Purchase of Agriculture Land

Dear Sir,

Is there any limit on Purchase of Agriculture Land by an

1) Individual (Under IT Act, 1961)
2) Company (Companies Act, 1956)
3) LPP (Limited Liability Partnership)

Seek your guidance, if there any restrictions under any act, please be elaborate what are the restrictions?

Also please tell what is BT and AL Act 1948 is all about?

Giving road by side of house for vehicle

I have a house in village ( Wai- Sarata Maharastra)

The front and side of the house has a open space. HOwever as the villages wanted the vehicle road to go ahead to their respective houses hence they asked us a road besides our house. Hence we gave them without much debate.

HOwever the front open space, is now being demanded by my uncle for moving his vehicle into his plot which i have rejected and only offered him a pathway and not a vehicle road as he can use the vehicle road provided by me to villagers to go into his plot. HOwever the villagers ( panchayat) is now ruling in favor of my uncle stating that it is compulsory for me to provide vehicle road in side as well as front of my house or they wont let my vehicle enter into the village.

Kindly guide me the legal standing which i could sort for.

SECTION-8 OF HSA 1956

Respected Experts , Some of the Experts from LAWYERS CLUB INDIA says that “ the self acquired property of father inherited by his son after the death of father will be his exclusive property as per Section-8 of HSA 1956 and it will be not his ancestral property and the son has the liberty to gift it to anybody he wants. Since it is not an ancestral property, the provisions of HSA (Amendment) Act, 2005 will have no application at all to the matter.�
I wants the Experts comments on this matter please.

Stamp duty

just wanted to gain some knowledge on this issue..If a flat is resold 4 times and out of the 4 owners consider A,B,C and D three have paid stamp duty for the property properly but the owner C while getting the property from B defaulted/skipped in payment of the stamp duty..now the final owner of the property is D.. Is he free from all Encumbrances and is the title of the property clear if this default does not come to the light??

Lapse of agreement period

Hi Experts,

My friend entered into an agreement to purchase a site in Dec-10, with 3 months time frame for compeletion of sale transactions.(He has paid 30% of the amount in advance).
In furthance of the agreement he has purchased the back-side portion of the subject site and Khata is already transfered in his name.
Now the seller of subject site wants 20% extra money citing lapse of 3 mons time frame despite the following conditions not fulfilled.

1) Portion of site is being used a passage, owner was supposed to compound the property.
2) There is an electric pole in the property & it was agreed to be removed(Not mentioned in agreement-Verbally).

Request your advise, since the seller was seeking time and is not refusing to register the property without the 20% extra amount.

Right of a tenant in trust property

Learned Counsels,

House was owned by a trust and it was let out to a worker of the trust in exchange of his services to the trust. The worker lived in that house for more than 30 years by being employed in the trust without paying any amount as rent for the accomodation.

In all these 30 years the trust didnot maintain the house which forced the worker to make improvements and renovations on his own. Is there any right accrued for this worker towards the ownership or title on the house property.

What law is applicable in such cases.

Please clarify.

Stamp duty

Just wanted someone to throw some light on this issue... Just consider a flat which has defaulted in payment of stamp-duty and which has now been demolished for the purpose of Redevelopment..Is Stamp duty for the said flat recoverable with penalty from the owner of the said flat after the demolition..

suddent increase in house rent by landlords

Hello Experts

I live in Hyderabad VijayNagarColony, I stay in very old Apartment as a TENENT . We shifted in this Flat in the November 2009. With house rent of Rs. 6500/- + maintenance of Rs. 600/- . This is a 3BHK flat but the Owner has lentout only 2BHK as one room was kept by the owner as his storeroom and this room has been locked since more than a year. The landland lord( I mean owner of the flat) after a year (i.e,NOV 2010) called us and said that he wants to increase the rent for Rs. 500/- then we said to him that there is no problem for us to increase the rent but we that another room also which he has kept as store room. Then he said he would vacate in 1 or 2 months and would give us the possession.
And he has vacate that room in last week of MAY 2011. And now the JUNE month has started now he says that he would increase the rent to Rs. 9000/-. After negotiating he said he can give it to last Rs. 8000/- or asking us to vacate the house. We said the owner that we can pay only 7500/- to him for this he is not agreeing. I would like to bring to you notice that there are around 50 flats in this apartments. And no one charging this much rent. All the flats are with 5500/- to 6500/-

And I want to inform you that We have not made any rental agreement and initially we have given 2months advance to the owner and every month we used to deposit the amount in his bank account. We have the deposit slip acknowledgement.

Sir, Please help us as we cannot suddenly vacate the house as the owner is saying that he will give the advance to us which we have given to him & asking us to vacate. Is there any law to restrict the owner for the sudden increase in rent . We paying the rent promptly before due date. Please help us..
