Mere brother ne father ki dead k bad 2003 mai mujse hakk sod part liya hai jismai kuch plots Pe case chalu tha us case ka result 2008 mai laga hai aur mera naam 7/12 Pe aaya hai tho kya muje mera share milega ya mera naam cut hoga air baki k polts Pe meri waras nodh nahi hui hai uspe mera naam lagega tho who bhi mera brother cut kar Santa hai kya I want my share now what I do?

Mutation certificate not in builder's name

Dear Sir,

I'm purchasing a flat in Ranchi Jharkhand, which is under construction.

I want to ask that if the mutation is not in builder's name while constructing a flats is ok or not.

or you can plz tell me abt mutation of flat building..when it is getting constructed.

Conditional registration

Hi Sir,

My father has a house in Andhra Pradesh which we are selling it to a person.
He said that he will give half money before registration and remaining half after few months of the registration.
We do not trust him much. so we asked to give us some guarantee. So he said he will sign a bond or can keep any of his property on my fathers name conditionally.

my question is

Can this be possible. if possible how can we be sure that we get our money after registration.

Can you please give me any good idea.

Property without will and nomination

My grandmother has died in 2006 and left behind a flat in Mumbai with no will and nomination. She has 2 sons & 3 daughters and all are married. Out of 3 daughters, one daughter died who has 2 sons and 2 married daughters.

Now we want to transfer this flat in my mom names without filling petition in court for succession certificate.

We had meeting with society office bearers and they asked for NOC,affidavit, etc.

Please help how to transfer this flat in my moms name ? What are the documents required for it? Will it create any problems in selling this property in future? Please let me know what are the procedure as per bye laws of mumbai ?

Property of women

My maternal uncle (mama) purchased a plot of land measuring 1000 sq. yards which he gifted to my late mother through a registered gift deed.
My mother expired in the year 1991 without leaving any Will whatsoever. My father died in the year 2013 without executing any will whatsoever, leaving myself and my two sisters. I would like to know whether, under the circumstances as stated above, my sisters have any share in the aforesaid property of my mother more so in the light of the amendment in the Hindu Succession Act effected in the year 2005 and the judgment passed by the Hon’ble Supreme Court (Division Bench of Adarsh K Goel, J and Dave, J)in C. A7217/13 Phulvati Vs. Prakash in October 2015.

Transfer of trust property

Dear Experts,

As per the provision of the trust deed the trust property should be transferred to a non-beneficiary upon death of the beneficiary.Accordingly, upon death of the beneficiary the trustee had moved before the court and obtained order to the effect of dissolution of trust. Now the person who is entitled to the trust property upon death of the beneficiary want to sell the property. My queries are as follows:

1. Do it requires any further formality to transfer the property to the person named in the trust?
2. Is it automatically stands transferred in his favour upon fulfilment of the condition (demise of the beneficiary).

Women rights in ancestral property & self owned father property

Dear Concern,

My father having agri land of 30 acres in DIST. NAGPUR, MAHARASHTRA.

My father having ancestral land of 10 acres and he had purchase 20 acres from my uncles in 1965.(10 acres getting from my grand father & 20 acres SELF PURCHASE from Uncle)

Now, My father is expired in 1980 and mother expired in 2000.

We are 2 sisters & 1 brother.(Me, my elder sister & elder brother)

After my mother death, we upload all 3 names at same time (Me, my elder sister & elder brother) on land 7/12 in 2000. My brother is not ready to give share.

Now, as per new SC judgement on Ancestral property NOV - 2015, has women not having equal share in Ancestral property.

My question is :-

1. SC judgement on Ancestral property - 2015 is apply for above condition. (As Name uploaded on 7/12 in 2000, before recent judgment OF SC 2015)

2. How much share, i will gate in above condition.(My father getting 10 acres from grand father & self purchase 20 acres by father)

Rectification of registered deed

I have purchase a flat in the year 2004 at 2, Girish Ghosh Road, Belurmath, Howrah - 711202 flat no. 213, block - a/1 2nd floor and registered in the July, 2005 at Kolkata - A.R.A.-I. But when I go to the Bally Municipality for Mutation the concerned person of Mutation department told that you have to require to made a rectification deed as the premises no. has been changed from 2 to 2/2 Girish Ghosh Road. I have obtained the xerox copy of floor plan which was passed by the Bally Municipal Authority as sanctioned plan in 2, Girish Ghosh Road. but the fine for non received of CC has been deposited in the current premises no. in 2/2. (the fine is deposited by the promoter in June, 2015)naturally I go for mutation in 14th dec, 2015.

Now is the rectification deed is required regarding change of premises no. if yes then what is the procedure and cost to be charged ?
please help me

Daughters rights on father's property

Hi, Experts

In case Partition Suit File By daughter on her Father's property(Who is no more) (No deed made by father) , if anything happen to daughter before the court decision regarding the partition case, who shall be legal heir after her??
whether daughter son's have rights on land after his mother but before court decision??

SPA for UP property, Resident of New Delhi

Hi, I am staying in New Delhi. And I have one plot in agra and one flat in ghaziabad, UP. Both of these properties and pending for registration and lately I will have to go outside NCR for employment purposes.
Please let me know can the SPA be registered in New Delhi or in UP. If its UP, can I go to Noida or Ghaziabad sub registrar office to get it done. Also want to know the actual fees related to this matter. I don't know how much bribe I will have to pay as I have to get it urgently.
