why banks or any some companies will not give loan to advocates
If a property is put to equitable mortgage, there is no entry made in revenue record of that property. The purchaser is unknown of the fact and that cuse a great fraud some times and a serious litigation. Can a PIL or any other writ can be filed in court for mandating that there should be entry of all such matters in the revenue record as must at the time of execution?

Hi Sir,
We have purchased a property 3 years back for 6 lacks rupees.
We have taken EC certificate against that property and there were no issues.
First we paid 3 lacks as an advance amount and during registration time we paid rest of the amount. That time the owner of the property told us that Parent Document is currently with somebody and their family gave us a written statement saying they will return the parent document within a year of time. 3 weeks back some body from HDFC bank came and informed us that the purchased property under mortgage with HDFC and they have Parent document with them. We have asked our seller about this and he is not ready to make that outstanding loan amount.Now, HDFC bank ask us to vacate from this property and they said this property will come to auction soon. We are all so afraid and teased by HDFC bank and don't know what to do. Infact my father decided to get some loan against jewels and he trying make the payment which is actually outstanding against our property. My intention is, during EC request, this mortgage was not picked up. So we paid all the money infront without Parent document.
Can you please advise us on this.. What can be done with Bank or Seller. Because the outstanding amount is almost 3 lacks now..

My father and his brother share some land in India. My father died with no will in place leaving my mother and five children (4 girls and me) behind. My mother now plans on coming to India with my dad’s brother to sell the land.
I understand that us 5 children have acquired a legal right over my father’s share when he passed away. We would like to either relinquish our rights to the land so that my mother may sell it, or give her the power to transfer the land to herself.
Please tell me if the below documents are what I need to send to India with my mother so that she can do the above:
1) Father’s Death Certificate
2) Proof of ownership of land
3) Power of Attorney from us 5 children to my mother (attested by Indian Embassy in UK)
4) Deed of Relinquishment from us 5 children, witnessed by two people.
Do I need anything else?

Dear sir,
We have Gifted property of late grandfather in Maharashtra, and there are 2 brothers and 3 sisters in the family my grandfather has done the internal agreement in his presence between all five persons regarding ‘’X’’ area of open space for three sister (X=X1+X2+X3) and the balance area of the plot ”Y” is for two brothers jointly, and 3 sisters road access will be provided by the two brother. In that plot there are old 23 tenants staying in their individual houses since more that 30 years and paying rent to both brother (joint name rent receipt) , since both the brothers have mutually sub divided and done Sub Division of “Y” plot area both plots/area opposite to each other) accept access road for all five of them, On Rs. 150 bond paper internal agreement and Notary on Rs. 150 bond paper with sub division Map on the paper itself , But the matter is elder brother’s elder daughter’s custody of house has come to younger brother property part,this elder Daughter family staying since 20 years without any agreement or rent, now younger brother want to take the possession same of house but she is refusing to handover the house eventhough she has got house in his father’s property which is rented and custudy of tenent now she(elder daughter) refusing to veccant and hand over the house to her uncle (younger brother of her father)
My question is what is solution to get the possession of the house from elder brother’s daughter family without any compromise.

I understand that a partition decree has to be necessarily registered. I also understand, that it it to be presented for registration within 4 (+4) months of it becoming final. As per the Registration Act, (s. 49), a document which is to be registered, if it isn't registered, cannot affect immovable property. Under such circumstances, what is my remedy if I haven't presented a partition decree (which includes immovable property) for registration even after 8 months of it having become final?
Any advice would be welcome.

Is it allowed to use proceeds from selling a commercial property to buy a residential property?

Mr.A made a will in 1975 giving a property to his son Mr.B and passedaway in the same year.but before Mr.B could execute the will,it got misplaced.
assuming the will may be found Mr.B in the year 1995 made a will and he gave the same property to his son Mr.C.Mr.B also expired in 1998.By luck the will of Mr.A found few days back and will of Mr A and B both are there.Now as both wills are there can the property be transfered to Mr.c?
illegal Gutter in my property
Hi All,
Just wanted your experts advice for an situation i m facing.
I have an property located in ghatkopar and have been actively residing in that place from my birthplace. since place landowner is a different person and i m the paying him the land rent(pagdi system). For past one year i have been shifted to different home but still i m paying the rent for that land.
From past 2 days i have noticed the people residing in back of my property have illegally constructed an gutter for passing their bathrooms water. i have an heated argument with them and then visited the local police station for action to be taken. but it seems the police to have joined their hands(taken a bribe) with them and tell me that its fine, you can close gutter when you will renovate your structure.
The above suggestion is not acceptable as the time pass it will be extremely difficult for me to close that gutter.
Please suggest an appropriate action to be taken or preventive steps to be taken to sort this out.
