In gujarat agri land purchased by non farmer in 1953.

hello sir, my great grand father was non farmer and in 1953 my great grand father had purchased one land with partnership with gunot (Charan). during the registration mamladar found that he is non farmer and he charged him fine of Rs-1 as per rule 84A and registered his name as farmer and my great grandfather name was there is 7/12, after the deth of my great grand father my grand father and his one brother and one sister name added as per "varsai" but during that time Charan (Partner of land) file objection for this varsai but mamlad refuse his objection and entered my grand father name in 7/12.. in 2013 my grand father wants to entered our name in this property in their presence but when we apllied for that the charan again file objection by telling that this land was purchased by his father from my grand father with out any proof and our name was not entered in 7/12, we file complain against mamladar to collector office but rejected by telling my great grand father was non farmer and ordered to remove all our name from 7/12.. we gone to gandhinagar against this verdict but regected... now we want to go to high court but not sure as per low we are correct or not please guide me about bombay revenue act...

Noc charges on registration of flat purchased 13 years back

Hi,

I had purchased a flat in a Cooperative Society in Greater Noida, Uttar Pradesh, more than 13 years back. The Society got a completion certificate about 4 years back after which registrations of the flat became possible.

Due to some reasons I was not able to get registration done earlier and am getting it done now.

The Society is now asking me to pay 1% of the circle rate of the flat as NOC charges, even though I am not selling the flat or transferring it to a third party (the registration is being done in my own name only).

Is this 1% charge payable?

To give proper guidence on property encroachment notice.

Respected sir/madam,
I live in rural area.Some political persons torchered us by given the notice of Grampanchayat that our house is in encroachment. But from succession we live on that place. Grampanchayat gave income tax receipt to fill the payment and we pay income tax regularly. Our home is legal according to Grampanchayat and Landlord property registration. For only to satisfy political agenda, they send us encroachment receipt to destruct our home in 3 days. Please give us proper guidence that what we do next? Please convey me immediately on my email. Chargesheet against MRTP ACT 1966 SECTION 52&53

A FIR had been lodged against me by the Municipal Corporation of Navi Mumbai for refurbishing my existing house in 2017. According to NNMC , I have carried illegal construction without permission from them even though I've constructed my house in less the FSI which is permissible. They claim a Notice was sent to me which I never received nor signed & later got a call from Local Police station in July 2017 stating an FIR has been registered against me & i need to visit police station & submit photocopy of property documents to them which I did. Almost a year later last week i.e. 9th August 2018 , i received another notice from the same police station stating that they are proceeding with chargesheet submission at local court & i need to be present there with lawyer. The Police have been less cooperative & have denied to provide any additional info about the scenario. Since I'm new to this all situation, I've no idea whatsoever what is to be done next. What would be the legal procedures & what do i need to do next? Please help!

Bank enforcing to vacate the house

My friend has taken a Home Loan (India Bulls, Chandigarh) from a Bank and since last 8 months he got into an extra marital affair and run away from his house leaving his wife and 1 year daughter. He is not paying EMIs since last 5 months.

His wife has filled some case for paying the expenses for them to live but the man is playing smart and not appearing in the court.

The poor girl is being threatened by the bank to vacate the house but they have not sent her any notice till date. Her name is also on the loan documents. The man is asking bank that he will pay only when they will remove the girl from the house.

Today again bank called the girl and said that are going to auction the house in next week and claiming that they sent a notice to her via speed post which she never received.

The bank also claims that they filled a case against the cancelled checks these 2 have given in Gurgaon court and the boy paid against his checks in the court.

We are not sure what is happening. The girls parents are ready to clear the loan if the property is transferred to the girl's name but the bank guy is not accepting that as well.

What can the girl do in this situation?

Shop premises on pagdi basis

I have a shop premises which was inherited by me through my chachi after her death. The shop is on pagdi system since my chacha first purchased it many years back. He used to receive regular rent receipts in his name but after his death in 2007 the shop was transferred in my chachi name by the Landlord and he incorporated her name in rent receipt. Before her death in 2011, she requested the landlord to add my name in the rent receipt as she did not have any kids but the landlord discouraged her to do so and refused to add my name. Now I am holding the possession of the shop premises and I also have all the old files and papers of the shop and it has come to my knowledge by the neighboring shops that the landlord has changed but they don't know whom to pay the rent to as it seems that a group of people have purchased the land from the earlier landlord but are not disclosing as to whom to pay the rent. The reason for this is the road widening proposal which is going to be done in sometime now. I would like to know how can i transfer my chachi name in my name and whom should i approach to strengthen my holding of the shop premises ?

As a tenants claim for money used for redevelopment

Hi,

I am tenant leaving from last 32 years in mumbai. Now our owner force us to vacate the room else asking for rent by 4x of current rent amount because of current redevelopment project.We regularly provide rent on time.He doesn't provide us rent receipt from last 8 years even if we asked him for rent receipt.We have made agreement only at the start.(In 1982)

In 2002, Our chawl fall down ( i was leaving on first floor) because of heavy rain, after we tenant redevelop our chawl by giving my contribution as Rs.65000 (In 2002) to the developer.

Now he daily misbehave with us to vacate the room.

Can i claim for property value because we redevlop chawl from our own contribution?

New Flat declared illegal and my loan already started

Dear Expert,
I have buy 1 new flat which 90 building project in Kasheli Thane in the March 2016 which was under construction. And on June 2017 I have registered that in bhiwandi registrar office and then my loan started.
I am still not take this flat possession coz still this is in under construction. Builder supposed to give me the possession on January 2018.
But on February 2018 Local collector officer came to the project and stopped all the construction saying that whole project is illegal.
Now all builders and land owners are in jail.
From last 7 to 8 months they are in jail.
And unnecessary I am paying emi to the bank.

This is my 1st flat and they cheated to us.
In that case what can we do ?
What can we do with bank emi problem?
What can we do for my flat ?
How can I over come with this loss?

Question on use of order 598/1998 as evidence

Dear Experts,

I am standing as POA on behalf of my friend- Plaintiff who got cheated of plot. We have filed OS for money recovery and cancellation of sale deed. While the case has progressed to the extent of defendant advo cross examination of myself… while the case is posted for defendants to produce any evidences. Meanwhile I have learnt the layout which was formed in 1992 and all plots sold by 1994 itself, whereas the plot which was cheated to my friend was sold in 2013 and infact the original developer filed a declaration suit in 1998 and judgement given in favour in 2010. This ORDER OS/598/1998 judgment photo copy I could get it by Gods providence. Therefore can we use these and other WhatApp message during when the case will be posted for defendants cross examination. OR do we need to bring to courts notice through any formal process. Finally as this case involves recovery of 41 lakhs therefore would court help us in recovering money by asking defendants to produce list of other property he owns and the same to be attached to this case as collateral security.

मैं एक अचल संपत्ति क्रय कर रहा हूँ एवं मैं सम्पत्ति के सकल भुगतान में से कुछ भुगतान नकदी एवं कुछ बैंक द्वारा करना चाहता हूँ अतएव मैं यह जानना चाहता हूँ क्या मैं चैक से भुगतान करने की अपेक्षा DD(डिमांड ड्राफ्ट) से भुगतान कर सकता हूँ ? भविष्य में कभी भी विक्रेतापक्ष या उसके उत्तराधिकारियों द्वारा उनके द्वारा भुगतान प्राप्ति को मिथ्या ना साबित किया जा सके इसके लिए भुगतान चैक से करना उत्तम होगा अथवा डिमांड-ड्राफ्ट (DD) से करना उत्तम होगा ।
एवं सकल भुगतान में से कुछ भुगतान नकदी करना चाहता हूँ इसके लिए मैं यह जानना चाहता हूँ कि मुझसे विक्रेता को प्राप्त नकदी की रसीद किस रूप में प्राप्त करूँ जो सर्वमान्य हो एवं जिसे भारतीय कानून और समस्त भारतीय कोर्ट में मान्य हो ।
