Deed of gift

Hello, i m residing in mumbai, and i have property gifted to my mothers name by her real elder sister before a year ago through the act of deed of gift, and we have completed all the registration and stamp duty and society transfers before a year itself, now the donor asks us to give the property back to her without letting us know any reason to do so., the deed clearly mentioned that this "deed is irrevocable" , also it states that the Donor was staying with the donee since last 10 years and the donee has taken care of donor's day to day care and responsibilities and she is confident that the donee and her family will also take care of donor's in future and so with love and affection the donor is gifting her flat to donee.

My question is whether we can be leagally forced to give the property back to her or no?
Even though we have never done anything wrong to her, she is forcing us and threating us to go in court if we don't make a transfer back to her.
So are then any chances, that we can be affected as per the law.?
Thanks in advance!

Valid Adoption

Respected Sir, recently I have gone through old documents and learned that my father was adopted in 1946. Adoption was registered in sub-registers office with index. At the time of adoption, age of my father was 7 years. Hence, he was unknown about that. When he saw the documents regarding adoption, he shocked. In 1972 heir from adopted father's brothers daughters were stood and became owner of the property. My question is that can my father claim the right of heir? Because as per tenancy act, adoption could not cancelled in any how condition. Next, in 1972 my father was 33 years. Can his adopting mother has legal right of distribution of property or again to stand new heir? Waiting for reply. Thank you. Somnath

Contradicting evidence filed by tenants advocate

Respected Sir's
I am a landlord of a property in Mumbai. I have filed a suit on one of my Tenants who is having commercial business in the property. he has carried out illegal additions and alterations in the premises.I had given in writing to the tenant that some basic work will be done by me before i give possession. But he did not approve this and all illegal work is done by him. In the court the tenants advocate has filed his written statement on the letter given by me but has not made any specific mention about the present status of work which is illegal and not done by me. Same is the case in city civil court where the tenant is plaintiff and I am the Defendant. Please advice and let me know your view as to what outcome can be expected. Whether the tenants case would stand or all matters disposed off or will it be beneficial for me in further course of action.
Please advice.
Thanking you in advance.

occupant / legal hires right

Hi, I live in Mumbai, our property is going for redevelopment. After my grandfather's demise(1988), my grandmother was living in the said property. Our family I.e my dad mom me and my brother are living here from past 17 years. My grandmother made a will in my dad's name for the said property. But we could not register the same. Now my dad has 7 elder siblings who have claimed for the property in mahada, and the builder is not ready to make an agreement with us. He is asking us to issue a possession letter signed by dad, and in return he is giving us the rent cheque and no other legal document from his side.

Documents with us: Grandmother's will Ration card - in the name of my dad Light bill in grandmother's name Rent receipt in grandfather's name Can we demand for an agreement. How much % are we entitled. We do not wish to sell the property. As occupants are we entitled for an agreement. Can we file a suit against the builder.

Regarding a will of a property

Respected learned professionals,

Brothers Vishnu, Mahesh, Ram, & Ganesh got their fathers property partioned in 1959 by registered partitioned deed.

In this partition, property of Mahesh and Ganesh is kept as joint property in the name of Mahesh and Ganesh together.

Mahesh was unmarried and he died on 1969 at the age of around 50.

This joint property is enjoyed by Ganesh and his family since the death of Mahesh who died unmarried.

All other brothers : Vishnu, Ram and Ganesh were married and has family and children. Vishnu, Ram and Ganesh have died.

Now, in 2015, the family of Vishnu and Ram approches ganesh's family demanding partition of the share of Mahesh for them claiming they are co-owners of the property.

But Ganesh's family tells them that, Mahesh under the will dated 1967 bequethed whole of his property in the joint holding to Ganesh only.

The will wrritten in 1967 is non registered but witnessed by two persons. The two witnesses are not alive now.

Family of Vishnu and Ram doubt the authenticity of the Will.

Now my doubt is, if the family of Ram and Vishnu approch court for partition suit, hether thy can challenge the auticity of the will as it is no registered.

Or how Ganesh's family prove the authenticity of the will as it is not registered and the witness have died now.

please enlighten me sirs...,

Licencee not vacating the premises.

We had rented out a shop vide leave n licence agreement to a company. Thereafter the company was irregular in paying rent. Later the company gave the possession of the shop to third party. The company told us that they are their own people. The company paid rent for few months after such transfer of the possession. We were yet unaware of the arrangement. In December the company stopped paying us rent n told us to sort the matter with the person to whom it gave our shop. But the said other person was not ready to pay the rent at the amount agreed between us n the company. For three month s we did not receive the rent from either party. Further in wake of loss of income we agreed to lent the premises to the other person but he was not ready enter in registered agreement. So we asked him to vacate the premises which he did not even after many times requesting him. Finally we told the company to intervene. The company requested to continue the arrangement under old agreement n paid us pending rent. Now again company has stopped paying rent. We have given notice to vacate the shop by hand delivery. Giving two months period as against one month in the agreement. Yet the person n company are not vacating the premises.

What is the expedious remedy? Can I go n lock the premises after notice period ends. Can I throw away their belongings.

What will be repercussion on me?
