Building permission for a plot sold in 2 parts after construction

Hi,

I am buying a property in Bhopal (MP) which was a part of 2400sq ft plot which the earlier owner has sold to a builder. The builder constructed 2 portion of 1300st ft and 1100sq ft and sold to 2 parties. He got only one building permission for the complete 2400st ft plot.

Now I am buying the property from one of the party the builder sold the 1300sq st constructed part.

I applied in SBI for home loan and they rejected the application stating that there should be a separate building permission for 1300sq ft area.

When I checked with a local lawyer he said that it's not possible to get a separate building permission for 1300sq ft now.

What is the possible solution to this. Is the building a illegal construction now in eyes of Municipal Corporation. What other problem I can have if I get loan from any other bank overlooking this issue. Please suggest.

Regards
Sunny

How to vacant our flats which are under the illegal posession of my father and his second wife ?

My grandfather owned a property (Land on which building (6 flats) is constructed) by the means of sale deed executed in his favour. My grandfather has dispute with my father regarding the property. He was forcing him to execute a will/gift deed in favour of him. My grandfather had lodged lots of FIR in local police station regarding his abuse and harrasement which is lasting from 4 years back to till date. My father has tresspassed two flats of the building with his second wife and continued to threaten my grandfather to transfer his self-earned property in his name. Therefore to save the property from my father he executed a registered gift deed in favour of his 3 grandsons. As it is self earned property no one can claim on such property. What should I and my two brothers do,so that the possesion of two flats which are currenty in the hands of my father and his second wife(Tresspassers) can be removed. How we can remove him from two flats legally? How to remove such persons(Father and second wife) from the property as he is threatning us to leave the propery or we 3 brothers have to face consequenses.
Please provide such solution that he can't reply to our defendant.
What steps we had to take to evacute the two flats under his illegal posession.

Property is in Ranchi,Jharkhand.

Partition suit

Dear Experts,
Sub: Ancestorial property- Partition case.
I have filed a PARTITION SUIT against my cousin brothers and sisters. The case is going on for the last one and half year.
History : The suit property is ancestral one, belongs to my Grand Father who was the original owner of the suit property. My Grand Father had 3 Sons and 2 daughters. My father (youngest son of my grand father among 3 brothers and 2 sisters) and my second uncle were minor, at the time of grand father’s death. The Doddappa (Uncle) was elder brother and he took charge of the family and educated his 2 minor brothers. But the two sisters are also elder and they got married at life time of my grand father (before 1930).
Soon after the death of my grand father, in the year 1936 the names of his 3 sons and his wife (Grand Mother) got entered in the records of right (Utara). But one of my second uncle shown interest to go separate and he demanded his share in the property. Then doddappa (uncle) and my father and my grand mother decided to give him one forth share of my grand fathers property and he got legally separated long back by way of Apsati-Watni.
At a later stage after the death of my grand mother, her share is equally distributed to my doddappa and my father. After the death of my doddappa and my father respective successor family members name has been updated in the records of right document.
Now the suit property is one which is not partitioned and it is undivided combined property by way of succession of my father and my doddappa (Uncle). I tried my level best to resolve the problem and get the partition done. But my cosines (Doddappa’s sons) are non co-operative hence I have to go to court as there is no other way left.
In my plaint copy I have not made party of my father’s sister as there is no name by succession exists in the records of right document.
Our defendants have taken objection in their Written Statement saying that my father sisters name is omitted/ignored purposefully and get the partition done without giving any shares to them.
Clarification Required:
Is my father two sisters who got married much earlier to year 1930 & now they are no more – in such case are they eligible for share in their fathers property? What Indian Law states in this case. Please clarify the same.
