power of attorney

My brother resides in usa.He has a plot in guntur in which he wishes to build a house.Since he is unable to come to india,he wants to give power of attorney to me so I can take the responsibility of the construction in the plot.we want to know the procedure for giving power of attoney to me (residing in india) from my brother(residing in usa).

stamp duty

What is stamp duty and when and how muchit has to be paid? once when in a decree the property was divided n the name of one brother is entered into records in 1992 bt due to some error on the part of MC the other brothers name was not entered into records. 1st brother paid 2500/ at that time. now in 2009 the 2nd brother wants to get his name entered into records, now the MC has sent the letter to 1st brothern it says u pay the stamp duty.please solve this wht was that 2500 which was taken thn n now how the 1st brother is liable to pay

Earnest Money-Can I get it back?

I had paid the earnest money for a flat and due to some issues, I am unable to arrange the remaining sum to be paid soon. Is there a way by which I get, if not all, but some part of the earnest money back. The seller is not interested in returning the money due to issues with his own next purchase etc etc. As there is still some time remaining for the final date of paymemt... is there a way out? The earnest money is not a small amount by any means. Please help.

Redevelopment-Benefits of FSI on land owned by society

My father's society has adopted the model byelaws 2001 based on which the society members are being charged equally for all expenses incurred by the society on expenses underataken towards repairs and maintenence of land on which building is standing,compound walls,pump house,staircases,landings,open terraces etc.These are as per interpretations available in model bye laws (page 2) .The Dy Registrar has confirmed sucha treatment and hence same is being followed irespective of area occupied by each member Repairs and mantenence of building(except common areas like landings stairway,terrace )are being done on sq ft basis).
The issue now is FSI is on the land which society holds.Presently by buying TDR ,the society can develop additional area equivalent to twice the gross area less presetly occupied. If the society goes for redevelopment ,based on the byelaws and the expenses as detailed above being collected from members ,some members are of opinion that the benefits arising out of FSI should society go for redevelopment should be shared equally and not on square foot presently occupied. Is this interpretation correct? Are there any case laws or precedents in this.Pls advice

We are a a christian charitable trust based in vasai - near mumbai. An advivasi pratron has expressed his desire to donate approximately 6 acres of land belonging to him for the ministry work. Can u pls explain what are the different regulatoyy formalities needed to make this land on the minstry name .
and what are the differnt aspects that needs to be kept in mind for the usage of the land.

partition conducted by a panchayat-is it valid?

A family partition of property is conducted by the elders of the village(5 of them) and both the parties to this family arrangement have agreed and signed the partition deed and all the panch have also signed this deed. Is this deed valid in the eyes of law? Does the courts accept this partition?

Regarding Double sale of Plot

I had Purchased a plot two years back, one month back I came to know that I purchased that plot which was already sold to some one. knowing this I got cancelled my sale deed & retransfer the right to same person who sold me plot. now two days back I Came to know that he again sold that plot to some one
so what will be conseqences if that person came to know he was cheated, Can he file Civil & criminal case on him and what will be the position of mine in this, can I also become a party to this, whether i will be liable to any civil or criminal proceedings.

Need some Guidance on Gifted Property

My father was a Bank Employee. He passed away in 1995. Before he passed away he gifted a 300 yards open land to one of his relatives. My father gifted the property to a lady. She is still alive today. When the property was given to them I was a minor & I was not aware of this at all. Hoping that they will get some shelter. They have constructed a house on that Land. But today after so many years there children have turned out to be greedy. They want to sell the house as the land rates have grown in there locality. I do not want them to sell the land as it is my fathers land. If they do not listen do I have a chance to go legally & get back that property. What are my options.

This property is in Hyderabad.....
