Brokerage for rental residential property.

Dear Sirs,

I am a small Real Estate Agent working in Mumbai. Six months back one person (with his family) has approached me for a 2 BHK Flat on a rental basis for a period of two years. I have found the same and he agrees with the same and the with all the terms, including the terms of my brokergae. A point of my brokerage has also mentioned in the agreement. The agreement has alredy enteded in to between him and the owner of the flat 4 months back and the same has been registered with the registering authority. Even after lapse of 4 months of completion of agreement and his shifting in to a new rented flat, the licensee is now refusing to pay an amount of brokerage to me as decided earlier and also a mentioned in the agreement.

Sir, please tell me what remedy is available to me for the recovery of my brokerage. Should I lodge a police complaint or send a legal notice to him? I have a copy of agreement with me.

Please advise.

Thanking you.

Property dispute between 2 brothers families when one brother is missing

Hi,

My father and uncle have few joint properties .His family wants their share of properties to which ideally we dont have an issue. The issue is that my uncle is missing for last 4 years and its his signatures on the property registration documents. As per the internal agreement there should be some properties that my father should transfer and some whihc should then be transferred in my father;s name. Since my uncle is missing, in his absence if his family transfers the property in my father's name, will that be acceptable ? I mean if his family wanted to challenge us again after his 7 years ( law in case of missing people),can they do that ? is it safe for us to transfer properties in my uncle's families names without having the risk of being challenged again?

Please advise.

Grandson's right over's grandfather's property

My Grandfather owned a property on his name which was partitioned after his death among 2 sons my father and uncle (During that time my Grandmother was alive).
My father has 2 sons including me,I want to take some cash credit loan by keeping my share (1/3) as mortgage (collateral security).
Property is on name of my father which he got after partition.

Can this be a ancestral property for grandson (me- mature adult of 36 yrs)?
Do I have same right as in case of ancestral property?
Can I pledge my share without partition to bank as security?
Please guide as I have to live my whole life with family and I need money for my business.

Seeking advise on a registration matter

Dear Sir,

My sister got married in 2005. My mother has made gift Registration of a land of 400 sq. yards on the name of my sister at the time of marriage and has given the Registration documents to my brother-in-law. Later, due to some disturbances, my brother-in-law left my sister at my mother and did not turn up for almost one year but retained the Land documents with him.

We asked him to handover the land documents but he did not. So, my mother cancelled the land registration in 2007 with the acceptance of my sister as property is still on my sister's name. My brother-in-law does not aware about this. After a lapse of 6 months time, my brother-in-law realised his mistake and taken my sister with him and now they are living together.

So, my mother want to handover the land property to my brother-in-law again. If we tell about the cancellation of Registration to my brother-in-law now, it may lead to further problems. Hence, you are requested to clarify us whether there is any provision to cancell the above Cancellation document (done in 2007) and utilise the Original Registration documents (of 2005) retained by my brother-in-law (or) we have to go for fresh Registration of Land ?

Hoping for an early reply,

Yours' sincerely,
Venkat Diwakar

Whether notarized agreement for sale of immovable property is valid

Good Morning to all experts

My query is :

(1)Whether A notarized Agreement for sale is valid in Gujarat.
(2) Can a Bank disburse the loan on Notarized Agreement for sale between a prospective purchaser and Builder/Owner/Developer wherein the property in question i.e flat is under construction.
(3)If yes what are the precautions that Bank should take and what are the documents that Bank needs to execute as security when the agreement for sale is notarised only.

(4) What are the subsequent documents that needs to be executed between a purchaser and owner/develooper if bank advances loan on notarised agreement for sale of flat that is under construction in order the protect the interest of the Bank.

(5) What are the document that Bank should take from the Borrower and from the Land owner/Developer in order to protect its interest. i.e Bank. Documents can be substantial documents for enforcement in case of default from the borrower/developer
