Right in rem

What is the legal definition of the term - granting rights in rem deriving from ownership giving the right to use real estate. Basically what does it mean?

Rental amount is being asked to transfer to another account

Dear Experts,

My sister is staying in a rented house, the landlord has moved to overseas.
Now the landlord is asking to pay the rental amount into his father's account.
What is to be done in this case.

Harassment by Neighbor

Hi, I live in a Chs in Mumbai and for years now, the person staying below my house has been harassing my tenants. 2 families have already vacated the flat and the 3rd tenant is currently being harassed. I use my current flat rent to pay the rent for the flat I stay in and I already am on financial crisis. He doesn't want anyone staying in my flat. He uses all means of harassment including going on the terrace above my house and throwing huge weighted stones. Even if there is slightest of noise from my house, he and his family come to my flat and start abusing and threatening my tenant. Written complaint Has been given to the Secretary of my Society, however they have refused to take action saying this is a civil issue. Tenants refuse to come to police station. I want to understand if I am able to convince my current tenant to come with me to the cops, what all can I do? What can I also do legally? I am mentally vv harassed and this has started affecting my health too.. If I don't get rent, I will get in a miserable situation. The society and all its members are hopeless. I need proper guidance in this pls.

Ancestral agriculture land dispute

Ancestral agricultural land of 7.8 acre in Cholavaram west of Cholavaram Panchayat. In 1960 my grand mother owner of above land made a will for the above land and registered it in Kannamangalam sub registrar office that the said property should be equally shared by her two sons 1. Late M Govindareddy (my father) No 2. Late Adhikesavareddy (my uncle). in 1981 both the brothers divided the land mutually not registered it, that time a portion of 30 cent of my father's share grabbed by my uncle's sons and used it. In 2005 a formal Patta was issued by vellore taluk in which the 30 cent of my father's share also included in my uncle's patta In 2012 my uncle's four legal sons divided their share and my father's 30 cent land also and registered in their names without our consent. As my father was died in 2001 and my uncle died in 2013. We are three legal heirs to my father (late M Govindareddy) we all were unaware about the above malpractice since last year. Now my question is it possible to get back the 30 cent of land from my uncle's sons ? If so how can we move kindly suggest us ....

How to get family tree/legal heir certificate in mumbai?

I see in internet that in mumbai/maharashtra Family tree/legal heir certificate is issued by Tahasheeldar only to government employee and Mill workers. If so, what other citizens should do to transfer khatha of properties of parents or spouses?
how poor people in rural areas of Maharashtra get family tree to transfer assets? how corporate people get transfer of funds after the death of a person?

my known person living in worli,mumbai has a site in bengaluru, his wife has passed away. now to transfer of khatha of that site from wife to husband it requires family tree. since there are no documents of this person from bengaluru. he should get family tree from mumbai only. so, how to get family tree or legal heir certificate in mumbai?

Selling my property

I had a house in delhi which was built on dda land alloted to my grandparents and which I received through my grandmother's will.i underwent the process to get mutation done in my name.i underwent a collaboration with the builder to demolish the house and built 4 floors along with stilt parking and selling rights of two floors rested with him and two with me.we did a sale agreement and sale deed for the same.but since he paid the stamp duty and he was buyer so he kept the originals and gave us the certified copies.For building plan to be sanctioned you should have conveyence deed registered for which builder helped since he had a middle man in dda and he kept the original conveyence deed with him saying he will return it as soon as he has sold both his floors.during all this a period of 5 years passed and we left the conveyence deed with him .Now he has lost our conveyence deed.my question is will I be able to sale both my floors and execute a sale deed in some body's name with certified copies of conveyence deed,sale agreement sale deed although I have all the papers like allotment letter,site possession letter perpetual lease mutation letter etc

Land Purchase

Hi Experts, My father and uncle had purchase land in Dahisar with 25 tanents on land in 1980. They had prepared Sale deed. But that time they have not done registration. Because lack of knowledge. But on the property card My father and uncle have Thier name as imala malak (remark - H) with reference to Sale deed. In 1993 they gone for Extension agreement and conveyance deed. In the same year we put this papers for registration & stamp duty. But we have not paid full amount of registration fees. As DP road in going from our land. Somebody suggest do not paid full amount of registration fees that time. In 2012, we receive one letter from Registration department, old custom house,CST to pay the balance amount to complete the procedure. So as per that letter we paid the balance registration fees. And complete the registration procedure. We received Index 2 and certified copy of registered documents of land. But till date we have not received original papers from the department. The main owner (seller) has expired in 1994. Now his legal heirs have there name on 7/12. But they do not have there name on property card. The legal heirs of seller had done deal with one builder for land development in 2008. One of the tanant had done NA of one piece on land from our land in 2010. We had won the case against all the tanents ( the case was originally suit by seller in 1976). We received the decree to remove the tanant from land in 1983. But we have not use that decree to remove the tanant. My question? 1) Can we able to put our name on property card, 7/12 & 6/12. 2) Can we able to win the case against legal heirs for the agreement they had done with builder for development. 3) Can we able to remove the tanant on the basis of decree received in the year 1983. 4) Can we able to win case against the tanant who has done NA of small piece of land

Property issues

Hello. This is regarding the property of my father in law who died about 15 years back and subsequently my mother in law also expired 1.5 years later leaving no will behind. There are 4 legal heirs to the property.2 daughters and 2 sons. the property tax is being paid regularly in the name of my father in law as there is no clear owner at present. 3 persons have mutual consent for transfer but one daughter is creating the problems.what I actually want to know is whether we can go for the mutation by mcd rules mentioned on ur site . Since we have been paying the property tax in the name of my father in law, is it acceptable? Please help
