Registration of lease deed

Respected sirs,

We have a property which we want to let out and register the lease deed.

The property is obtained by our mother through properly executed and valid WILL
of our father who expired last year August.
Query is:
Can we register the lease deed in our mother's name as"OWNER" and LESSOR with the TENANT as the LESSEE, without any other formalities or documents??

Adoption 1946

Respected sir, my question is that whether the adoption deed was registered earlier as per hindu adoption and maintence act 1956 is valid today? whether it will be cancelled today due to limitation?
I have query because my father was adopted in 1946 but did not got any effect of adoption due to missunderstanding that it is cancelled and now he is heir of his biological father. Till we have his registered adoption document. plz suggest solution.

Agriculture land division

Dahyabhai having agriculture land recorded with the name of his brother Nanubhai. This land coming from his mother Self acquired. She has death. So this land is become Ancestral or Self acquired for Dahyabhai & Nanubhai ? Please advice me cleaver idea.

Transfer of flat

I am the legal heir of my Parents flat they havei deceased, now how do I transfer it in my name , received the legal heir letter by the court I reside at New Panvel. I have 4 sister who are also Legal heir but they have given NOC to transfer the flat in my name. What is the procedure can I do it by myself or have to get it done by an agent. also which Cidco office I have to approach, pls tell me the money required and the time period for the Procedure.
Another Query One of my friend told me that when ladies are Legal heir of any property they don't have to pay the stamp duty but my lawyer has charged me a hefty amount for the same what is the procedure and solution for this if I have paid more can I get any compensation from the court . I am from New Panvel

Property in ad(adi dravidar) conditional land (tamil nadu)

My Grandmother had bought a land in 1994, and having a patta in her name. Now she is no more. As my father is only son for my grandmother, he applied for name change in patta. But that application is rejected by VAO, stating that land is AD(Adi Dravidar) Conditional land. Since we are not belongs to AD, VAO states that he is helpless in this application. VAO told that in recent years only this restriction in in practice. My question is,

1.Weather can we get patta in my father's name?

2.Since we have patta already in my Grandmother's name, will that new rule can restrict the name change?

3.If we construct a house in that land, any problem will arise?

Seller don't have patta in his name for the property by settlement

Hi,

I am planning to buy a residential land. The seller got the ownership by the settlement(year 2013) from his brother who got the settlement(year 2011) from his mother(2 settlements within one family).

But the patta and chitta is in the name of the seller's mother.

While buying this property, Shall I change the patta from his mother's name to my name? Other documents are clear.

Please advise me on this.

Shift to my son's house

I and my wife aged above 65 ,lives in Ahmedabad ,in house owned(in my wife'name) by us. My son's (our only son, no other child) family will be shifting to their second house near to their office(both in Maharashtra). Both the house are under long term loan from private banks .They are thinking of selling their first house to settle part payment of new house loan. We suggested them that we sell our Ahmedabad house and shift to their old house , and from this realisation (sale of Ahmedabad house) make payment of their old house house and clear of loan liability. By this we will be near to our son as well as keep the property being sold. Our settling his loan liability can be effected under normal course or by through with help of some legal documents? My quiry is can capital gain of sold property be offsetted some way ? Do we need any document for this shifting ? My son is ready to execute required deeds for this . Can a MOU or LEASE agreement or through a POA can this transfer effected ? As it is a general quiry I am not submitting any files.

Complaint against the society registered with bogus members

Respected experts,
I am residing at a chawl situated at a plot where there exist a building of one ABC Housing Co-operative Society. As per list of members annexed to the schedule of conveyance of the said society, it is found that the said Society is registered with bogus members in the year 1973. As I was born in the year 1964, I know that the building of the said Society was constructed in the year 1976-1979 and that thereafter the new flat purchasers (other than registered members)purchased respective flats and now are claiming to be members of the said society. It is surprised that the members whose name is shown in the conveyance deed never taken possession of the flats nor they transferred their share certificates in the name of the new flat purchasers in the year 1980. While constructing the building the developer had consumed FSI of the Chawl over the building of the society showing occupants of the chawl to be tenants of the said Society. I have already inspected file A of the said Society under RTI Act and as per details given above I came to the conclusion that the said Society is a bogus Society.
Kindly inform me how to take legal action against the said Society who being itself bogus taken away right of re-development of Chawl and the developer encroached in the open spaces and right of way enjoyed by the chawl occupants since the year 1933.

Grandfather property - threaten by daughters

Hi Sir,

Please help me with below situation.

My father got a Property A" from his mother in the year of 1960

My father bought "Property B" & "Property C" which was self earned by him

In his life time, He settled the "Property B" to Son 1 & "Property C" to Son 2 with the consent of all 3 daughters who all were married before 1980.

In his life time, he did not settle the "Property A" to any one and died in the year of 2000.

Now all 3 daughters are threaten to go to court if "Property A" is not shared to them.

What would be the result, if it is filed in the court?

I just what to know, how to categorize the "Property A"? Whether it is Ancestral Property or not. If yes what would be the rights to the daughters?

Kindly let me know, if any info is required.
