Pagadi system

Dear Sir,

I stay in Jogeshwari - Mumbai since last 3 years under a pagdi system room (chawl). In October 2011, i have renovated the house and increased the vertical height to around 14 feet ( applicable as per BMC - Mumbai law).

However, the pagadi owner is demanding the money in cash from us as a compensation for increasing the vertical wall of the home and not seeking ihs permission.

Further, there are aroung 20 rooms in our chawl and 50 % residents have increased the vertical wall in the past and the pagadi owner has never demanded any amount from them .

Further, the pagadi owner has complained the local policy station and the poice suggested to pay him the amount without any written consent. We paid him, Rs.2,000/- partly and still he is demanding Rs.3000 from us so that he would not complaint to BMC and destroy the renovated property.

I would like to know what can be done to resolve the issue as the pagdi owner is behind us for the money and is not demanding any funds from others who have increased the vertical wall limit in past.

Partnership

A, B, C, D and E are joint owners of land in Gujarat. A partnership firm is created in the year 2009 by the aforesaid owners with F, G, H, I & J the partnership is formed having nature of business of development of land and construction of units. A, B, C, D & E brings the land jointly owned by them in partnership and F, G, H, I & J bring capital for construction of units i.e residential and shops.
Now my query is as follows :
(1) Can A, B, C, D and E bring their jointly owned property in partnership firm. IF yes then how and if no why. Can a joint property be brought in partnership firm without any document.
(2) What is the stamp duty applicable in this case of partnership deed
(3) If units are constructed on this land than who will execute the agreement for sale and sale deed of these units.
(4) Can any of these partners authorise any one of them to execute the deeds and documents of the units. If yes then how.
(5) Suppose A, B, C, D, and E only form a partnership firm and bring the land jointly owned by them in the partnership firm and then sale the land as partners of the partnership firm. Is it a valid sale.
(6) Whether any development agreement is required to be executed between them.

Lapse in registeration of sales deed

I signed a sale deed with a seller 2 years ago. Hoever, due to a fault on my part the property failed to be registered.

I have now resolved my issue and am ready to register the property. However, the seller is now stating that she will only register the property if I pay a further amount to reflect today's market value.

In the last 2 years property prices have increased 5 fold in the area - as reflected my recent nearby sales. The seller argues that if I sold the property after registeration, I would aquire this amount or more.

Since the sales deed, I have been living at the property but all taxes have been paid by the seller.

1. What legal basis does the seller have to request more money to register?
2. Is my 2 year old sale deed now void? Will I need to draw up a new sales deed before I can proceed at origianl or new price?
3. How should I respond?

With kind regards.

Building constructed by the muncipal corporation

Hi Sir,
The muncipal corporation of my town has constructed a marriage hall on my land. As I stay away from my home town due to my work, I came to know about it after one of the person who was willing to buy it went to have a look at the property. He told me about the construction. The construction by the munciapl corpoartion has not yet completed, and is not yet ready to use, howevr, the concrete structure has been erected. Could you please tell me what all steps should I take? I would also like to inform you that, if I agree on a compromise I will get the government rate of 180000 Rs, from the Muncipal corporation. However, the property is at a prime location and if I sell it to someone else, I would get close to 300000 Rs.
Please assist.
Thanks

Waiting eagerly for your reply.
