Sale under safaesi act

One of my family members have purchased a Property throgh e-auction under Sarfaesi Act 2002U/s 13 Rule 12. Eauction date 29.6.15 balance paid by raising a loan with the same Bank on 13.7.2015. Bank issued Sale Confirmation letter on 30.6.15. Property registered in the name in July'15. But later on we came to know that the property is under lock and key. Bank filed affidavit before CMM for physical possession.(1) Who has to bear the legal and other expenses for the proceedings for physical possession? The Bank or the Bidder/borower? (2) Whether the bidder/borrower can claim refund of interest on the loan applied till the date of handing over physical possession?

Unprobated will after death

Will is registered by a deceased person before her death. Property is used by her relative who does not have any legal right on the property. In the will deceased person clearly stated that after her death the immovable property has to be transferred to some other relative other than the person who presently lives in that property. Whether the person who lives now is forced to vacate the propert, if you he will is probated?

Regarding the distribution of property

Dear experts,
My father is a very dutiful son and takes care of his aged parents and caters to all their expenses. I have two paternal aunts who always shirk away from their duties as daughters and have in the past gone on long vacations while my dad used to sit for hours into the night with my grandfather in the hospital. My grandfather is 90 years of age and is unable to think clearly anymore and very unfortunately my grandmother always misguides him and goes to the extent of loading my aunts with gifts who do almost nothing for them whereas my father who bears their expenses gets nothing in return. My grandfather is a retired Air Force officer and gets a high pension package but has been taught by his wife to not contribute to any of the expenses. I do not want an ugly situation to come up when my grandfather passes away nor do I want my father to be devoid of what rightfully should be his so I wanted to know whether my dad can claim the property and money left later or not?
I am studying law currently and knowing my aunts I am pretty sure that later on they are going to turn around and ask for their share of inheritance even though they hardly even come to meet them. My father is extremely gullible and does not see all of this coming. Pretty obviously he has a lot on his shoulders, my brother's education needs to be catered for and I am just in my first year of law. Please do tell me what can be done? And whether there are any provisions in the Hindu Succession Act under which the person who provides for the parents gets the benefit?
Many thanks and regards :)

Regarding Residential Plot

Sir,

A 200 Sq. Yds plot was booked by me in year 2011 10,000 rupees per sq.yds and 10,50,000 was paid by me to developer in 2011 and 12,70,000 in 2014 including EDC charge. The coloniser demands from me EDC charges before possession of plot and the same was paid by me. But after signing buyer seller agreement now they are demanding IDC before the possession. The plot is also deep 5-6 feet from the roads developed by coloniser. Sir now i did not want to take plot because the developer is raising his demands day by day. The colony is in punjab jurisdiction the developer had its office in Chandigarh and he closed his office from Chandigarh. On my all cashmemos he marked his address of Chandigarh. Kindly guide me i can cancel my plot at this stage and whether i can move in Hon. Consumer Court of Chandigarh jurisdiction.

Terrace issue.

There is a building terrace on the top floor in my building and opposite to the terrace there are two rooms.(one room of the 2 is mine) The building is in Pagadi system. The issue is that two tenants of the building have constructed two rooms on the terrace. In the building map its terrace area which belong to everybody. The tenants who had made rooms on terrace are saying that they have documents for the room ( No tenants have seen the documents (They have taken electric meter on the rooms they made on terrace from BEST)and i am sure its not possible as i have seen the map of building and its clearly written as OPEN TERRACE.
My question is is it possible to construct rooms on terrace by any law??
If its wrong by law how to get the terrace back.
