Agricultural land limit

Sir I am resident of Maharashtra in kokan area. After the death of my grand father my father applied for transfer of grandfathers property in his name (under process). My grandfather had an agricultural land more than 1 acre and a farmer certificate. After the completion of name transfer procedure, my father will be the owner of the grandfather,s property. My Father interested to buy a piece of agricultural land of 10 gunta from the plot of 33 gunta. Someone suggested that it is not possible to buy piece of 10 gunta from the plot of 33 gunta land separately. As there will be only one 7/12 for 33 gunta land, so part land sell is not possible. Please suggest.

Buying property from Muslim in India

I want to buy a property from Muslim in India. The property is buyed by his own money and he himself built it. Can his wife or children object him from selling the building to me. He is ready and willing to sell to me. He tells his wife and children will not sign the sale deed as they are willing to own the property after him. But he is interested in selling the property to me. Pls suggest weather I can buy this property without any legal battle from his family after the purchase of the property.

Sales agreement

1) Whether, my father and brother (they are not the allottee) can sign the sales agreement document as witness from my side?
2) Do the same persons need to be present during the flat registration as witness, which may be held after sometimes?

Conveyance

Our society does not have a conveyance deed and Occupation Certificate,
1. Would like to know if both are independent of each other or OC is compulsary before making an application or Conveyance deed.
2. Where does the society apply for Conveyance deed
3. Our land is on 999 years lease, with a CHS formed by a group of members. However our owner has now expired, can we obtain deemed conveyance

Cancellation of sale agreement

My friend has done a registered sale agreement with a builder for purchase of a flat, now due to financial reasons he is unable to make further payments.
Now i want to purchase the flat, my queries are

1. how much time will it take to cancel his agreement.
2. Is it possible to cancel his agreement and do a new registered agreement in my name in 1 day.

Enhanced edc and interest

Dear fraternity,

Wanted your suggestion on to the demand for enhanced EDC and interest by Ansal Royal Heritage on which there has been a stay order by high court since 2013. The builder doesn’t want to give possession unless it’s paid and is willing to give penalty on delayed possession only when the enhanced EDC is paid. Appreciate your suggestion on the right course of action.

My property under my mother name

We are 4 brothers with no sisters, 2 elder to me and one younger to me. Our house is in my mothers name, which consists of 3 floors in bangalore, ground floor occupied by parents and my unmarried/unemployed second brother, first floor is occupied by my 4th brother and second floor is occupied by my eldest brother. and the 3rd floor is rented out (Small house which is only one room) I was out of country for work from past 10 years, during this time my brothers occupied each floor and they have made modifications with out telling me and they say they have took their share.

Earlier I was the only earning member where i took bank loans which was used for the property, i have very little evidence being paid to my father, Also during my tenure abroad with my savings i paid for purchase of land, but was paid from my bank account. Since i live abroad i asked my mother to get it registered under her name.

Unfortunately i i lost job and had to return back to India, i stayed for 2 moths then my mother asked me to leave the house and she is refusing to give my land or any share from her property, i am not sure if she has made a will. She has been supporting my brothers than me.

If she has made a will, how can i file a case for property and my land which is under my mothers name.

Claiming property

Hello Sir,
I'm a son of 2nd wife of my father. First wife had left my father with her 3 children long back. First wife and children had claimed compensation from my father when he was working and it was settled by the court.
my father is no more and it's been 11 years since he has passed away.
I'm considerably doing well and i have build a house of my own 6 years back. And there is a site in my moms name as well.
Now i'm not claiming for any ancestral property of my grand parents neither do I want any thing from them.
Q1. Legally can the first wife and their children claim for property which is in my name and my moms name? (Solely acquired by me through my earning)
Q2. They have gone to the village to claim for ancestral property after 25 years which I'm fine with and I'm not interested in that at all. But they are going on telling people in village that if I go there they will create problems for me. I do not want to go there and I dont want to claim for the property at any given time. How do I take legal action for threatening me?
Q3. Now my fathers brother had 2 son's and they want to claim for the ancestral property too. For that they are asking me to intervene as I'm the son of second wife and through me they can fight a case with first wife of my father and their sons.
Q4. how do i legally convey that I'm not interested in that ancestral property and how do i make sure they don't trouble me.

I just don't want to get it in this mess at all. Please suggest the right move.

Can anyone fill stay order on construction on old house

Hello sir
We want to build a new house on the place of our old house . Old house is more than 40 years old. My relation is not good with neighbors . So neighbors are not allowed us to make the new house at the place of old one . Can they filed stay order on this place? If yes how can we take NOC against any stay order. Please help me I was in trouble.
