sir,
I reside in kolkata.I have a two storied building of which I am selling the entire ground floor. As per my knowledge, that buyer can use the roof for common purpose such as maintenance of water tank, water pipes etc, but I will be having the sole right on the roof including new construction in future. But ,yesterday lawyer from buyer's side told me that as I am selling the ground floor, I won't be having sole right on the roof after the sell and both (me & buyer) of us will be having proportionate right on the roof.I want to know which one is correct in this present context?after sell will I loose my right on roof or I will have sole right on roof for construction?
Urgent help is needed? Thanks in advance.

Dear Experts,
I have piece of property consist of two houses given by my grand father to two poor families 50 years ago with out any kind of registry or notary.
After 30-35 years, for the sake of money those family gave the possession of the property to others and left the place forever. They did some kind of notary or registry in favor of 3 new parties for the same property illegally, though they are not actual owner of the property.
We want to get back our property and I have following questions related it.
1) What all documents we need to proof ownership of the property in court
2) What type of case we should file in court?
3) Which law section is best for filing this case?
Kindly help provide your expert opinion.
Thank you so much for all help!

Hi, I bought a resale flat in Pune in Aug 2011. The maintenance dues of 40K have been paid for 3 yrs by 1st owner
and posession was given in Sept 2009. The flat was vacant till April 2011. The agreement between first owner and
builder clearly states that the amount is for 3 yrs and he will revise the amount based on inflation after 3 yrs
have been completed. The builder is claiming he has exhausted the amount and demanding Rs 3000/- per month.
Construction is still on for 6 more buildings located in same premises. Society has not been formed and builder is
refusing to form until construction is over. I have few questions based on this situation:
1. Is the agreement between 1st owner and builder still binding on the builder considering I am 2nd owner?
2. Isnt the builder responsible for maintenance till he has finished and formed society?
3. He has started using maintenance money from Day 1. My understanding is that he needs to safegaurd it and
handover when society is formed. Is this correct?
4. My flat has been occupied for just 8 months. Does Sept 2012 deadline apply to me? Can this date be extended
based on occupation date?
5. He is threatening to stop water supply. Can he do it?
6. What should I do? Pay him or wait till 2012 or beyond?
7. What action can I take against him based on your answers for 1 to 6?

Dear Sir,
My father and his two brothers living in Panipat in our agriculture land. This property was actually on my grandfathers name, who expired long back, when my father was a kid. the land then was in the name of my fathers elder brother.few years back my fathers elder brother sold a part of land and gave part money to my father and part money to my younger uncle to purchase lands in their own names and my father purchased 10 acres in his name.
Now my self, I am 38 years male. I did love marriage in 1992 and started staying seperately because my father got angry with me due to this marriage, but I was in connection with my elder sister and elder brother. my brother got expired in 2003. and my mother got expired in 2007.when my brother got expired, I came house and stayed for abt 10 days, but still my father didnt spoke to me.Now after 18 years I came back to my home town and still living seperate with my family.I went home to meet my father, bjut he was still in the same mood.
Now I want my share of the property. Is it possible to get the same?my father will not be easily ready for this, so can I put a application in the lower court and take stay on this agriculture land until I get my share?
Or I can send a notice to my father thru an advocate?
Please advise me in details, so I can move accrordingly.

Illegal agreement
Dear Sir,
The property where we are residing now it was purchased by my grandfather. My grandfather died on last july. My fathers are two brothers and three sisters. And after the death they have not done the mutual partition yet.
Now the problem is that before my grand father’s death and one of my uncle become a legaliear and successor, he made an agreement with a outsider on Rs10.00 court paper saying that he will sale that entire property to that said outsider where the whole property is not belongs my said uncle, after grandfather death he became the owner of only 2 cottah’s land among the entire property.
Now my queries are:
a) Can we ignore that “agreement”?
b) How do we ignore that “agreement” through any legal process or saying that we don’t accept that “illegal agreement”?
c) That outsider can take any legal action (fraud/420 case saying that without being a he made agreement) against my uncle and us or not?
Please advice.
Thanking you
