Can majority in soc. force secretary to sign mou or resign for redevelopment agreed without gr 79(a)

Greeting to All,
I live in small Registered society where 6 members out of 8 members have appointed Redeveloper without following Bye laws or GR of Mah. 79(A).

1) Society is registered.
2) Society does not have Conveyance.

I being Secretary have tried to explain the legal process of GR 79(A) and redevelopment, however Chairman and Treasure and total 75% i.e. 6 members are not willing to listen and understand.

Chairman have called SGM with following Notice.

NOTICE

As resolution passed in majority in SGM for dt..... for the redevelopment and Secretary has voted against it, which create technical problem, contradiction to move on further.

AGENDA

1) Whether Secretary is to continued on his post or he should resign and hand over the charge to other person/member.

QUE. 1) Can Society Majority force me to sign MOU as Secretary, where redeveloper is appointed with out Conveyance and without following GR 79(A)?

QUE. 2) Can they force me to Resign if I refuse to sign MOU?

Thanks in advance.

Agriculture land distribution

There is piece of Agricultural Land which was given by the GOI to Scheduled Castes in 1972, And the Land was suppose to be given in the names of all family members.
My Uncles father was not at Home during the distribution so during that time my uncles Uncle said to the officer that as my brother is not home you can give the land in my name & once brother comes from other village after few Months, we distribute among ourselves equally.
As that time the panchayat where strong, the The Uncles Uncle gave the assurance in the Village Temple in front of Other relatives that once his brother is back he will Transfer his name in it.

Now here the Both the brothers expired & their childrens are left. And there was not attempt to distribute that land to is Brother names. & after his death the children of the that person took the land.
But from the pressure from relatives & other village people, the childrens allowed that the to cultivate to their cousin who is suppose to be the 50% owner of the land.

since 30 Years this is happening but in 2012, the childrens in whose name the 7/12 are there removed his cousin,

Now my uncle is without land, and who is suppose to be 50% owner of the land.

The Land is in Gujarat.

Can what can be done.

Regards
Deepak

Complicated issue need help......

Sir I am from chhattisgarh. There are 30 acres of ancestral land in my and my brother's name(jointly he is partner in every acre of land).he took loan of 3 lakhs from government bank under some kind of farming scheme, putting the land as security(since that land placed as security is also in my name so signature was also needed but he fraudly released the loan without my sign),now he was unable to pay the loan so, he asked me if l pay the loan then he would give me 3acres of his share.I paid the loan he said that he would give me this and this... land(without any legal formalities just orally) meanwhile he died without registering that 3acres into my name.

Now his widow is ready to give me 3acres as promised by her husband.

So here my question start:

1.can I separate ""only"" that 3acres which are going to be in my name as our 30 acres are jointly in my and my deceased brother's name.since I don't want to have a partion.

please tell me. A way...

Municipality's rights to remove encroachment in open spaces sanctioned in private layout

Here is a brief:

There is an Open Space which was earmarked as Open Space in a Private Layout. While the Open Space was marked in layout and approved, there is no documentary evidence to show that it was transferred to the Municipality. Some persons are encroaching this Open Space by showing rent agreements with the owner. Here is question regarding law:

Who is the owner of the Open Space? In absence of a documentary evidence to show that Open Space was actually transferred to Municipality, in which cases can Municipality be deemed to say that Municipality is the owner of the Open Space and has right to remove encroachment.

Any relevant case laws?

Additional Facts: The Open Space is in Maharashtra and the layout was passed in 1960 which is before the Maharashtra Regional Town Planning Act came into existence.

Assigned land

sir,
my aunt had aquired agricultural land as she was landless in her village, she got 2 and half acres 30 yrs ago.she was married by that time and her husband found a job and she had to move to another state with him.since the time she aquired the land her father and brothers had been enjoying the land and had never given her any income.now she has the survey numbers only and her husband has expired and she has 2 daughters he has to settle.she is willing to sell that land or cultivate it and asked her brother(father has expired) to give her the papers of property,he is rejecting to leave the land and is telling her that the land is being cultivated by someoneelse, but he is actually enjoying it all by himself.
please kindly suggest procedure how she can get the pattadaar passbook or documents of the land.this is in a small village andhrapradesh ,ongole district.she isnt educated and has no support to fight with her brother who already has agriculture land of his own.
