Hi - My father and mother purchased a flat jointly in the society. Both their names appear in the Registered Purchase Agreement. My father name stood first in the share certificate and my mother name was second and mentioned as Associate in bracket. My father had nominated me as his sole nominee. After my father expired I made an application informing them about the death of my father thereby adding me as the nominee on the SC and add my mother as the First member on the SC i.e. enter her name first on the SC and my name as nominee below her name. The society went to the lawyer and have now added me as the nominee (first name) and are now asking me to nominate my mother as an associate member who btw is a joint member. Can you let me know what is the correct treatment for my mother in this case and how can I ensure the society adds my mothers name first on the SC.

Sir,
My son and daughter in law are residing abroad and cannot come down, thus giving me the entire POA rights to ensure the smooth running of their finances including the societal affairs.
Now I would like to stand for election and attain office bearers position, as the society lacks in members as they are all old and cannot take care of the running and this year, the MC is finishing their 5 yr term period.
My son and daughter in law would like to process my name in the legal authoritative high court documentation to the society MC asking them to include my name in the society books as member of the society enabling me to stand for election.
My question : Is this procedure correct and can you guide me, what is the right documentation for doing so?
Thank you.

My Father gave me a legal document of property stating he has no objection in transferring this property to my name. He expired last year. After his death Me, My mother and Brother are legal heirs. This legal document also contains no objections from my brother and Mother.
Property is a small room in old Chawl in Mumbai , which is under redevelopment for last 2 years. Looking at current progress redevelopment may take another 5-6 years or more. Before redevelopment began 2 years back, property was registered on my father's name.
When I approched Builder (who is redeveloping this chawl ) and Chawl association for re-registartion of this property, they tells me to wait tillIs redevelopment is over . Is there a way to legally register this property on my name now and not wait for another 5-6 years. My brother is making unnecessary noise after my father's death and that worries me. Does MHADA play any role in the entire process ?

We are living in Bangalore as a tenant from last 2 years. We have vacated the house with 1-month notice. Our Owner is refunding very less amount from the deposit. We are paying rent of 26250 per month. As per agreement he should cut down max one month amount for painting and cleaning .he is cutting around 45-50K for painting and cleaning purpose. He is even cutting around 10,000 for sinking funds that should be paid by the owner to society and I have confirmed this from society office also that it should be paid by owner only not by the tenant.
Please let us know what action we can taken in this situation.

Need advice on the following :
Need advice on the following : The pagadi house being situated in Mumbai is on my mom's name. Earlier I was staying at the house along with my mom and sisters. Both sisters are younger to me. Lost my dad at a very young age. Took care of mother as much as physically and financially possible until her death couple of years back. Due to constant differences between my younger sister as well as daily fights, I had to leave the house as she used to fight and then threaten to leave the house / commit suicide etc. My younger sister stayed at home along with my mom and took care of mom after I left, however, I used to visit the house every week and take my mom out etc. After mom was bed ridden, I used to support financially and visit her as much as I could. Whenever, she had to be hospitalized, we share the expenses, responsibilities etc.
I married off the elder sister and bore all her marriage expenses as well as did all my duties as a brother when her first child was born. She is also non-supportive.
Younger sister, I sponsored her education and made her a masters in Law based on which she is currently working in a reputed bank in a good post.
A time came when younger sister could no longer bear the expenses of mom and then after sending me an email, she left the house abruptly. My mom was then taken care of by the maids whom we had employed to take care of mom. Younger sister left the house saying that she could not bear the expenses of mom and got her own house and started staying at that location. I used to visit mom and take care of the maids salaries as well as the grocery expenses, maintenance expenses, medical bills etc. Sister rarely used to visit during this period.
After my mom's death, due to age related complications, younger sister again started staying in the house on some pretext or the other. Since it was not possible for me to stay at the flat due to some challenges, I let her visit the house as and when she pleased. She currently visits the flat, say 2 -3 days in a week, most probably on weekends and stay at this place while on other days she will be staying at her own flat with her husband.
Recently, I tried talking to her to sell of mom’s house as I am going through some financial difficulty, I am also job less since past 3 -4 months. However, she refused to help me and also does not allow me to sell off the property saying that she needs the house for self. Tried talking to her amicably many times, however, she refuses to co-operate.
She is keeping that house as a cat house, wherein she has a few cats as well as two maids who feed and try and keep the house clean. Off that is one old maid who is not even able to manage her day to day needs.
Given the above, what options do I have in
1. forcibly selling the flat and getting my share of the property?
2. I am also interested in recovering my expenses (spent on mom when she was bed ridden for almost 2 years) from the amount, if possible.
Please advise.

What documents are required for cidco mortgage noc?
I am purchasing flat in Kamothe, Navi Mumbai. I have already completed part registration with the seller for this flat. Now my bank is asking for CIDCO mortgage NOC before loan amount disbursement. Bank wont be able to make disbursement until and unless i submit CIDCO mortgage NOC.
As per broker society should provide us Form F to get mortgage NOC from Cidco and society is denying to provide Form F because as per them Form F will only be issued when the full registration is completed.
Could you please help me to find out what documents are required to get mortgage NOC from CIDCO? Is Form F need to be taken from society before approaching CIDCO?
