will we give answer or not

in 1980 we are happy family but after the death of my grandfather in 1995 there is a dispute b/w my uncle and my father .as we have a residential plot in which we stays the power of attorney at the purchase time of the plot is on my uncle's name and after 2-3 years the power of attorney was cancelled and there is a registry of the plot on the name of my father in front of sub registrar and after that we can done the plot freehold on name of my father as a landlord of the plot.and also we have a shop which is alloted by dda to my garndfather and in the lease deed issued by dda the name of owner was written as my grandfather's name M/S firm name and at the time of the allotment of the shop my uncle was a partner in the firm and without breaking the partnership my grandfather transfered the shop to me and my father and also my grandfather made a partnership deed between me and my father but we never do working with that partnership deed and after ten years my grandfather and my uncle dissolve the partnership deed and uncle gets his share of capital invested in the firm and after that my father works in the firm as a proprieter of the firm and now my uncle claims that as he has the power of attorney of the residential plot so he is the owner of the plot and also he claims that my grandfather transfered the shop to my father and me and made a forge partnership deed between me and my father ,so my uncle claims that he is the owner of the shop and we did the forgery by making partnership and he send the lawyers notice that to do out of court settlement by giving him shop and house otherwise he will go to court.SO i want to know that whether we will give the answer to my uncle's lawyer or neglect it and also in dda the conveyance deed is name of father and me so who will be the real owner of the shop?

who will get injuction

we have a plot which is gift deeded to us three years back by grand mother to my father by paying stamp duty in front of sub-registrar and also my grandmother made a registered will on name of my father and now six months back my grandmother died and now my uncle claims that he has a will of my grandmother in which my grandmother gave the plot to my uncle and also my uncle goes to court for the probate as he has a fraud unregistered will because my grandmother lives with us for past five years and she is not in contact with my uncle ,so my uncle made a fraud will,if my grandmother made a will on name of my uncle than why didn't he go to court for regitration of the will in the court .now my lawyer tell us to go in the court for injuction of the plot ,on first hearing of the injuction case in the court ,judge ask us to show the possession of the plot so we go their and took the required photographs of the plot and on the same day my uncle broke the locks of the plot goes to the court that he has the possession of the plot and also we filed the complaint in the police station but due to my uncle contacts police do nothing .Now there are many hearings in the court and judge gives us the date on which judge gives his decision on the injuction .So sir i just want to ask you that as we have registry of the plot ,so who will get the injuction of the plot?

Dress code of Advocates.

Many of the countries had dropped the advocates formal robes, they are using the normal office dress code (shirt and tie). Any body filed any case for the similar change in India.

Inclusion of items in Trademark

One of my clients has a registered trademark under class 19 of Trademark classification. The items included in the certificate of registration are Plywood, Blockboard, MDF, Plain & prelam Particle board, Decorative Ply, Laminates, Partition & Sealing boards. Recently we became aware of a manufacturer of FLUSH DOORS who is using my client's registered trademark brand without my client's permission. Please note, this item is very closely related to BLOCK BOARD which is mentioned in the certificate of registration. Kindly advise if my client can stop them from doing so and also can any legal action be taken against them.

Also there is another person marketing marbles in the brand name of my client. Can any acion be taken against them as well?

father-in-law property rights

My husbent and me live far from my father-in-law about 8year. Now I came and live with them. But my father -in-law and brother in law have not to give my house property.My husbend has not yet any job.How can I take my right.

patent agent exam.

Dear Sir,
I have been practicing as an advocate in Allahabad High court for more that 11 years. I have also done Bachelor of Arts & MBA(Specialization in Intellectual Property Rights) & MS Office. I want to appear in Patent Agent Exam.
Kindly advice me that considering my education am I able to appear in the exam of Patent Agent?

Assignment of trade mark

Dear Sirs,

I want to assign one trade mark used by company to another company. Actually i have no idea regarding the entire process to be followed. Kindly advise me what to do. Is a drafting of assignment agreement will be sufficient?? If not then what the other process? Whether the agreement drafted if only notarised will be o.k?or registration required?? when the assignment will be done shall we be debarred from using the product or we may use it by a seperate name??

property rights

Hi
I have asked this question but can`t understand
My father has a shop in his name but he is expired but before that he has made a affidavit on stamp signed by the notatary that in the event of death the property will be transfer to his son alone will this simple affidavit on stamp paper will be sufficent of transfer of a shop in Thane maharashtra as we are 4 member now (mother 2 sisters and myself)as there is no will or nomination of the above mention property only a affidavit

right of plot

i already asked about this query ,now i am going to tell about my query in detail.In 1965 my grandfather has a shop in karol bagh delhi and there is a scheme in dda to shift shops from karol bagh to mayapuri in delhi .So in 1975 dda alloted the shop to my grandfather in dda and the title on the lease deed of the shop is as my grandfather's name M/s firm name and in 1970 my grandfather made a partnership with X with the same firm name and in the ratio of 70:30 in which 70% goes to my grandfather and in this partnership deed the shop is not mentioned and X is only partner in firm for sale and purghase of goods.And in 1983 my Grandfather transfered this shop to my father and my uncle and dda gave us the conveyance deed also in the name of my father and my uncle and the partnership between my grandfather and X continue till 1992 and in 1992 my grandfather returned the capital of X and after that my father is working on the plot with the same firm name as a propriter on that shop till now and now in 2011 X claims that my grandfather made a forgery by transfering shop to my father and my uncle and my father and uncle also made a fraud .So sir i want to know whether X has any right or not on the plot as he claims that he is partner in the firm at the time when my grandfather transfered the shop to my father and my uncle.
