Gift Deed to Mother from Son and Daughter-in-law

I have a Flat in Bangalore and my wife and I are the co-owners. We would like to gift our property to my mother. No where we have mentioned the explicit share of the property (I assume it would be 50%-50% in this case).
What is the easiest and cheaper way to transfer the property
1) Can my Spouse transfer the property to me first (Register the Gift Deed) and then I transfer the property to my Mother?
2) My mother is not a Tax assessee. She has a PAN card. Any income(rent) arising of this property will be treated as her income or mine? She will be filing her own IT-Returns.
3) Is there any tax applicable?

Sister and brother have joint rights in a residencial house.Both were livining in same house with their familie's.Illegaly brother take possesion from his sister.Now my quastion Under Limitation Act,How much time ,sister take possesion back from brother.

difference between sale agreement and salling the propertly

one of my relatives has got some bit of property written on sale agreement in the year 2000 from his father and on his sons wife name now it is 2011 will this agreement work? if the written person has expired and the property owner has expired not registering or transferring the property how to go about, as such it was mutual agreement and there was two lakh rupees given to the owner

Joint family

Dear Members,

I am resident of Bihar. My father was the Karta of the joint family. After father’s death (mother is at the age of more than 80 yrs) my elder brother (retired form Army) is taking care of all properties and business as Karta. My 2nd brother died in 1991, left two sons (20yrs & 27 years) and two daughters (21 yrs unmarried & 32 yrs married). I retired from Indian Air Force in 2009. I have two sons (30 yrs & 26 yrs) and only unmarried daughter of 25 yrs. Elder brother have two sons (40yrs & 45 yrs) and two daughters (42 yrs married & 43 yrs married).

After retirement I want to settle down in my native. But when I came to native surprised to know that my elder brother along with his sons fraudulently transferred almost all the property especially in the name of his sons. Now they are telling that you have very little share. They don’t want to give share in residence.

As a fact before retirement we always visit the native but as faith never inquired the things. At this stage I am in great strain. Whatever they have acquired, acquired form joint family property only. In boosting the family 2nd brother play key role today his & my families are suffering and elder brother’s families’ members are enjoying.

Know please suggest how can the partition will be done even my mother is living?

As they are now very dominating so how can I proceed for partition? Other than partition no solution is there.

partnership firm having 9 partners.firm build a commercial complex, when the partnership firm disolved, then property is transfer of all each partners, so what is the stamp duty rate?

Indemnity Bond & Deposit of 10,000 demanded by housing society for permission to rent flat.

Dear Sirs,
I have a 2BHK flat in a cooperative housing society in Pune. I have been giving this on leave & licence since 2007. Till now, the society has been charging me 10% of maintenance dues as fixed by the Supreme Court. Now the society has demanded that every flat owner renting out his/her flat must furnish an indemnity bond claiming full responsibility for any damage caused by the tenant, and has also demanded an interest free security deposit of Rs 10,000/-. I find this unfair and unreasonable. I have had three tenants so far, and I have taken great effort in screening and interviewing each one, and making sure that they are well educated, professional, law abiding citizens with decent families. I have paid all my dues well in advance. There has been not a single instance of nuisance or inconvenience to the society from me or my tenants. I need advice on whether these demands are valid, and if I should agree to furnishing this bond and paying the deposit.

valuation of the property


Dear sir
My mother is likely to acquire two row houses through sucession of his brother since he expired on april. The query is to understand the valuation since we had paid some money as a bond in the court proceeding based on the paper value in which it was originally
purchased on 1996 thinking that my mother who is the only sister with blood relation and my uncle being unmarried when he expired and she will be acquiring this as a gift.
But now we had got a letter from the collector office in chennai stating that they will be visiting to confirm the value mentioned .\
pl give your expert advice if my mother is to acquire the property through gift is it that we have to revalue it as per present value and its locality and pay the defecit amount or what we had initially paid as a bond based on the purchased document is correct pl reply
