In our society, one memeber is claiming that he has paid a seperate amount to Builder at the time of purchase of flat for "OPEN PARKING SPACE"...
(1)Can a Builder lawfully sell Open Parking Space like this (Not to every members, but to some members before formation of society)??
(2) Now with the increasing number of vehicles in society, can society lawfully utilise total available Open Parking Space (Including that of the member claiming his FIXED PARKING SPACE to rearrange total parking arrangement of the members??
(3)In such case, can member ask for refund of amount paid for Open parking from the builder, who is one of the members of the society??riven

My real paternal uncle, Indian Hindu, passed away in 2004 & his wife passed away month ago. They had no son or daughter. The clinic is in the name of uncle & residence is in the name of his wife. There is no nomination. My uncle had 4 brothers all are passed away. His wife survived by her mother, 2 sisters & a brother. Please let me know who are the legal heirs? Is his wife's mother-brother-sisters has any claim in the property

flat for my mother but no nomination filed.we have submited affedevit,i-bond and form 32.We all heirs given consent and signed the docs.But our hoousing society is refusing transfer the flat on my mothers name.It is demanding heirship cer from court.Is it necssary for transfer. we all heirs have no dispute at all. Nomination by joint holders & death of first holder of flat
Hi All,
We are facing a problem in our society for one flat.
That was registered in joint name of Wife as first holder & husband as second or joint holder.
They had registered nomination in the names of thieir Married daughter & A minr son with the society.
(1)Now with the death of the first holder (Wife) can the husband ask for Transfer of Flat to his Name only?
(2)What is the legal standing of their Daughter & Son?
(3) In what proportion lawfully The father, Daughter & Son claim rights on the flat in question?
(4)What can be the stand of the society with regards to transfer applcation by the Husband(Second Holder)?riven
