Looking out for a property which is a Tenanted Old Bldg.
Whether Co-Ownership Agreement can be done between the Landlords and Buyer
If so any draft agreement is available
Stampduty and taxation implications if any
Validity under the law ? and whether Loan can be obtained by the Buyers

Hi,
I am planning to reconstruct my home at my village in rural pune.
I want to avail loan for this, but bank is asking for approval from collector.
My question is, Approval letter from Grampanchayat is valid in any cases?
I read some articles on this, as per those articles grampanchayat can give approval to plans with below 0.4 FSI.
Can anybody please clarify this?
Thanks.

Dear Sir,
My father willed his property to my brother. Would he need No Objection Certificate from us, his siblings if he wants to sell the property.
Thanks

Respected members
My father had bought a house plot in the year 1987 from Mr. X(Seller). After the death of my father in 1996 the plot has been transferred in my name through mutation and I constructed the building within the area where my father had constructed Wooden house nor encroaching even 1" others land.
Now the area has been fallen under municipality area and as per municipality law I have to pass the floor plan of the building.
Now I come to know that the actual area occupied since my father time was about 30'x 38' whereas the area recorded in document is 30' X 30'. There is no complain from all the four boundary holders as well for the area actually occupied. Nor any boundary side belongs to the Mr. X and his legal heir.
So in view of the actual area occupied I approached the Collectorate Office to correct the record as 30' X 38 'ft instead of 30 x 30 ft. Accordingly the area has been verified by the concerned Head Surveyor and Revenue Surveyor along with all the members of boundary holders and there is nothing adverse in the field inspection report.
But the youngest son of now late Mr X has come to know that I am planning to update the land record thus he has file a petition for not to include the excess portion so acquired by me on the plea that his father had sold 30' X 30'ft area only and not 30 X 38 ft. Whereas the petitioner was minor when his father had sold out the plot in 1987.
Now I am of the opinion that the petitioner (son of late Mr X) has no right to make claim for the excess area of 8 x 30 ft at this moment on the following grounds
1.That, neither petitioner nor his father himself had objected to the acquired land even when my father was alive nor even when Mr. X was alive until 2 years back.
2. That, Nor the petitioner holds right title of the so called excess land of 8 x 30' ft acquired by us since 1987.
3.That, Nor he is my one of the boundary holders so that he can say that I have encroached his 8 x 30 ft land.
However, I valuable opinion of the learned experts is solicited on the above issue so that I can place my views accordingly before the Collectorate office as and when called for.

Hi,
Please advise on the following.
My father is having 4 children out of which one of them is a daughter. Iam the youngest son to them and my eldest brother has passed away 2.5 years back. I was staying in Mumbai previously and moved to Bangalore after the death of my eldest brother. The entire property belongs to my father and he is earning rents out of them which is running up to 3 lacs per month. He had already made some properties in the name of my sister. In spite of this my father is handing over all the income to my sister and brother in law. He is not parting his income to neither me or my second brother or my sister in law who is a widow. When asked my father says that the entire property is his own earnings and threatened me that he will give all the property to his son in law and he will come with the court notice to vacate us from where we are staying with all the family members since 30 odd years. He had filed an harassment case against me in the elders forum which directly comes under Bangalore city police and I have received a notice towards this. My sister and brother in law is instigating my parents to do all these things in order to just grab all the property of my parents. My second brother is a divorcee and has no dependents. I am married and have a 3 and half year old daughter.
What can be done in this situation in order to prevent my sister and brother in law in getting all the income and prevent my father in giving all the property to my sister and brother in law.
Tenant society formation
Our building is a Old Tenanted property where there are about 15 tenants.
Whether a Society can be formed by the Tenants for maintenance purpose
Whether the Landlord can also become a member for his flats in the same buildings
Other important aspects to be considered
