Hi, We have been staying in a building that is made in 1978, and we done some renovation work in our house around 20 years back, wherein we converted our kitchen in bedroom. Due to some personal reason, someone has filed a complaint in the bmc, and we have received a notice under section 53(1) to restore it to original state.. The society however has no objection to the alterations.
Wanted to know,
1) If we can regularize, the flat as it is by taking permission from BMC.
2) is there any way out of this notice, other than restore the flat to original condition...
Thanks

I purchased a flat in Hinjewadi, pune in a township project. The society was formed. In the agreement regarding parking the builder has written Exclusive car parking. After the allocation of the parking slots 180 members out of 800 were allocated tin shade parking in the compound of the society .Its an open parking with a fibre roof overhead with other sides open to rainwater and dust.Others got the stilt parking. The builder has refused to listen to the affected members. He has taken Rs.300,000/- as other charges which we believe are parking charges. We gave him options like constructing an RCC parking on Tin shade parking space or give us back Rs.300,000/- with interest. He refused.Do we have a strong legal case? If yes,how and where to file and the cost of it?
I read here that in 2012 the gujarat high court has passed a judgement allowing an agriculturist / farmer from any state in india to be able to buy agriculture land in gujarat. Can anyone please help me to get a copy of that judgement? regards

In the year 2010 I purchased a property but due to some technical problems that property get registered in my cousin brother name, till today we don't have any problem regarding the above and we are living happily together. now cousin brother telling me that I have to vacate his property because all property documents are in his name and daily we are fighting regarding this matter and recently my cousin brother try to vacate me by force and case went to police station. Now my questions are as Below:
1) Can he has a right to vacate me, I am living on this property since from 2010?
2) While at the time of property purchase full consideration has been paid by me only. Cheques issued by me to the seller has properly reflected in the sale deed, due to some technical problems I can't get registered in my name.
3) can I claim legal title of the property based on consideration paid by me.
Under such situations I need best alternative to resolve the above issue.
Thanks in advance

I am living in a government allotted (allotted to my father) house for 99 years lease, father expired in 2011. My father make 2 fixed deposit of 4,50,000/- each, one sister got full share, and other fixed deposit share by two sisters.
My father signed a will in the year 1995, in the name of me (son) which is not registered and witnessed by two friends of my father, which are expired, my father sign is there that portion is cut due to fold, i want to ask it valid will or not,
Will is in 2 pages on first page my father signed in vertical with 2 witnesses also. this will is not registered.
Now my 3 sister's are threatening me that they will put a case against me, My parents give them after marriage of all the three sister in 2009 5lakh to each sister and 5 grms of gold, and clearly mentioned that this house belong to my son and in the will he write that i have married my all three daughter's in good family and spend more than my capacity. my father has 3 houses in delhi 2 were sold at the time of 2 sisters marriages.
I have a house in Triveni Nagar, Jaipur. I have lost my original lease deed(Patta) issued by Jaipur Development Authority. As soon as I lost the same, I logged FIR in related thana and published in two leading news paper of Rajasthan for return paper if any body found it. I also got a duplicate copy of the same from Registrar Jaipur. However when I tried to sold my house the Buyer contacted the bank but the banks denied to sanction loan against my house with the reason that there is no original lease deed(patta). Please help me that how can he get loan without original lease deed(patta).
Sir
My Grandfather A has a Son B and a daughter C.
After the death of my grandfather 'A' in 1974, the patta of his self acquired land got mutated into his son(my uncle) name.We donno how the revenue officials mutated into his name alone omitting the legal heir Daugther C.Till now it's in his name.
My mother C used to cultivate in land now and then until her demise.
I'm the son of C planning to suit for partiton.Do my Uncle B claims the land as his adverse possesion?
Do adverse possesion is applicable in undivided joint family property?
The title document is in name of my Grandfather. We haven't made any partition with uncle family. My mother didnt gave any release deed in property to her brother.Revenue record got mutated 40years before.
Kindly clarify my issue.
Property distribution between son and daughter
My father in law has got 2 children. His son, who has got his own family (staying with him); and my wife who stays in Bangalore with me. He and his wife are leading a retired life in Pune. The relationship between us is very homely and they keep visiting us every now and then. Whereas, their relationship with their son and his family is not all that smooth, despite they staying together in the same house. He owns an apartment in Pune where he lives right now. Every now and then he keeps talking about giving out his property to his son, probably he has got a grandson there, despite his not so comfortable relationship with his son and family. While we have never spoken to him on the property distribution, but want to understand, what does the law say about the property distribution for a son and daughter? Legally, can my wife claim her share in her father's property? If yes, what are the ways to claim if it the will has already been created for the son.
Please advise.
