceeding based on the paper value in which it was originally
purchased on 1996 thinking that my mother who is the only sister with blood relation and my uncle being unmarried when he expired and she will be acquiring this as a gift.
But now we had got a letter from the collector office in chennai stating that they will be visiting to confirm the value mentioned .\
pl give your expert advice if my mother is to acquire the property through gift is it that we have to revalue it as per present value and its locality and pay the defecit amount or what we had initially paid as a bond based on the purchased document is correct pl reply

Tenancy rights

My parents stays in a rented flat of the Bombay Parsi Panchayat Trust in Mumbai since 1960 with my grandfather and my father's two brothers alongwith their families. The rent receipt was in my grandfather's name. My grandfather expired in 1983. The rent receipt was then transfered in 1987 in the name of my father's elder brother by taking the NOC of all the brothers.

In 1985 my father's younger brother shifted residence to Ahmedabad alongwith his wife and two children. He and his family have been staying in Ahmedabad since then. My father's elder brother expired in 1997. His wife still stays with us in the rented flat.

In 2009 my father applied to the Bombay Parsi Panchayat Trust for transfer of rent receipt in his name and also asked the Bombay Parsi Panchayat Trust to delete the names of his younger brother and his family (i.e. wife and two children) as occupants in the flat, since they are residing in Ahmedabad since 1985.

My father's younger brother is not agreeable to deletion of their names as tenants in the flat and hence they are not providing us the NOC. They claim that they have a right to the flat as legal heirs.

My question is does my father's younger brother and his family have a legal / tenancy right to the rented flat especially since he and his family are not staying in the flat since 1985. Do they have any protection under the Bombay Rent Act ?

Rights

Dear Sir
I want to know what is the Tenancy rights and landlord rights.
Does tenant have right to sell the property.
How much % landlord liable to collect from tenant when he sells to other.
Landlord can remove all tenants any time withoute any reason or o/standing rent not paid.
if rent not paid for several years then landlord can remove the tenant.

How to get back gar marusi land

Our land in haryana is under occupation of some unauthorized people for the last 30/40 years. The land is gar marusi in revenue record. Now the owner has died and his legal heirs have come to know of this. We seek advice from the experts, as to how the land can be back to the legal heir and how the land is to be changed in the name of legal heirs. Thanks

MVT ON NEW PROPERTY

Dear Experts,

I have purchased 3BHK flat at Rs.79lacs in Mulund, Mumbai. The registration and Stamp duty is paid in Dec-2008 and register sales agreement also made in Dec-2008. intially builder promissed to give possession by dec.2009. Now the flat is ready for possession and all the dues have been settled to to the builder. but to get possession of our flat, builder is asking for bank guarantee against the new law i.e. 5% MVT on the agreement value which is costing us approx Rs.4lacs . could you please clarify me about this law. as while ageement nothing was mentioned by builder.

purchase of land

sir we purchased a 12 plots from a man in 210000 in 2009 and he give us the power of attorney and agreement now in 2010 he came to us and told that he repurchase our land in 406000 and he give us the 150000 and remaining in two months now he linger on the matter all the resale is done only on simple paper and and he also said that he will done 90 b in land act means conversion then he registered our property now what remedy in law and what action is taken plz suggest and he also gave me the 100000 and 110000 cheque for that can i go separately in 138 and issue the notice that he take credit by me of such amount plz suggest me the remeady .

Filing of 420 case

There is hotel of my grandfather in Meerut.My grandfather gave a part of this hotel to my father.This property is in lease by nagar nigam.My father brother my uncle without informing me & my younger have sold one shop whichwas coming below the hotel in 8 lacs rupees and did not give any money to us .My father is a paralytic patient and he has put a thumb .My uncle has taken the entire money. Can we file a 420 case as it has been sold without my consent

shop owners coop socty registration in mumbai

we are about 40 shop owners in chembur[M-ward] doing business for last 35 yrs. the land belongs to MHADA & we are PHOTO PASS HOLDERS[ regulated sqatters] after 1976 census.

excess of land than the booking plot

I HAD BOOKED A PLOT IN ANSAL SUSHANT CITY AJMER.IT IS A CORNER PLOT WITH SIZE 164 SQ METER AT THE RATE OF RS 5000 PER SQ METER ABOUT 2 YEARS BEFORE.THERE BOKKING STARTED ALMOST 5 YEARS BEFORE AT THE RATE OF RS 2500 PER SQ METER.I HAVE MADE 95 PAYMENT UPTO DATE
BY MAKING QUARTERLY INSTALLMENT AS PER PLAN OFFERED.IT IS A CORNER PLOT AND GARDEN FACING
EAST NORTH FACING ETC OF MY BEST LIKING.

NOW I HAVE BEEN TOLD LAST WEEK BY THEIR EXECUTIVE THAT THEY HAVE CARRIED OUT ACTUAL SIZE DEMARKATION ABOUT 3 MONTHS BACK. AND MY SIZE OF PLOT IS MORE ABOUT 80 SQ METER.

WHICH IS ALMOST 50% MORE OF BOOKING SIZE.

NOW I AM IN DELIMA AS I WANT CONSTRUCT MY HOUSE ON THE SAME PLOT AND BEING A SALARY PERSON AND IN THE AGE OF ABOUT 55 YEARS JUST CANNOT AFFORD THIS MUCH EXCESS AMOUNT.


PLEASE LET ME KNOW THE MY LEGAL STRONG POINTS TO MAKE A HARD BARGNING FOR THE RATE
OF EXCESS PLOT. AND IN YOUR VIEW WHAT IS THE REASONABLE OFFER I CAN MAKE FROM MY SIDE TO THEM AS I HAVE TO BUILT THE HOUSE AT THAT PLOT ONLY AS MY AGE IS CATCHING UP AND OTHER PLACES IN THE CITY THE RATE IS JUST OUT OF REACH OF MINE
