Is copying and pasting news from other websites onto my website copyright?

Dear lawyers,


I am in the process of designing my own website which is based on health and beauty.The site is not ready yet.

My site will include interactive and informative options like Discussion forums,blogs,healthy recipes and NEWS SECTION.

The NEWS section is just a small section of my site,amongst the various other sections.This means that my site is NOT A NEWS WEBSITE.

In the NEWS section,the registered members of my site will post latest news related to health,beauty and nutrition,after copying and pasting the news from NEWS WEBSITES.


I will make it a rule that they mention the source of this news,ie,the name of website link,from where this news has been copied and pasted.If they don't mention the link,I will delete the news immediately.


1. Can this copy and paste lead to copyright violation,even if the members mention the source link of the news,next to the posted news?For example:


http://timesofindia.indiatimes.com/life-style/health-fitness/health/Gadgets-leading-to-health-disorders/articleshow/8316332.cms (SOURCE LINK)



2. Someone told me that for doing this,permission has to be sought from that news website,from where the news will be copied and pasted.But I have a doubt.


In many websites,including in Lawyersclubindia.com I have seen members posting news from 100s of different websites daily.How is it possible for the administrator to seek permissions from all these news websites beforehand?He cannot predict beforehand that the members will copy the news from this particular website.So how can he take permission from that site in advance?

contruction on roof rights

Dear Sir,
I purchased a builder floor in Uttam Nagar on upper ground floor , other person purchased top floor in May 2011 ( Total G+4 Floor in building), I get to know , it is with roof rights and now he is doing some temporary construction (Channel and shed) on roof, Is it llegal or illegal ?? Also i heard that now registry with roof right is not llegal, is it correct or wrong?

if we get threaten e-mails, how to find the source( IP address, phone number etc ) of e-mail? whom we have to approach to identify the source ( IP address, phone number etc ) of e-mail?

Ancesteral Property right

My Grandfather had 3 children, 2 of them are no more. I am one of those dead son. Now the only uncle of mine wants to sell our ancesteral property which is in the name of my grandfather. So he is making the pressure on my grandfather to distribute the property & give him the largest portion of it. Actually the house where we are staying has 4 floors. Ground floor where my uncle resides is of highest market value. I resides on the 2nd floor & on the third floor my grandfather himself resides. And that third floor is made my late father 10 years before. At that time he spent a large money on it, so that our grandfather can live their life as per their requirements. And at that time it was decided verbally among the brothers and my grandfather that that 3rd floor will be given to us. But now they are annoying the same. What should I do as my grandfather is going to shift 2 floors on his name.

trade mark registration issue

Hello
We are an event management company and are planning to start an online website around weddings and wanted to keep the name something around shaadi .. e.g ourshaadi.com .. but we were told that if we do that .. shaadi.com will sue our company and get a stay order.

My question .. is unlike a brand name like say samsung which is not an english word .. shaadi is a ritual and a generic term .. is it still a valid case?

Sherlok holm stories

I would request you to kidly advise whether the sherlokholms stories can be retold and published in india without obtaining permission. The auther was died in 1930 and whether the copy right act is still operative on the books or charectors?

Transfer of Membership

My father has given me POA to redevelopement procedures for our MHADA flat in Thane. What is the procedure for membership transfer. Our commitee members are not willing to make me member as they are not following procedures for redevelopement.

Trade mark application objected


Dear Experts,

A Trade-mark application was submitted under Class-42 for a CONSULTANCY FIRM,

"Class 42 in respect of Consultancy services on all matters relating to the commencement or expansion of business/industry, investments and trade strategy and business development services to and for institutions, concerns, bodies, associations (incorporated or unincorporated), departments and services of the Government, public or local authorities, trusts, scientific research and development centers, and related services ancillary to the above mentioned services, ‘in and included in Class 42’.

The above said application was objected by the Trade mark registry (there is no opposition, but the objection by registry) as follows :-

"The above mentioned application has been examined under the provisions of Trade Mark Act,1999 and Trade Mark Rules,2002 and the trade mark applied for is open to objection under the following sections :
1. The trade marks-which are devoid of any distinctive character, that is to say, not capable of distinguishing the goods or services of one person from those of another person;which consist exclusively of marks or indications which may serve in trade to designate the kind, quality, quantity, intended purpose, values, geographical origin or the time of production of the goods or rendering of the service or other characteristics of the goods or service.
2.Other Objection/Requirement/Conditions/Restrictions.
YOU ARE REQUESTED TO AMEND SERVICE DESCRIPTION SINCE ALL SERVICES ARE FALLING IN DIFFERENT CLASSES EXCEPT "SCIENTIFIC RESEARCH AND DEVELOPMENT CENTERS".

In your esteemed opinion, what shall be the best reply to the above objections. If any case laws are provided, the same will be highly appreciated. Thanks and Regards.
