Gair marusi

Dear Sir,
There is some land and a house in himachal which is mentioned as gair marusi in Revenue Office (Patwar Khana) in the name of my Grand Father Late Mr. A.

Also, names of my father and my two uncles as sons of Late. Mr. A is mentioned in the record of patwar khana.

Now my father is no more and one of my uncle has build shops on the land which is on the road head of National Highway and not giving my share with the statement that it is gair marusi and not by the name of Grand father. I am given only the house which is at the back side of shops where my grandfather and myfather (with our family) used to live. As house was not in a condition to live in, I demolished it and reconstructed by investing my own money.

And the new Electricity, water and Sewerage Connections of new house is by my name only.

House is in Khasra No. X and Piece of land (Where shops are build along with some unbuilt area) is in Khasra No. Y.

Sir, please guide me if a land is gair marusi, will it be divided among three sons of my Grand father equally by law or here might is right is the only case.

Can I claim my share in shops which my uncle build in my absence being working out of himachal.

There is still a piece of land beside shops which is still not constructed and I am told by uncle that even this piece of land will not be given to me.

Can I apply for stay order if he tries to do construction on this piece of land, though my name is not in the record of patwar khana but my father's name is there.

Regards

Hindu succession act.

A father holding Restricted tenyor (43-c)Agriculture land as inheritance property having 4 sons and 4 daughter. But in the rights of record there is only one name of the father. Father has taken written in presence of notary from sons & daughter that there is no rights of ownership in the property & what so ever is left in favor of father without any consideration & now father trying to sell the property.

Children have entered a civil suit in court but later they have withdrawn with out any obligation.

Is there any more rights of children in the inheritance property?

Purchase of flat in building constructed on gaothan/gharpatti plot

Dear Sir/Mam, I have booked a 3 BHK flat in a multistory under construction building by UNI Constructions "PALM RESIDENCY" at Koliwada, Sector 16, Nerul (West) Navi Mumbai. The builder/developer is advertising the construction to be on gaothan plot and has clearly told that no nationalised bank will sanction loan for this flat but he will arrange the loan from cooperative society at .25% heigher than market rate to which I have agreed and have already paid a sum of Rs 2,00,000/= as booking amount on 25 Dec 11. Now I came to know that if the constructoin doesn't qualify for loan from a nationalised bank there seems to be problem of title. However, the builder says that it belongs to a farmer and he is developing it for him at 50-50 share basis means ownership of half the flats in building will be that of builder and remaining 50% to the builder. In such a situation what are the complications I am likely to face as occupant/owner of one flat? and how can I avoid them. Please treat me as having almost nill knowledge about the subject and advise. Regards

Right on path left in commonproperty

ancestral house site was partioned by two brothers(1995). as Eastern wing and Westeren wing both having North highway.
eastern wing onits east has an exclusive commonpath of 9ft widthleft by ancestors during 1912 partionon. North frontage is 42ft , North to south depth is 168ft for each brother .Eastrn wing has to dispose the property in 1997 to tide over his commitments .but buyers want the entire frontage 42+42on North as frontage to buy .so east brother requested west brother for parting with north west bit inlieu , east brother willgive his south east bit to west brother . that is to say the 1995 partion has been redone as north bwing and south wing for marketability .West brother agrred with acondition , east has to leave anew another 4.5ft width corridor adding to existing 9ft path.he did so .
Now in 2012 , the North property insale ,original East brother purchased .
now he is blocking the 4.5 path claiming it originally belongs to him .West brother is objecting for it . What can be the just position?
