Greetings,
First of all thanks for providing this type of platform & Service.
My question is with reference to Apartment Act in Maharashtra,
Facts:
1. I am the Apartment Owner. In Our building, there are @60 flats (36 nos - 2BHK and 18 nos -3BHK and 4 nos Penta-houses).
2. Currently our Committee is charging the same Maintenance cost to each Apartment owners.
3. Sinking fund is as per Sq.Ft. which had been come through the one time Maintenance charges collected in early stage.
4. Also, Committee is asking same Painting fund which is not from sinking fund from each apartment owner.
Considering these facts I believe this is not convincing that each Apartment (i.e. flat) owner should bear the same Maintenance Amount and same Painting fund.
Please advice how it should be as per law and Apartment acts in Maharashtra.
If all mentioned facts are not as per regulations, then how should I approach for the remedy step by step?
Awaiting Reply
Thanks

I purchased one flat and one shop in my wife's name in 2001. I paid all consideration for both properties. Now I want to transfer these properties in my name without paying any stamp duty. Is it possible and how ? Please advise also whether if irrevocable power of attorney will be as good as transfer or sale deed.

My maternal grandfather died in 1988(at Alibag - Maharashtra). He had 8 children (5sons plus 3 daughters). I am his daughters son (who is predeceased in 1996). He had three ancestral properties. Out of which one property was sold in 1993 and all got equal share. Now all the three daughters are deceased. There are two children each to daughters of grandfather who now are heirs.
There was no informal or registered partition or court decree that had happened till date. Now the two balance properties are to be sold. What would be the rightful share of pre deceased daughters children? Will the amended hindu succession (2005)law apply? When a hindu coparcener dies what are rights of daughters in such a case? My maternal uncles are saying that you as pre deceased daughters son shall get only 1/96 share. They say that since grandfather dies on 1988 succession opened that time and property will be divided in six parts now - 5 parts of sons and one part of grand father. In the part of grand father now there will be again 8 parts and daughters children shall receive one part each which would have belonged to daughters if they would have been alive.
I feel this is incorrect and need advise as four of my maternal uncles have never taken care of my grandparents and my grand father died in Alibag court fighting cases against my maternal uncles. One maternal uncle was saner and took care of my grand parents whom we will adore till our death.
Please advise as different lawyers are giving different opinions.
Quick and precise advise shall help us to fight injustice (if any found).

The Chairman & Secretatry has signed on the Share Certificate as transfer in the name of Purchaser without execution of prescribed forms.
After six months, When, I approached the Society that there are certain documents / forms should have been executed for transfer of Share Certificate, they told me we could complete these formalities now. However, the Seller has left the town and we do not have his whereabouts. Therefore, can we execute such documents without the signature of seller and instead could attach the Registered Sale Deed.
Please suggest
Probate
My father expired in 2005. He has made a "WILL" in my favour. I have received "PROBATE" from competent court. What are the papers required to be submitted to Society for transferring the flat in my name? Does it require to be paid Stamp Duty/Registration?
