DC Converted site

Dear Experts,
One of my friends had purchased site DC converted from a developer in Bangalore electronic City during 2003. He is constructed house in 2004 and now he wanted to sale this property. When the buyer approached bank with property details bank has asked family tree of the original seller who sold property to my friend.
The Issue now is : Original Seller(Jagan) of the land is still alive but he is not sharing family tree with my friend.
Another point my friend heard that Jagan got 2 sons they were attained 18 years during 2003 but there is no consent letter from his son when it is sold to my friend.
Request your help on this issue: Can the Jagan sons put claim on this property? If yes how the court can fix claim ? Is there any time limit for such claim?
What precaution my friend can take?
Please help.

Partition deed

I am a married women married in the year 1974. My father died last year. Before his death, my brother and my father's brother have entered into a partition deed dividing the property ( 80 cents of land)belonging to my grand father and registered the same and constructed individual house for their occupation. This is a illegal partition deed as my father has not given any written acceptance to my brother. As my father is no more can I have to the right over the property and sue my brother? Is there any other way left to treat the registed deed as null and void under transfer of property act.

PROPERTY TRANSFER

MY GRAND FATHER PURCHASE LAND IN 1978 WITH HIS BROTHER. MY GRAND FATHER HAS THREE SONS AND ONE DAUGHTER. AND MY GRAND FATHER'S BROTHER HAVE NO ONE AS HE NOT MARRIED. MY GRAND FATHER'S BROTHER PASSED AWAY IN 2003 AND MY GRAND FATHER PASSED AWAY IN 2007. MY AUNT GIVEN IN WRITING THAT SHE DON'T WANT ANYTHING FROM PRPOERTY. MY ONE UNCLE SOLD HIS PART OF LAND WHEN MY GRAND FATHER WAS ALIVE. MY ANOTHER UNCLE IS MISSING FROM JUNE 2006. NOW WE WANT TO ADD OUR NAMES TO LAND 7/12 REPORT. PLEASE ADVISE ME IN THIS REGARD

Transfer of property from late father to my mother.How?

Hi,
My late father has a home in in name which needs to be transferred to my mother name. What is the procedure to transfer it to my mother name and also how to know if ever he has created a will or not?

Purchase of property

I am interested in purchasing a property situated in Dharwad city of Karnataka. The property has been transferred from father to one of his son by submitting a application on Rs 20 bond paper (relinquishing of right over property in favour of son)in the office of tahshildar. The tahsildar has mutated the RTC (record of rights) and the latest RTC shows the name of son. But no deed was registered in the sub registrar office. Is the property transfer legally valid. Does tahsildar has powers to change the name in RTC on basis of a unregistered document. Who is the legal owner of the property. Can the son execute the sale deed in my favour with father as witness. Or both father and son jointly as sellers can execute a deed in my favour. Which is a legally correct way

Pagdi System Laws

My mother stays in a Pagdi system room. She stays there for a few days and stays in my flat for a few days. When she stays with me, her pagi system room is closed and unoccupied. The landlord for that pagdi system room is not accepting rent stating that her room is closed and he wants her to sell the room.

One of our neighbours had a similar situation and our landlord took his room away through court.

Please let me know what are the laws related to this and how do I protect my mother's room being taken over by landlord.

Query regarding property

I booked 2 flats in Imperia Residency in Greater Noida. One with Down Payment Plan and the other with Construction Linked Plan. Whereas the returns for the down payment plan started in September 2010 when 90% payment was made, when I wanted to convert the other flat into a Down Payment Plan in April , company is telling me that flats are overbooked and that they can't give me a flat. For the second flat, I just have a receipt for 20% payment that I had made for my flat.

Please help me out in this case. What is the legally correct action that I need to take in such a case?

Society Sites formed in area reserved for park

Hi Experts,

My friend has purchased a site from a allote of Govt. employees Society which turned out to be earlier earmarked for park.
Details as hereunder;
1) Society purchased & converted land in 2003.
2)Alloted the site in 2003 and thereafter the sale deed in 2008 to the original & got B-katha in his name.
3)My friend purchased the site in Jan-11 & also got the katha in his name.

Now he has come to gather that the space was initially reserved for park, but subsequently sites were made out & alternate space provided for the park.

Pls advice will my friends title with respect to the property be affected due to the above confusion of park area.

WILL Validity

I am a Hindu Married Lady with a husband and 2 children and am settled in New Delhi. I have a brother and a sister. My Father expired last year while at Meerut, UP. He had left a WILL with an Intent to transfer one property (House in Merut) in my name, and the second property was a Joint property in My Fathers and Brothers name. There is 3rd property which is in the name of my Mother and is willed in my Sisters name. All the properties are in Merut / Ghaziabad (UP). The properties may be of different values.

In the WILL my father has also mentioned that in case if he expires before his wife and that all the property should be passed on to his wife.

The will is not registered.

How do I ensure that the property is safe from my Brother, what steps should I take ? I may like to mention that My Mother has a leaning towards the Son.
