Dear Respected Experts
I have a Query regarding Property partition of my best friend from Kasargode.. hope your good offices can help him...
My friend says...
My paternal grand father's inherited property was partitioned between my father & 2 brothers after the demise of grandfather.
Their names... Eldest one is Sri. Karunan, 2nd one is Sri.Pavanan, and 3rd one is Sri. Sugunan (my father).
The partition was done and the deed was registered in July 1957.
Partition was registered as 2 schedules namely,
Bank deposits and land as per Schedule A for eldest brother Sri. Karunan
Property as land as per schedule B for 2nd and 3rd brother (my father) as joint holding
The reason for keeping properties for 2nd and 3rd brothers as joint was that the 2nd brother was not well and unmarried. my father was to take care of that 2nd brother. This was orally agreed between all during partition.
So the schedule B was kept for my father and his elder brother together. jointly
The 2nd brother died in 1967 unmarried.
Both my father and his eldest brother were married and have family and children.
Both my father and his brother died in due course.
My father was enjoying the property as per schedule B without any claim from other brother when he was alive or his wife or his childrens for the share of property of demised brother who died unmarried in 1967.
Till now that is till 2014, nobody has claimed share of demised unmarried brother's portion of partition.
My humble question is sir,
Can we partition the property as per schedule B among we children, as we think sole right of the schedule B is for my father.
Can the family and children of my father's brother (Sri. Karunan) come and claim for the share of brother died in 1967 (Sri.Pavanan) ?
Are we entitled to give their share claiming adverse possession?
If they come and claim for share will it be time barred?
My father had a sister late Mrs Suguna at the time of partition in 1957. she was not given anything in the partition and not made a party of the partition deed of 1957. She has children who are alive now in Orissa. Can the children of mrs. suguna came and file a suit for cancellation of the deed of 1957 and pray for re-patrition making them also parties.
Kindly enlighten me sir.
regards,
sanker
Hello Experts,
I have a query regarding a property.
The Facts are as under:
A property has been purchased by the father in 2013, and after purchasing the property, but the ownership is not transfered on his name and the total consideration has been paid by the father, but unfortunately the father is demised (dead) and the son is well aware of the fact the his father has purchased the scheduled property, so the son approches the land owner and the land owner gives all the documents pertaining to the said property to the son after charging an additional amount of Rs. 30,000/-, but the property is still registered on the name of the land owner.
1. Now my point is how to transfer the proerty on the sons name if the land owner is ready to coperate? Can we register the property on the sons name by showing the payment details of the father or do we have to apporach the court of law?
2. Incase if the land owner is not willing to coperate what can we do?
Plz need your suggestions on both the points, as the intention of the land owner is not clear, as he has given the the documents, but the ownership title is still with the owner.
Thank You,
Naveen Kanth.

Hi,
I have 3 queries.
I purchased a flat in Pune in 2009.
I did not purchase parking space, as I did not have a vehicle.
Now, society is allotting open parking space for those who do not have parking as well as additional parking for those who have more than one vehicle.
Now effective Oct-2014, our society has started charging Rs 1800/- per month per parking space. (Applicable only for new allotment. Not applicable to those who already have a reserved parking.)
The parking charge is NOT applicable to those who have already purchased parking from the builder. It seems to be injustice.
My query is:
1. Can society apply so high charge Rs 1800/- per month only for those who does not have even a single parking space ?
2. How society can justify Rs 1800/- can be justified for charges ?
3. The majority of the members agree with the charge as they have already purchased the parking and nothing extra is going out of their pocket. In this case, how to defend in the AGM ?

We have flat on top floor & below flat owner had informed us that there is some leakage in his flat from our flat. So both we agreed to carryout work in 3 step immediately with sharing cost. at each step leakage will be observed for few days.
Now 1st step has been completed still there is leakage so we have to decide to proceed for next step. Now other person is saying that due to leakage there is damage in wall & water heater in his house & he is saying that i have to share cost for that as well, which i have denied. Now he is threatening that he will take legal action & even not ready to share further cost.
Nothing was in writing from both side, just mutual trust & we always tried to cooperate for all work even we are staying above his flat.
So my main query is - As per law whether the repairing cost against leakage has to share by both parties or even damage caused by this leakage also has to share.
Appreciate your advice.
Receipt of payment
the owner of a property i want to buy wants me to pay rupees one lakh as token money. would it be sufficient to obtain a handwritten receipt on plain paper from him. Or should i use stamp paper. what kind of stamp paper?
in case of a fraud will the handwritten receipt on plain paper with his signatures and thumb impression serve as sufficient evidence in court, or should i do something else.
