Decree vs withdrawl of court case

Sir,

There is property next to my property. I am interested to buy it completely. However it is under litigation. One of the defendant has sold out the complete property in the year 2000. There after many sale transfers have happened into it. Now there are @ 6 owners into it each holding part of it. In the year 2013 the plaintiff's which happen to be cousins of the first defendant's father in law and there heirs, have filed a suit in Jr. court. The court has passed exhibit 5 and put stay on the property along with partially agreeing their claim in property.

The plaintiff's have gone to Sr. court against the Jr. court verdict to get clear mandate in there favor. However there appeal was rejected.

Now they want to do settlement. Shall it be better for defendant's that

1. Plaintiff withdraws the case and do a compromise agreement with defendant's outside court. Gives consents to all previous sale deeds by registered document.

or

2.The compromise deed is done first where in the consent to all previous sale deeds will be taken into and decree is sought by court. Then the same be registered in registration office.

Best regards

Shekhar

Related to land tribunal commitee in karnataka tumkur district

Dear Sir/Madam,

here asking for to know land tribunal commitee, because there is in tumkur including AC there is 4 members of Tribunal commitee members to decide land issue, for that here i want to know their rights and power.

Because in my Grandmother ( Inam land ) case they are going to share all parties ( my Grand mother/ Tenant/ land lord) equaly and they are not seeing whether they have rights or not on the property.
already i consult local lawyer sir, he told if Tenant or land lord have rights then they can take, Also he told as per his knowledge by verifying the related documents he told they dont have rights on this.

But here that land tribunal commitee members going to share all Parties equaly and this are all doing only because they are in case from past 45years, Now tell me is it lawfull.

Ok we will agree for that also but we need one good value thats it..

Here i want to know is what ever decision Tribunal commitee will take is it will be final or is we have any option to challenge this matter in high court.

Thanks
Devaraj

No agreement tenant

Dear sir,
I am staying in a home for past 10 months and now i want to shift. When i asked the same to my landlord she says that 2 months of notice must be given as per the rules and if you want to leave, then i will be deducting the rents to 2 months with Rs. 11000 of painting cost.
The deposit which we paid was Rs. 25000, if she deducts 2 months of rent i.e., 7000 per month, and Rs.11000 of maintenance cost, we get nil balance.
The main thing is, she didn't make us the rental agreement.

Please help me in what i should do next.

A was purchased one BC colony house in rural village in 1986 on the name of Mrs.'A' and 'A' was living in the town, it is unregistered document and still now it is not registered.

Presently All the children were married.

Last 4 years back Mr.A was given that colony house to 1st daughter named "D" by orally and told that stay whenever time to be required. Now the daughter is staying in that house.

Recently Mr.A was expired due to the health problem.

Now, Mr A's wife (widow) and son was telling to their elder daughter "D" to vacate the house immediately and pay the Rent from last 4 years. presently Daughter "D" was in poor condition.

Kindly advise the below points :

1. Daughter "D" will compulsory Vacate the house...?

3. Is there any rights available to "D" of her father's house ?
4. What are the legal grounds available to the daughter "D" ?

Partition suit and injunction

I along with Nine others(common friends)purchased a plot of land of about 2800 square yards jointly, for future development of the same for our own individual houses. All of us, i.e ten buyers have paid equally to vendor and conveyance deed is registered. However there is no demarcation of individual area and thus the total plot belong to ten buyers.

Now the nine co owners are insisting to sell the plot to one builder for a commercial building. These nine people belong to three families. But I am not ready to sell my share and desire to construct my house.

I apprehend that the group of Nine people would sell their undivided share 9/10th share to the builder who has threatened me to buy the same and shall make me agreeable for sale of my plot also.

I approached a lawyer who says that any petition by me in court for Injunction on such sale and partition shall not yield the favourable order as other can sell their undivided share and with the new co owner I shall have to fight for partition.

I am not convinced by this advice.
Kindly give opinion about my status and action I should take at legal forum.

Regarding Sale agreement

Respected sirs/maams,

I am not well versed with law terminologies so kindly excuse the illiteracy here.

We have an ancestral property in form of a plot in Delhi. A person(close friend of my father's brother) approached my father and showed interest in purchasing the property.
My father agreed to sell it and got into an agreement with the person after he paid a meagre amount as bayana. This happened last year in july 2014.

However, the time period for paying the remaining amount is not mentioned in the agreement. Also, we have only the photocopy of the agreement original lying with the person. We have been trying to contact the person but he is not responding.

I am a bit tensed and would need your expert opinion on the following questions:

1. Can my father sell ancestral property?
2. Can the person usurp our property by altering the agreement saying he has paid the whole amount?
3. For what period will this agreement stand valid, in case we want to get it developed by someone else?
4. What remedial action can we seek?

A prompt reply would be much appreciated.

thanks in advance.
