As per by law 34, transfer of flat to nominee on death of the owner must be done within 6 months. However what happens If nominee approaches society to transfer the flat after 6 months due to some challenges.
Require guidance as society mgmt committee has insisted that If nominee submits the document after 6 months then transfer has to be performed via registrar / legal proceeding would have to follow. Also other members who are not part of hier/but distinct relatives they too can then claim share in the property.
request to guide on the procedure of transfer of flat to nominee after 6 months of owner's death. Also insuch situation can other members who are not part of heir / but distinct relatives can they claim share in the property?

Respected sir/madam,
I live in rural area.Some political persons torchered us by given the notice of Grampanchayat that our house is in encroachment. But from succession we live on that place. Grampanchayat gave income tax receipt to fill the payment and we pay income tax regularly. Our home is legal according to Grampanchayat and Landlord property registration. For only to satisfy political agenda, they send us encroachment receipt to destruct our home in 3 days. Please give us proper guidence that what we do next? Please convey me immediately on my email. Sir/s,
(1) Is registration necessary for the indemnity bond submitted by the heirs of a tenant of a flat in Mumbai for transfer of the tenancy rights ?
(2) Are separate bonds necessary for each of the heirs or a composite bond is valid ?
I shall thank the experts for advice.

A FIR had been lodged against me by the Municipal Corporation of Navi Mumbai for refurbishing my existing house in 2017. According to NNMC , I have carried illegal construction without permission from them even though I've constructed my house in less the FSI which is permissible. They claim a Notice was sent to me which I never received nor signed & later got a call from Local Police station in July 2017 stating an FIR has been registered against me & i need to visit police station & submit photocopy of property documents to them which I did. Almost a year later last week i.e. 9th August 2018 , i received another notice from the same police station stating that they are proceeding with chargesheet submission at local court & i need to be present there with lawyer. The Police have been less cooperative & have denied to provide any additional info about the scenario. Since I'm new to this all situation, I've no idea whatsoever what is to be done next. What would be the legal procedures & what do i need to do next? Please help!

If any property after the death of grandfather distribute between in his son and daughter. After mutations his sister give haque tyag patar in favour of his brother so it consider as self acquired property or forefather property please give your opinions...
I have taken a property from govt auction 31 year back and in possesion peacfully to above proprty. We have saledeed and possession letter from the govt. But we don't have record. Now another person is claiming the part of the property in his name and has got the record. But the said property is in possesion for last 31 years. Sir/madam can you please what is legal complication. If the party (claimant) goes to court, what is chance to get back claimant property. Regards

My friend has taken a Home Loan (India Bulls, Chandigarh) from a Bank and since last 8 months he got into an extra marital affair and run away from his house leaving his wife and 1 year daughter. He is not paying EMIs since last 5 months.
His wife has filled some case for paying the expenses for them to live but the man is playing smart and not appearing in the court.
The poor girl is being threatened by the bank to vacate the house but they have not sent her any notice till date. Her name is also on the loan documents. The man is asking bank that he will pay only when they will remove the girl from the house.
Today again bank called the girl and said that are going to auction the house in next week and claiming that they sent a notice to her via speed post which she never received.
The bank also claims that they filled a case against the cancelled checks these 2 have given in Gurgaon court and the boy paid against his checks in the court.
We are not sure what is happening. The girls parents are ready to clear the loan if the property is transferred to the girl's name but the bank guy is not accepting that as well.
What can the girl do in this situation?

I have a shop premises which was inherited by me through my chachi after her death. The shop is on pagdi system since my chacha first purchased it many years back. He used to receive regular rent receipts in his name but after his death in 2007 the shop was transferred in my chachi name by the Landlord and he incorporated her name in rent receipt. Before her death in 2011, she requested the landlord to add my name in the rent receipt as she did not have any kids but the landlord discouraged her to do so and refused to add my name. Now I am holding the possession of the shop premises and I also have all the old files and papers of the shop and it has come to my knowledge by the neighboring shops that the landlord has changed but they don't know whom to pay the rent to as it seems that a group of people have purchased the land from the earlier landlord but are not disclosing as to whom to pay the rent. The reason for this is the road widening proposal which is going to be done in sometime now. I would like to know how can i transfer my chachi name in my name and whom should i approach to strengthen my holding of the shop premises ?

My aunt is having a flat in her name in a co-operative housing society in Mumbai. She wants to add her nephew's name in the flat and she has also put his name in nomination. I would like to know the procedure for that ? I would also like to know the difference between an Associate member and Joint member. I have come to know that a nominee is only a trustee of the property.
Cheating case from Vijay bank
auction conducted by vijaya bank on June 18. I paid 25% payment and balance amount is loan sanctioned, we are ready to get registration.,but problem from bank side only because they hide owner apply for DRT CASE, (before bidding)and tenent also apply for stay case from 2016. Starting they're completely avoid the information. For thst reason 3 times date of extension happened. But yesterday they told we are not ready to give the extension because this is SERFAESI Act. They are not ready to give permission for discussion with gm. Even though we try to meet gm, but that lady behaving very very roodly and she clearly told I am not interested talk with you don't waste my time like that. Before auction owner and tenant case is there but how can they call for auction. 4 to 5 times I requested to meet GM but intentionally she avoided. Actually we purchased through bank agency. That agency starting they not allowed to enter the bank because they keep the amount extra for bank officers. Finally we given the police complaint, then now we enter the bank but no use because bank officials and agency acting same .They hide everything to bidder.
What I'm do? Please suggest me pls.
We already issue a letter to bank for clearance of drt and stay case. But no reply from bank side, what to do 9th August last date over.
