Can any share holder of an undivided unpartitioned residential house (with court stay order), sell his share to the stranger?
My father has a undivided unpartitioned residential house. He has one sixth share of this house. Other co sharer has five sixth of this property. On July, 2004, my father had gotten the stay order from the court about the sell of this undivided property , thus the co-sharer can not sell his unpartitioned five sixth of this house. But recently he (other share holder) sells his portion to the stranger without giving any notice to my father. Is that possible? What can my father do against this? And how could he stop the stranger to enjoy this undivided unpartitioned property with court stay order?

What are the eanings for IOD, CC & OC in construction work and BMC (MCGM)?
My grand father was 3 brothers. After partition he has inherited a big piece of land(in 1960-65).
He has two sons(my father and my uncle)and 1 daughter. He has also purchased a house and registered equally it in the name of three people(in 1980-83).1)my father,2)my grand mother,3)my uncle. The area of this purchased house is half of the area of the land inherited. This house is 200 mtrs away from the land inherited. After marriage of my father and uncle, my grand father built a new three floor house in half of the land inherited.Due to bad behaviour of my uncle my grand father-mother and my parents permanently shifted to newly built house(in 1990-92).From then till now we are aquiring this newly built house and the adjoining land. my grand father died in february last year.My house value is 60 lakhs and value of adjoining land is 30 lakhs(total=90 lakhs).Value of house aquired by uncle is only 45 lakhs. There was a mutual agreement that after the death of my grand pa ,my father will be given the ownership of newly built house with land and uncle will be given the ownership of purchased house. Now after death of my grand father my uncle is not ready to withdraw his rights from my father's house. He says that he wants either half of the land or 15 lkhs rupees so that both will get the property of equal value.Grand mother lives with us.we cant get my grandmother's share transferred in my father's name because my uncle will never let us do that.Se is gradually loosing her conciousness. How can i get the house registered in my father's name. Please suggest something which can be done easily. There are three four renowned lawyers in our blood relation practicing around there, thats why my father hasitate to go to them because he does not want to disclose the inside family matters to them .please help.....

Hello All,
Mr. A working with a well known Property Developer and during the employment he was provided with an accommodation in one of the companies flat in a registered Co-operative Housing Society.
However the company sacked him without assigning any mistake on his part from the job and asked A to vacate and give peaceful possession of the flat. No proper termination / relingusih letter is issued.
Mr. A is not going to the office and also not vacated and given possession of the flat. The company had sent his personnels for getting Mr. A evicted from the flat. However Mr. A being an expert asked the Developer to give a proper Notice to that effect and called upon the developer not to send any person for getting him evicted illegally without due process of law.
There is no proper written agreement / Deed between Mr. A and the developer except a writing signed by Mr. A in favour of the developer that the developer is granting the premises for residential use and Mr. A will vacate after termination of services...
Now even after expiry of Three months from the date of ORAL termination, the developer has kept mum about the falt and is not asking the possession of the premises.
However at a point of time the developer has agreed that they may sell that flat if Mr. A need to purchase. now Mr. A is financially in position to purchase the flat what remedies are available with Mr. A.
Should Mr. A vacate the flat or can he purchase the flat. Wat actions can the developer take to evict Mr. A. Mr. A is in peaceful possession and is paying Electric, Water and maintenence to the society. Please advice proper solution if required i can also meet personally for further actions....
