sir i have 2 children and my divorce case is going on . i married in 1997 . i come to know that daughters have right in father property . i am private lecturer and my husband is working in ltd company . and my father is having land and house and not giving anything from his share. so what is my share in in laws and my father property

building plan gone from municipality

as a co owner of a building i have asked for the permission letter for the illegal construction going on in my building ,which the authorities cannot provide .Now i find out that the original drawing of the building is also not traceable and i think this is a co effort of the officials and the part owner who i think are trying to change the plan....i would request honorable members to advice me what can i do?

Sale of Devasthan Land

Hi,

I am a member of Hindu Undivided Family and have some queries related to the sale of Devasthan land Near Satara, Maharashtra as marked below;

1. The sisters have married before 1980 are they eligible as beneficiary in the sale proceeds.

2. Are the children of deceased sisters eligible for any benefits under the sale proceeds.

3. The tillers have not tilled land for last 40 Years. How can their names be removed from land records.

cooperative housing society in UP.

I live in a housing complex of 408 flats in kanpur.
The flats are 1,2,3,and 4 bed room apartments within the same complx which has a huge open area with huge lawns and play area which is used by all residents irrespective of area of flat.

The builders are charging maintenance @ of area of the flat and so the bigger flat owners have to pay more each time whereas the smaller ones are enjoying the same faciities inside the complex for a petty sum.
We have also quoted a judgement reported in 2003(3)AII.M.R.2003(8)LJSOFT 113 in the High Court of Bombay Writ petition no.1948 /1997. judgement 30.7.02 (R.J.Kochar,J)

The case inabove is the same as with us but people say that this case was from maharashtra so it would not apply here in UP.

Please advise us what we can do on this to get the builders to charge all residents per unit and not as per area of the flat as al services are being availed outside the flat and none of the services are availed inside the flat area.

Rghts of a tenant in Pagri bunglow

Respected Sir/Madam

I am a tenant in a pagri bunglow which is approximately 80 years old structue, so the condition of the said bunglow is nt well or can b called as dilapidated. now beacuse of some disputes between the Landlord & couple of developers The Court Receiver has been appointed for the property, we pay the rent regularly to the court receiver.
Now as per my knowledge tenants are not suppose to move/repair/modify the structure under court receiver , so my query is if because of any Natural or Unnatural reasons the Structure collapse or comedown, as a tenant what are the options available for me to protect my rights, & howmuch The court receiver is accountable in such circumstances?? Can I get the permission from The Court Receiver to atleast repair the premises under my possession?

Transfer of Property

Hi all, I have a query related to transfer of property.

My freind has a house which is in her spouse and her father's name. Now, she wants the property to be transferred to her name or her spouse's name completely. What is the procedure and cost involved in this? Or can it be transferred to her name as a gift vide a gift deed? Are there any other consequences if the property is transferred in the form of a gift? Kindly suggest.

Judgment Required

There is a registered housing society. At ground floor of the society, there is a flat which is presently owned and used by the builder as his office. The builder is paying municipal taxes as per commercial rate. Now the builder is selling the said flat cum office to a homeopathy doctor who want to open his / her polyclinic and consultation office in the said premises.

Can he / she do so?

can he / she open his / her polyclinic at the said premises?

Society is not giving NOC for the registration of the said premises?

is there is any citation of the Hon'ble Supreme Court or any Hon'ble High Court, please provide the same, so that he / she submit to the society and clear rest of the formalities.

approved building plan of building

i had purchased a resale flat in kharghar ,navi mumbai. The society is already formed. I want to apply for SBI home loan. Bank needs building plan copy approved by municipal authority of the building. The society says it didnot received from the builder. Can i get the approved building plan from builder. Will builder charge me for that?

can a will for property to be avilable if case pending in probate court be won as legal heir is vali

if someone made a will for a property for whcih she is contesting in probet court,as legal hear of her deceded brother ,that if she won the case then the propetry of her part be distrubuted as per her will,is it a valid will.
Now she died and the courtcase is still pending, what is the legal effect of the will. can any benificery in this will can file caveat or other proceiding in the court based on this will.

Entitlement of claim by sister

My cousin & his family stays in his deceased parent's property since birth.His Parents expired in 2009.His sister is married in 1989 & is settled & has her own property.Pursuant to the incorporation of the Hindu Succession Act,2005 as amended,can his sister claim her rights on the property if so what part of the value in Rupees as their son is the only son who is occupying the said property since birth & does not have any other property. He & his family donot want to vacate the premises.If she is not entitled for the claim on the property under which section or sub section is my cousin benefitted.Or, is there any judgement befitting the stance.Pl help in quoting the relevant section or section/subsection.

What is the criteria, date of marriage
of daughter or death of parents.
